Mangaluru: Consumers Forum penalizes cable service provider for excess charge

Daijiworld Media Network - Mangaluru (SP)

Mangaluru, Jul 8: In a case in which a consumer of a cable service provider was found to have been charged over and above the actual charges the company is authorized to levy, Dakshina Kannada District Consumer Grievances Redressal Forum has imposed fine of Rs 13,000 on SAT-1, a cable TV service provider. The firm was found charging over and above the specified fee for the channels.

Laxmikanth, a resident of Vaidyanatha Nagar at Attavar, had got connection for television channels through a service provider named SAT-1. He had opted for certain television channels at the prescribed monthly rate of Rs 300. When he tried to view cricket matches through Star network sometime later, he could not access the channel. When he contacted the service provider, Laxmikanth was asked to pay Rs 20 extra to be able to view the said channel. As he refused to pay additional charges, he was not given access to the said channel.

The cable service owner did not heed to initial notices served by the Consumers Forum. Later he appeared before the forum. The forum, which arrived at the conclusion that consumer, Laxmikanth, had suffered on account of deficiency of service by the channel service provider, ordered SAT-1 cable service to provide Star TV channel to the petitioner without charging anything extra, and to pay compensation of Rs 10,000 and court cost of Rs 3,000. The concerned have been ordered to make the said payment within a month from the date of the pronouncement of this order.

    Dear Cable Operator,

We can sympathize with you and the new rules. However we ask you and all cable operators to be honest with us (the customer):

    1. Don't over-charge us.
    2. Don't block free channels like DD Sports so that you can force us to take Paid Sports channels.
    3. Explain the TRAI rules properly to your customer truthfully. Mention in the 100 channel list, the 25-26 DD channels are compulsory but the customer can add any channels of their choice in the balance.

Why are people crying now ? You voted for the central government back, so be happy to pay anything they demand. Are you sure that its always the cable operator at fault ? Have you taken the time to read all the terms and conditions on the government (TRAI) website ? Do you know that the government has increased the taxes (VAT) from 12% to 18% under GST ? Do you that the government created the concept of tariff for each individual channel, which looks nice but inherently means that cable operators have to pay more to the distributors and therefore your charges go up as well ? Do you know that bouquet of 100 'FREE' channels is not Free ? Do you know that know that your personal information, aadhaar number and channels subscribed is collected and stored by the TRAI (central govt).

You selected your government, so don't cry now. (Those who didn't vote for the current government please accept my sympathy.)

    @ William DSouza

    1. The 100 'Free to Air' SD channels carry a fee of Rs 130 plus GST which has to be paid by ALL subscribers. (especially if you want to pick and choose channels instead of opting for the operator's bouquet)
    2. If you want to subscribe to any extra 'Paid' channel, you have to pay for the channel cost plus GST.
    3. You can cancel any of the free SD channels in the 100 list to replace with your Paid channel, but you still need to pay the minimum Rs 130 plus the paid channel fee along with GST.
    4. There are only SD (standard definition) channels in the 100 list. If you want to add a paid HD (High Definition) channel then you have to remove 2 SD channels for every HD channel.

These are the new rules from TRAI-government. Some people may benefit, most may not.

Hope this helps. Read more here: https://channeltariff.trai.gov.in/

Presently in the ongoing cricket World Cup, where India is playing, it is freely broadcasted in DD sports channel. But the cable mafia is Mangaluru has blocked this free to air channel. Many of our neighbors who have not opted for star sports are deprived of watching the World Cup match in DD sports by cable mafia.
I request the concerned authorities to look into this matter and check the tomorrows match relay in cable network.

I had taken a printout of selected cannel package along with its total cost inclusive of GST from TRAI website to the cable operator named Bharath electronics who are under Malnad agencies. They charge more than what is prescribed by TRAI and when we told we will complain to TRAI the person said go ahead.. Do anything you want..M=Which means they don't have fear of law.

Well done, these cable operators have been spolied by the present Govt. it all started with the box. Now pay for individual channels big problem for customers. The cable operatorors can win a gold medal in cheating and fooling customers. Well done Mr. Laxmikanth on fighting for yours rights. Good eye opener for other customers.
