'Time to stand up with judiciary': Jaitley on allegations against CJI


New Delhi, Apr 21 (Agencies): A day after allegations of sexual harassment against Chief Justice of India (CJI) Ranjan Gogoi rocked the judiciary, finance minister Arun Jaitley on Sunday said that 'institutional disrupters' were 'destabilising' the institution of CJI by lending shoulder to such unverified allegations. 

In his blog Jaitley said, "It's Time to Stand up With the Judiciary", asserting that those who peddle falsehood should be dealt with in an exemplary manner.

The allegations were levelled by a former employee. The Supreme Court even held an extraordinary hearing on Saturday after the alleged victim accused the CJI of sexual harassment and persecution. The former employee has described two incidents of alleged molestation by Gogoi in her affidavit, both of which allegedly took place in October 2018, only days after he was appointed as the CJI.

Jaitley said: "In terms of personal decency, values, ethics and integrity, the present Chief Justice of India is extremely well regarded. Even when critics disagree with his judicial view, his value system has never been questioned. Lending shoulder to completely unverified allegations coming from a disgruntled person with a not-so-glorious track record is aiding the process of destabilisation of the institution of the Chief Justice of India.”

The minister further said that those who “peddle falsehood to destroy the institution are not dealt with in an exemplary manner, this trend will only accelerate.” The incident of a junior ex-lady employee of the Supreme Court making harassment charges against the Chief Justice of India has acquired a “disproportionate magnitude”, Jaitley said. “Such complaints, when they are made in the ordinary course of any administrative functioning, are referred to the appropriate Committee.

However, when the complainant distributes copies of her representation to other Judges of the Supreme Court and the media in order to sensationalise her allegations, it ceases to be routine. “When four digital media organisations with an unparalleled track record of 'institutional disruption' send similar questionnaires to the Chief Justice of India, there is obviously something more than what meets the eye,” the minister added.

Jaitley regretted that last few years have witnessed the consolidation of ‘institution destabilizers' in a major way. “For the ‘institutional disruptors' there are no red lines,” he wrote. “Many of these destabilizers represent Left or ultra-Left views. They have no electoral base or popular support. However, they still have a disproportionate presence in the media and academia. When ousted for mainstream media, they have taken refuge in the digital and social media… “Even though most of them subscribe to fringe ideologies and ideas, it is regrettable that a section of the Members of the Bar affiliated to the Congress Party tends to join them.

Frequent attempts are made to get some Parliamentarians to sign Motion of Impeachment against judges and even the Chief Justice on unsustainable grounds. What has always puzzled me is the Congress lending support to such fringe campaigns”, the minister said. Justice Gogoi was sworn in as the 46th Chief Justice of India on October 3, 2018. He retires on November 17, 2019.

Jaitley said India has witnessed a series of attacks by the ‘institution disruptors' against judges who are unwilling to agree with them. “It may not be an exaggeration to say that today both in Court and by creating an environment outside, a mass-intimidation of Judges is on,” he said.

Stating that reputation is an integral part of a person's fundamental right to live with dignity, Jaitley said an intimidated judge can fear consequences of a possible view that he is taking. “It is, therefore, essential that all well-meaning persons stand with the judicial institution when destabilizers get ready for an assault,” he said.

    Supreme Court and CJI are highest points of our Judiciary.

    They need to come clean on the serious allegations made.

    We cannot brush aside these allegations citing conspiracy etc.

    We need not stand up with judiciary in this issue.

    Judiciary has the system to reveal the truth and come out with facts and render justice.

    Why cry foul play before investigations on the alleged matter? Govt should be neutral on this issue.

    Jetley Saab. Sabarimala is a glaring example of how you, Modi and the Govt have tried to undermine the unanimous judgement of the Supreme Court and encouraging your siblings in Kerala to disobey the court orders. The issue was initially welcomed by both the BJP and the RSS including Mohan Bhagat but sensing that this was an opputunity to indulge in Divisive politics the issue was politicised to create disorder and mayhem in Kerala instead of abiding by the orders of a Constitutional body like the Supreme Court.

    It was a joke then with the central Govt issuing advisories to the state Govt to provide protection to women wishing to visit the temple while actively encouraging your cadres to openly disobey the court order. You allowed this situation to explode so that you could gain a foothold and politically in Kerala.

    If you, Modi,BJP or the RSS felt so strongly against the Supreme Court order, you had a simple remedy of issuing a Ordinance from the Central Govt but instead decided to indulge in divisive Politics for cheap electrol gains. ope the people of Kerala will punish you for this duplicity.

    Mr. Jaitely for your information the CJI has said that the democracy of the country is at threat, so which party is at the helm of affairs? Stop blaming the Congress about it. A very sad state in our country. The center had a problem with CBI, the RBI governor Urjit Patel resigned and now the CJI has sexual harassment allegation filed against him. How can so many big institutions of the country be tossed about? It is clearly showing that the truth about many SENSITIVE ISSUES is going to come out and larger forces are trying to suffocate it.

    Bjp making drama. Public sab jaanthi hai who are actually behind this conspiracy. Cji is known for his honesty loyalty and of very strict after his duty who cannot be sold.
    As per the Telegraph Daily News a Delhi-based advocate has claimed that an unknown person met him a few days ago and offered him Rs 1.5 crore to organise a news conference where a sacked woman Supreme Court employee would level allegations of sexual harassment against Chief Justice Ranjan Gogoi.

    Does Jaitley, who could not win an election from Amritsar, and joined the central cabinet by back door, has "electoral base or popular support ?" In his view the poor victim does not have "reputation" of her own. Is the CJI so weak that he could not defend himself? An office bearer in the "executive" wing of the government is trying to help a top officer in the "judiciary". What is the quid pro quo? If the CJI is really innocent he will come unscathed if he follows the procedures available to him. Why interference from others?

    Jaitley Saab, describing this situation with grief and sympathetic words is no solution to this issue just to snub the affected person and condemn that person and get public support. Let there be just unbiased inquiry and then case be filed against CJI. CJI is also a citizen of India and the same law applies to him too. Let it go through proper channels. No need for emotional break downs.
