Bill against Triple Talaq tabled in Rajya Sabha


New Delhi, Jul 30 (IANS): A Bill which outlaws Triple Talaq was tabled in the Rajya Sabha on Tuesday, moving a step closer to end the practice of instant divorce among Muslims.

Introducing the Muslim Women (Protection of Rights on Marriage) Bill, 2019, Law Minister Ravi Shankar Prasad said that though the practice had been banned in many Islamic countries, India had not done so despite being a secular nation.

BJP ally Janta Dal (United) staged a walkout during the discussion.

"With all humility, I will neither speak in favour of the Bill nor support it. There are reasons for it. Every political party has its ideology and they have the freedom to move on that," said Bashishta Narain Singh of the JD-U.

Congress member Amee Yajnik supported the Bill but urged the government to take out the criminal angle from it.

She said that while the Minister quoted the Supreme Court's judgment while tabling the Bill, he forgot to mention the two words the court stressed on: "thoughtful consideration".

"An already distraught woman will now be made to deal with criminal justice system, jostle in Magistrate's court to seek bail for her husband, seek maintenance, custody of children. SC never asked for such a remedy," the Congress leader said.

The Bill has already been passed by the Lok Sabha.

    Triple Talaq Bill is Funadamentally Flawed

    a bill which is fundamentally flawed on several grounds.

    Firstly the bill was conceived, drafted and adopted without any discussion at all with those who are affected. The bill is titled The Muslim Women (Protection of Rights on Marriage) Bill, yet at no stage were Muslim women, their representatives or women's organisations consulted. It is a mockery and travesty of justice that the opinions of those in whose name a legislation is proposed, were ignored by this government. What then is the credibility of the claims made by government representatives that this was all done to help Muslim women?

    The bill emanates from the imagination of the government to (a) showcase Muslim law as unjust and (b) instrument a careless and vindictive law to break up Muslim marriages.

    highlighted three points that looked legally and practically untenable.

    1. The very harsh three-year-jail term for the husband – particularly when in no other religion is there such severe punishment for uttering three words.
    2. The astounding lack of clarity on who would provide maintenance to the wife once the husband is in jail.
    3. The virtual shutting of the doors on any possibility of reconciliation.

    The BJP uses its majority in Lok Sabha to do what it likes. On December 20, 2017, Union law minister Ravi Shankar Prasad answered that after the SC judgment, 99 cases of instant talaq were reported. Is that enough to punish the Muslim community, causing legal quarrels between husband and wife and sending the husband to jail for up to three years? The debate was sparse.

    Is divorce is only common for the Muslim community? No, it is not.
    1. If the PM Modi government want a Uniform Civil Code, why this law specific to one community?
    2. Why the women still need to wait for three years till her husband sentenced is completed. Whereas the Islamic Holy book Quran give this provision in 90 days?

    The BJP-RSS think that they are 'Moulana' & SC scholars.
