Don't change Kashmir status, UN chief to both sides

United Nations, Aug 9 (IANS): United Nations Secretary General Antonio Guterres came out on Thursday against changing the status of Jammu and Kashmir and backed Security Council resolutions, of which the main one requires Pakistan to withdraw all its nationals from Kashmir.

His Spokesperson Stephane Dujarric said: "The Secretary General calls on all parties to refrain from taking steps that could affect the status of Jammu and Kashmir.

"The position of the United Nations on this region is governed by the Charter of the United Nations and applicable Security Council resolutions."

The Council's Resolution 47 adopted on April 21, 1948, said Pakistan should withdraw its nationals from Kashmir before a plebiscite can be held. Pakistan, however, continues to occupy a significant part of Kashmir making a plebiscite impossible.

Since then, India has said a plebiscite was moot because of Pakistan's continued occupation and because Kashmiris have had their say in state and national elections.

"The Secretary General also recalls the 1972 Agreement on bilateral relations between India and Pakistan, also known as the Simla Agreement, which states that the final status of Jammu and Kashmir is to be settled by peaceful means, in accordance with the Charter of the United Nations," Dujarric said.

While calling for maximum restraint, "the Secretary General is also concerned over reports of restrictions on the Indian-side of Kashmir, which could exacerbate the human rights situation in the region", he added.

The Charter provisions directly applicable to the India-Pakistan situation require members to settle their disputes by peaceful means and to refrain from the threat or use of force against the territorial integrity of any nation.

The Charter also says that UN cannot "intervene in matters which are essentially within the domestic jurisdiction of any state".

The Simla Agreement signed in 1972 by then Prime Minister Indira Gandhi and Zulfikar Ali Bhutto, who was Pakistan's President at that time, also said that Kashmir was a bilateral issue, thus ruling out third party intervention.

The Secretary General's office circulated to members of the Security Council a letter written by Pakistan's Foreign Minister Shah Mehmood Qureshi to Guterres on August 1 expressing concern about the situation in Kashmir. He also asked Guterres to set up a "fact-finding mission" for Kashmir and to appoint a special representative.

Dujarric said that the letter was being studied and no decision has been taken on appointing a special representative.

He said that the Secretariat was in contact with the Permanent Missions of India and Pakistan over the recent developments.

Joanna Wronecka, the President of the Security Council, refused to answer a reporter's question about Qureshi's letter and if there would any action on it.

    UN was a sitting duck and could not do a damn in solving the problem for 70 years. The cost was only borne by Indian security forces and people with the loss of thousands of lives and billions of dollars with no benefit. It's only those selfish political leaders of the region who benefitted the most and enjoying royal life. Now that PM of India has shown some guts and spine to put an end to the decades old problem, the UN need to first force Pakistan to vacate the Region it occupied illegally and leave India to manage it's own internal affairs.

    We Indians had no idea before what exactly truth behind Kashmir conflicts . Read the article properly you will understand better. I believe Sriman Shah ji and team went for 370 in hurry and without taking opposition parties into confidence. Now the matter is on UN table which is a bit concerned.

    Why is UN interfering? This is Indian matter. Not Pakistan or UN. But under Modiji impossible goals have been achieved and next goal is Akhand Bharat. We will achieve this. Jai Hindustan.

    UN interfering because Article 370 is legal agreement between Indian & Kashmir leaders to annexation of Kashmir to India. A leader or Nation as good as the agreement which it sign. Before 1947 No India or Pakistan, Only hundreds of Princely States, Kashmir was a Independent country before 1947, Akhand Bharat was a dream, We never had Akhand Bharat, No one was able to unite India in to one Nation. British ruled most of India and not all of India, Parts of India called empire like Buddhist Ashoka Empire, Mogul Muslim empire, British Christian Empire, But we Hindus never united due to our cast, region, divided culture. Historically we never had Akhand Bharat . Wake up with reality and written history not mythology.

    Brother, Why is India a member of UN? and want a permanent seat is Security Council. India will never be akhand Bharat and never a Hindustan as long as seculars live there.     Time is approaching for Pakistan and India to vacate Kashmir on graceful manner without bloodshed and death to mankind. Finally freedom with Independence to Kashmir from occupying powers. Kashmir is rightfully belong to Kashmiris Who will choose their own administration and destiny after 70 years, It took Panda-vas 14 years to get what was rightful of Panda-vas with Mahabharata war and Kashmiris it is taking just little more time. Shri Krishna will bring down the powerful corrupt & finally give victory to suppressed and powerless. Let us pray that the mighty powers of today China & USA with United Nations help bring peace, freedom & Independent to Kashmiris without war and death.

    Its not WAyanad, where Congress is desperately trying to call it a new separate nation with Rahul Gandhi as its Prime Minister.

    As I understand it, although Internal matter, Modi, shah and BJP has to honour the agreements signed under UN. Unilateral and illegal changing of Kashmiri status goes against governed by Art 370. By this statement UN is saying indirectly it won't agree on the actions of Indian government headed by Modi. As long as UN does not have a stamp on the status it will remain as disputed territory. Bilaterally means Pakistan and India should resolve this issue and Kashmiri people must have a say on it. Only that way any settlement has legal backing. Current action taken by Indian government by arresting Leaders of Kashmir, Imposition of curfew, No elected government nod- all this is incorrect in a democracy.
