Bengaluru: HC stays lower court judgement exonerating Janardhan Reddy

Bengaluru, Sep 4: The state high court, on Tuesday September 3, stayed a judgement delivered by the special court for people's representatives here that had absolved former minister Gali Janardhan Reddy, in an illegal iron ore mining case, absolving him of the charges under section 409 of the Indian Penal Code.

The single judge bench of the state high court presided over by Justice B A Patil, which heard the criminal review petition filed by the Central Bureau of Investigation (CBI) questioning the subordinate court's judgement, stayed the operation of the said judgement. It also asked the court concerned to continue to hear the original suit in its entirety including charges under section 409.

Advocate P Prasanna Kumar, appearing on behalf of the CBI, said that the court does not have powers to make amendments in the charges or including fresh ones at the stage when charge sheet has been submitted, the case has been accepted for hearing and the witnesses are being examined. He argued that the judgement delivered by the said court on September 18, 2018, was illegal and defective. He therefore sought the judgement to be quashed.

The high court bench upheld this plea, stayed the judgement of the subordinate court, and adjourned hearing.

Moreover, his involvement in 'bail for sale' scam is still not completed in which Judge who is involved later found dead in his Hyderbad residence is still not yet investigated but
    the state Highcourt passing such an order is highly questionable?

    This former BJP's Karnataka tourism minister Minister who offered Rs42cr crown at Tirupati from the same illicit money he looted. He also ordered the demolition of 200 years old Suggalamma temple on September 3, 2006. A week before the demolition, 18 sanyasis and mantras from Kerala and Tamil Nadu had arranged elaborate pujas for the powerful goddess & animals sacrificed.

    Janardhana Reddy sir, is a very devout man. He has even donated a Rs. 35 crore crown in Tirupathi Temple from his own savings. He also did his daughter's wedding with great difficulty. He is a very humble man.

    Yeah yeah Reddy... Ur Reddy is very pious man.. he gave 35 crore crown as there is a saying if u give 35 to Balaji u receive double of that .. what a devotee.. clap clap..! who spends 500 crore in difficulty?? Hahahaha....
    He gave from personal Saving? Really? Don we know how he sent iron ore to comman wealth China illegally.. he started mining with a revenue of 10 lakh and in 2 years he had crores of rupees do u think people in Mangalore are stupid to believe u.. he would take hafta wasooli from other miners in that area too.. preach rubbish to someone else

    All the Judgements are coming in favor of BJP. How the courts decide the judgements? on the basis of arguments of prosecution and defense lawyers or based on evidences? if lower court gave one judgement then how can it be changed ? COMMON MAN became Commana man with all these nonsense.

    Our judiciary and the investigating agencies are just a joke, is the take away from this report.

    Special judge changes the charge sheet and exonerates the accused. This judgement HC accepts that it is illegal and unjustified, where special court does not have the power to change the charges.

    The word to note is "illegal". If a court itself can do illegal thing, who is supposed to do legal thing. 2ndly, what is the ramification to the judge who pronounced the illegal judgement? Will he dismissed with no pension? Will there be any scrutiny on his wealth?

    The influential and powerful always dodge the law. This is a good example to learn.
