Bangalore: No Churches, Temples, Masjid on Public Sites, HC Tells Govt

The high court on Friday March 6 said no church, temple or masjid should exist in public sites and asked the state government to come out with a uniform stand within two weeks. It asked the government what action it proposes to take about places of worship encroaching upon civic amenity sites and other public properties.

"If a poor man encroaches upon one cent of land, you make it a big issue. But in the name of god if it is encroached, you take it as blessings. As far as we are concerned, rule of law should prevail. You have to evict those people by giving notices in accordance with law, even issue notice to God if required. A principle of natural justice applies to God also. Don’t favour anybody.

"No church, temple or masjid in public sites, this is the stand of judiciary. It seems you are afraid to take any decision. There should be no sentimentalities in this issue," the division Bench headed by the chief justice remarked while hearing a PIL connected to encroachment of Lakshmana Rau Park in Okalipuram area.

    A very good ruling from the High Court. I support it whole heartedly. The religious heads of all religions should take the lead out here in demolishing alll illegal places of worship. And nobody hsould take the law in their own hands. And Mr. Bhat, we do understand why some Hindus feel aggrieved when any political party plays vote bank politics.

    We all are victims of such politicians who play the communal card. I for myself will never vote for such politicians who stand for elections using the religion. Instead let every person give their vote to parties who believe that justice, peace and prosperity should be for all citzens of this country not mandir, masjid or church

    I congratulate the Judiciary for taking a bold Stand regarding constuction of these religious structures in public utilities like parks,play grounds.All these things happen because of high handedness of a few politicians. But what will the gov't do if these structures were there from a long time.

    While accepting the ruling by the HC, to evict those people by giving notices in accordance with law, I totally disagree with their statement, even issue notice to God if required. A principle of natural justice applies to God also." I am sure the one who said these words is out of his mind. Why accuse God for wrongs done by the people, besides the whole world belongs to God. People should demand apology from this judge, who has no right to insult God publicly for what ever intentions he might have.

    Very Honest Judgement by the Honest Judges. Religion and State should not mix. All worship places on Public Property should go immediately. They are really for money minting rather than for worshipping. I hope and pray that 3 'Aswatha Katte's near Shedigudda Market,near Karangalpady, which have taken more than half the road should go first. Couple of years back a Lady has to loose her life due to this ashwatha Katte.

    Dear Ravi Kadri, I understand your point. However, as far as the comments you are talking about "BJP" issue, I don't it will stop till such time it gets its share of beatings!! (share of = justified in multitudes sense, common sense is deferent anyway)

    Hi Bhat, Thanks for the info but unfortunately I could not find the article you refer to giving these statistics. The figures that you quote for Madarasas and Churches are too good to be true and need to be taken with a pich of salt. But having said this, I also agree with you that even the income from the temples should be spent for the upkeeping of the temples.

    It should not be left to the ministers to use it for their political ends and to make daily announcements of allotment as if they give it from thier personal account. I think all the readers here agree that whether it is temple or church or mosque, it should never be constructed on public property and if we agree with it we should all support their demolition.

    A judgment of this kind should have come almost immediately after the independence in 1947. BETTER LATE THAN NEVER!!!! I praise the same God who inspired our judges to pronounce this historic judgment to evict HIM by giving legal notices to quit all the public places if HE does not quit, then evict HIM legally from wherever HE causes inconveniences to people of GOOD WILL.

    It is definitely a welcome decision. I have been in Bangalore many years and I have witnessed so many shrines coming up on main roads, many of these, as a Christian I dare say that christian shrines are aplenty, are of vested interests.

    There are local goons who thrive on these shrines making money during festivals to drink and make merry...all in the name of religion!!! I think religious leaders like the bishop and swamijis should convince their people and take the lead to demolish these shrines rather than blame the govt which only eyes the vote bank. Is anybody listening?...

    GOD does not want free stuff. So free land of Government should not be used for selling religion. God wants humble places which is in our HEART. We hve to work hard and life a good life if you want religion and God. Not by encroaching in Government lands, making money by selling religion and then the so called great men who say they are high priests enjoy the benfits of this.

    Good judgment. God bless Karnataka High Court judges who passed this judgment. At least one can expect good roads. DC should implement this as weapon without mercy to demolish whether encroached construction whether it is church, temple or masjid build ups. Rule should be implemented without any partiality.

    The important aspect in this judgment is the judges mentioned that if a poor man encroaches one cent of land then it is big crime where as the rich encroach acres of land nobody questions them.

    Hi. Linzhi. Pls read and comment why BJP Should not give the money to temple.(the figures are only from Karnataka Temples) There are as many as 2,07,000 temples in Karnataka and the total income of these temples amounts to 72 crores and only a sum of Rs. 6 crores is being spent by the Government for their upkeep.

     On the other hand, the Government spent a phenomenal amount of Rs.50 crores for the madrasas and Rs.10 crores for the Churches, and for the Hindu temples only a partly sum of Rs.6 crores is being spent.(Data received from the Revenue section of Tourism & Temples, Govt of Karnataka, excerpts from an article by Anjali Patel dated 29/10/2003) (http://www.hindujagruti.org/activities/campaigns/religious/save-temples/siddhivinayak/)

    It is absolutely welcome judgment. Karnataka government must make use of this opportunity and bring legislation in line with the judgment. As far as comments against BJP in this column it is become psycho issue with certain people due to which they are seeing ghost in BJP every issues these day. I would like to remind those guys that by their comments on BJP and Hinduism they are pushing them more into anti minority wave. For god sake for country's sake please stop such comments.

    I dont understand why for every news people bring BJP to accuse... If BJP is giving to Matts/Temples.. Congress is doing everything for Masjids/Churches.. what are the activities going on in Tirupati - isnt it by congress?... Why people only biased towards BJP.. all parties are same on this vote-bank politics.... This is very good decision - and should be implemented very strictly.

    I welcome the court ruling. Religion and politics should never be mixed. The government should not patronise one particular religion. If a place of worship is required to be constructed, the devotees should bear the cost. After BJP came to power in Karnataka almost on a daily basis we see announcements made by the CM and other minister allotting funds and land for the temples as if the only agenda of BJP is to build more and more temples and expand the existing ones and at the same time try to destroy as many churches as possible. We need to se with how much sincerety the govenment implements the court ruling.

    I urge the karnataka government to take strict actions to implement this judgement without descrimination among the religions. This is the best judgement to stop encroachment of public property in the name of religion.
