SC directs Kolkata commissioner Rajeev Kumar to cooperate with CBI


New Delhi, Feb 5 (PTI): The Supreme Court Tuesday directed Kolkata Police Commissioner Rajeev Kumar to make himself available before the CBI and "faithfully" cooperate with the agency in investigation of cases arising out of the Saradha chit fund scam probe.

The apex court said Kumar will appear before the Central Bureau of Investigation (CBI) for investigation at Shillong in Meghalaya. The apex court also said no coercive steps, including the arrest of the Kolkata Police chief, will take place during the course of investigation.

A bench headed by Chief Justice of India (CJI) Ranjan Gogoi also issued a notice to Kumar and sought his response before February 20, the next date of hearing on the allegations by the CBI that he was tampering with electronic evidence and that the SIT headed by him provided the agency with doctored materials. The court directed Kumar to make himself available before the CBI and "faithfully cooperate" in the Saradha scam probe.

The apex court also directed the West Bengal chief secretary, the director general of police (DGP) and the Kolkata Police commissioner to file replies on the contempt pleas filed against them by the CBI on or before February 18.

The bench also comprising justices Deepak Gupta and Sanjeev Khanna said on consideration of replies of the chief secretary, the DGP and the Kolkata police commissioner, the court might prefer the personal appearance of these three authorities on February 20.

The bench said the apex court's secretary general will inform them on February 19 whether they are required to be present before the apex court on February 20.

    It seems to all that the high drama is politically executed from central and state government. It is very sad that central government has the power to manipulate CBI the way it wants. It should be an autonomous body like supreme court and the central government should have the power to intervene with 2/3 majority in some special cases.

    This is second recent incident where Hon. Supreme Court had to intervene.
    First in Kerala Shabarimala case with regards to no entry of females and now in this case.
    But people are reacting in a contradictory language in both the cases. Very Strange!
    Lucky guy- Mukul Roy, main accused of Narada Scam, former number two of Mamata Banerjee, who joined the BJP ... NOW NO CBI INQUIRY!

    The people are convinced that the CBI is being misused by the Modi Govt either to presuurise opposition leaders or indulge in vindictive politics. We have seen the CBI and enforcement directorates being extensively being used to settle scores with oppositon leaders while leaving their own leaders deeply involved in corruption going scot free without being hounded by the CBI.

    High time we disband the CBI and leave it to the states to deal with all corruption issues so that any Govt at the centre cannot use the CBI to indulge in any vindictive politics.

    Have we all forgotten how Modi used the CBI for months to target and harass the Delhi Chief Minister Arvind Kejrival.

    Though I may be wrong...,

    The apprehension about CBI coming with some documents/information, planting it as evidence and claiming it as a reason for arrest seems to be purged by the Apex court order at least for now…, (mathlab use of FEKUISM theory). after all LORD BRAHMA knows everything...,

    CBI didnt go to Kolkata to "arrest" anyone...this Cop was summoned 3 times but failed to appear for "questioning"...though i think SC should have shown more "spine" but in the current judgement also the stand of CBI has been vindicated then how is this a moral victory of "Mamta" ??????

    Misuse of power by CBI has been restricted. Unnecessary arrest on pretext of questioning as a part of political vendetta is a very common feature of CBI's investigation process.
