Lynching victim Pehlu Khan's son shot at in Rajasthan


Jaipur, Sep 29 (IANS): Unidentified assailants on Saturday opened fire at a car in which Rajasthan lynching victim Pehlu Khan's son Irshad, and other key witnesses in the 2017 case were going, officials said.

They were on their way to a court in Rajasthan's Behrod for a hearing. Pehlu Khan was lynched by a mob last year on the suspicion of smuggling cows.

Irshad has lodged a complaint in Alwar alleging "some unidentified miscreants opened fire on their car while they were on their way to Behrod to appear for a hearing".

He was accompanied by key witnesses in the case who were to appear in the court to register their statement. Those in the car included Ajmat, Rafeeq, Areef and human rights activist Asad.

Irshad said at around 9 a.m., a black car, having no number plate, overtook them and one of its occupants called them to say that they should not go to depose as witnesses in the case.

Also, they were asked to stop the car but when they did not, they were shot at. Soon after, they went towards Behrod side while Pehlu Khan's son and the witnesses went back to Alwar.

Alwar Superintendent of Police Rajendra Singh said the case will be thoroughly investigated. He also said the footage collected from CCTVs was being reviewed.

Asked why they did not get a complaint register in Behrod, Irshad said "they were too scared and hence preferred to stop their car in Alwar". However, Singh said had they lodged their complaint in Behrod, the culprits might have been booked earlier.

Pehlu Khan's son has requested officials to shift the case to Alwar or Tijara, saying it is risky for them to travel to Behrod each time for a hearing as they have been getting constant threats there.

    I suppose they are taking the cue from Gujarat to silence and intimidate prosecution witnesses if not eliminate them altogather.

    The Silence of the Lambs i.e the authorities including the PM is what is encouraging such brazen attempts to subvert the law.

    A Botched Investigation Helped Get Six Accused in Pehlu Khan’s Killing off the Hook.
    Four key witnesses in the Pehlu Khan lynching case, including his two sons Irshad and Aarif, were allegedly fired at on Saturday morning, while they were on their way to a court in Behror to submit their testimony.
    According to the chargesheet, all the six accused named by Pehlu were absconding and had a Rs 50,000 reward on each of them. However, they returned home after the clean chit was given by the CID.

    “If you see the records available on the Rajasthan high court website, the six people named by Pehlu are not included in the chargesheet. They were not questioned before the investigation was concluded,”.
    The bail orders for eight out of the nine accused arrested were granted on the basis that ‘the accused were not named in the FIR’, that ‘no specific act attributed to them’ and ‘existence of two sites of offence – Jagwas chowk and Ramkumar chowk – and presence of accused at one chowk which is not the spot of murder’. The plea also said ‘no incriminating recovery’ was made from them and ‘the case of the petitioner is akin to that of the co-accused who have been given the benefit of bail.’

    “It is a deliberate attempt to twist the case in favour of the accused. In the map drawn by the police, two sites of offence are not mentioned and neither is there any record of injuries made at these two different locations. How can one prove that the injuries that caused death were made at a specific location and not the other?”.
    It does not make sense for a person who purchased milch cows for Rs 45,000 to slaughter them, which would earn them a mere Rs 6,000.

    The Supreme Court on Friday asked 19 defaulting states to implement its July 17 judgment providing a stop-gap mechanism to deal with such incidents within a week.
    A bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud warned the other states to fall in line by September 13 or have their home secretaries summoned for personal appearance before the court. "No further time will be given to the states and if they do not file affidavits of compliance, their home secretaries will be asked to appear in person," the bench said.
    In a landmark judgment Supreme Court of India on July17, 2018 condemned the lynching incidents across the country. The Bench headed by Chief Justice Dipak Misra said the horrendous acts of mobocracy cannot be allowed to become a new norm in the Country.
    When witnesses testify in a criminal case, they are providing a service to the state by helping in the conviction of state offenders, therefore, it is rudimentary for the state to protect its witnesses. When the state makes no additional provisions for the witnesses, they are more susceptible to threats and violence, making them reluctant to come forward or testify correctly. The lack of a proper witness protection scheme is, therefore, a major disadvantage to the effectiveness of the criminal justice system.

In March 2002, a mob burnt down a Best Bakery in Vadodara, killing 14 people. The main witness in the case, Zaheera Sheikh was compelled to retract her statement.     Several other countries, including the United States, United Kingdom, Canada, Israel and Italy have highly effective and secure witness protection programs.
    This is Why India needs a strong witness protection program.
