Centre tells SC: Rafale documents are stolen


New Delhi, Mar 6 (IANS): The Centre on Wednesday told the court that documents related to Rafale that have appeared in the media and cited by petitioners seeking a recall of the December 14 ruling giving a clean chit to the government on the purchase of 36 Rafale fighter jets were privileged documents stolen from the Defence Ministry.

Referring to the dissent note by the three members of India Negotiating Team (INT) in the eight-page note, Attorney General K.K. Venugopal told the bench of Chief Justice Ranjan Gogoi, Justice Sanjay Kishan Kaul and Justice K.M. Joseph that it was being probed if they were stolen by former or present employees.

The Attorney General referred to an article in The Hindu by its former Editor N. Ram related to the note by the three members of the INT and said that it was being investigated.

The Attorney General took exception to the newspaper publishing a report on February 8 - just prior to the hearing of the Rafale plea by the top court.

At this, CJI Gogoi wanted to know that if what had been published in two write-ups were based on "unauthorized" documents, what action the government had taken in the first instance when the story appeared on February 8.

The court asked the Attorney General to apprise it of the steps taken vis-a-vis the documents allegedly stolen from the Defence Ministry.

As the Attorney General sought that the both the review petitions and the application for perjury proceedings against the officials who misled the court and suppressed material information from it be dismissed at the outset, the court said that let Prashant Bhushan say what he wants and the court will decide what part of it to be accepted.

    Last week, PM Modi said in Churu that the "country is in safe hands". Today, the AG informs the SC that the Rafale file is stolen. MoD is in South Block, one of the most protected buildings of the country which also houses PMO. Go figure.

    At this rate anything can be stolen from the country. What was the chowkidar doing? Was he sleeping while on duty? If indeed he was sleeping then he needs to be sacked from his post for dereliction of duty. If the chowkidar can't take care of some vital documents, how on earth is he going to take care of the country? How is that arrogant Defence Minister going to answer the country? Does the government think it is a joke to just say that the papers are not found and hope to get away with that? Please stop fooling us. This is probably the biggest joke of the century.
    Fine, for a moment let us believe what the government says and let us assume that the papers are really stolen. The question that then needs to be asked is, who is going to benefit by robbing these papers.
    My God, I just can't believe such a thing is happening in our country. This is the limit, my friends. Seriously. I have to pinch myself to make sure I am really reading this news.

    A Mangalorean in the company I worked, had taken MHADA house by submitting fake papers. Sensing it, after sometime, he was called in the govt office and since, officer could not find his file, he was told to go. The previous day that Mangalorean had contacted the peon and after bribing, took the file to his house and burnt it. He is still in that MHADA house. Missing documents is the oldest trick.

    To conceal a lie, 100 lies have to be told. That is the problem with Modi Govt., in everything that they do.

    It is the supreme court which earlier looked at the evidences provided by Modi led BJP. It gave an verdict saying they are not going to look into the issue of pricing or procedure. Fine. However, within the evidences provided the center had lied about PAC report. It was all clear that center gave all the wrong information to court to get an favorable verdict.

    The complainant have the evidences in possession, Modi led BJP has lied to the court. Evidences provided are credible, Modi's lawyer can not deny them as forged. He has to accept as he has no other choice.

    Modi always said Rafael deal was clean deal. So, irrespective of whether the documents are stolen or received from someone who wants to expose corruption, must be reviewed by the court to cross verify how much Modi lied and what all issues it is lied. Whether the lies what Modi led govt said is form of treason or how much of money that got exchanged. At least out of curiosity.
