Woman gets triple talaq over phone from husband in Saudi


Kushinagar, Aug 4 (IANS): The Kushinagar police have registered a case against a man who allegedly gave talaq to his wife over phone from Saudi Arabia.

This comes three days after the Triple Talaq Bill was passed by both the Houses of Parliament and got the President's assent.

According to reports, the woman's father submitted a written complaint to the police on Saturday following which an FIR was registered against the husband under Section 4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, at the Nibua Naurangiya police station of Kushinagar district.

The accused Abdul Raheem, son of Tarabuddin, a resident of Shobha Chapra village under the Nibua Naurangiya police station in Kushinagar, said talaq three times to his 25-year-old wife Fatima Khatoon over phone on Wednesday and ended the call.

Fatima, daughter of Ahmad Ali, had got married to Abdul in 2014. After four months of marriage, Abdul went to Saudi Arabia to work and came during vacations but his behaviour with Fatima was not good and even his family members harassed her.

"On Wednesday, my daughter was doing household work when her father-in-law Tarabuddin came and handed her his phone, telling her to talk to Abdul who said talaq three times and ended the call.

"Abdul's father called a panchayat, took my daughter's thumb print on a paper and handed her a cheque of Rs 1.5 lakh, saying the marriage was over," said the victim's father.

R.N. Misra, Superintendent of Police, Kushinagar, said, "Taking action on the complaint of the woman's father, a case has been registered against the woman's husband under Section 4 of the Muslim Women (Protection of Rights on Marriage) Act. We are probing the role of all the people involved and are taking statements of both sides. Since the accused is in Saudi Arabia, we are sending notice through proper channel."

    Foolish fellow must have forgotten that he is an Indian first. He can't stay in Saudi Arabia forever. He has to return to his country one day and face the consequences. Hope the Indian Government will take some action against him immediately even if he is in Saudi Arabia so that it will prevent others from doing the same.

    There is no mention in Quran about "Instant" triple Talaq.
    This is something uneducated people do out of frustration.
    Modi government has targeted "Instant" Triple talaq so it has nothing to do with Islam.
    Its as good as a Non-muslim doing a breakup with his wife or a GF.

    Can u point out a word in my comment where I oppose TT? I personally hate TT practice. I strongly back the Bill uttering INSTANT TALAQ i. e totally against the Sharia. But what I concern over the Bill is of criminalizing it and put husband behind the bars for three years despite Supreme Court nullifies TT. When SC itself declared bill as void then what's the point to pass the Bill? if this bill manages its way through in its current form, will punish the wife doubly and wife has to suffer rest of her life without mantainence.
    This bill punishing the wife rather husband since no such convincing hopes from then govt where our Law Minister Ravi Shaker Prasad announce any support for the wife post TT. Viewers should analyse both positives and negative aspects of the Bill instead blindly stick to the positives which is in reality considered as liability over assets.

    Law is in place for her to exercise. She can file a case, if its her personal wish to not file a case no one can help.... instead you can go and try to convince her to use the ever existing law...in case of triple talak, women had no right or protection in law, that's what is provided with....if a triple talak victim doesn't file a case, no one can force her....

    This is a old trick. There are numerous cases, where marriage happened in India, both went to western countries and the woman returned back alone. The woman was abandoned, while the husband happily married someone else in US/Europe. Eventually, they return back to face the law of the land.

    Divorce (whether mutually agreed or court arranged) is legal. No law can prevent separation if desired by both husband and wife. However, there has to be a settlement for divorce. Triple Talaq was rightly made illegal as there is no representation for the wife and big question mark over her & their children future.

    If a couple decides to divorce then it is inevitable. From the time they have decided they are separated and may live away from each pending legal procedures. Triple talaaq might be quick but he might end up in prison but they can file for divorce without any consequences. Then what is the meaning of Triple Talaaq Ban?????. In this guy's case as long as he is abroad he may be free but once he arrives he will spend his holidays in jail. It would have been better for him if he had filed for divorce in the court and then follow court's procedures.

    This looks like when someone bought a cow and later said we dont want it and give some money back.Is it so bad this talaq ?no connections to a wife and husband?later hunt for a better one?where is the feelings,and heart remain?I dont understand.she is so young,is there a chance for her to marry again or live in her previous husbands house or mother?Pity these women.Whereas men always choose the best and youngerone,women have bad times.money and house is not everything.

    The Pharisees of my time were very educated persons who had deep knowledge of the Holy Scriptures and outdid others with their piety and religiosity.     God is immutable, equally is His Word. In every human family, there is a parallel with the first human family that God created with His own hands. In the divine plan, man is united to a woman so that they become one special entity, which is strengthened by the blessing of God. God wants his children to proceed from the love of a family, which has been formed in a holy manner.

    Unfortunately the human idea is very different to the desire of God. Adultery or forbidden sex outside marriage is the cause of the destruction of the moral principles of these times. Even more perverse is homosexuality. Human beings live their lives searching for pleasure and they despise the divine laws. Devastating consequences of this sexual permissiveness are the destruction of life before being born in the wombs of the mothers, an aversion to marriage, and children who grow without the maternal and paternal love found in perfect homes.

    The man and the woman of these times don’t want to assume the matrimonial responsibility that involves fidelity until death. The future husband and wife must elect carefully their partners; they must not do it just for the physical attraction, but in response to the love of God who wanted man to have a companion for life. Many marriages break up because they don’t accept the matrimonial covenant that is made before God for life. A man and a woman get together to become one single flesh, a new fountain of life that will generate children for God.

    PM Modiji, has successfully abolished triple Talak in India.....This aggrieved lady must register an FIR, at her local police station, in liasson with a lawyer, her case will be expedited and her husband passport can be revoked and he will be forced to surrender before the police station....... He will certainly be penalised, for his gross indiscretion, of violating the new anti Talak bill laws !!!!!!!

    It is very easy to misuse this powerful weapon by the wife to falsely accuse the husband that he said "talaq" 3 times in telephone, Just like the false dowry harassment cases.
    In this case the father in law also came in to the picture and so it looks like real case of triple talaq. Otherwise it will be difficult to prove or disprove the allegation. Every Indian Muslim knows that triple talaq is now illegal and has to go to jail for 3 years. The law makes only instant triple talaq a criminal offence. Not the usual form of talaq which is pronounced at 3 intervals. So logically thinking, any sane guy will not risk going to jail for 3 years and instead will say the talaq at monthly intervals 3 times so that he can get divorce without breaking any law.
    In Islam also triple talaq or instant talaq is not acceptable and the exact number of such cases may be very small, I think.
