New Delhi, Oct 11: The Delhi High Court has moved to a wider acceptance from 'no means no' to a 'yes means yes' over a sexual context.

The court upheld the notion that a sexual relationship jilted by a man or a woman over frail reason is not an offence. This judgement came in after the man was acquitted of a rape case lodged by a woman who he promised to marry.

"Jilting a lover, however abhorrent it may seem to some, is not an offence punishable under the Indian Penal Code,” the court said, adding that "two consenting adults establishing a physical relationship, is not a crime."

The woman's claim that she was enticed into having a physical relationship on the pretext of marriage was not deemed as a man raping her. The court then established the infirmity the case carried. The court also observed that the woman had spent time with the man at a hotel in 2016, after three months of the alleged rape.

The woman had then lodged an FIR in 2016, alleging rape by the man. She claimed to have developed a friendship with the man which later turned into an affair. The man allegedly promised to marry her after being in a relationship for a long time.

In 2016, he invited her to his house to meet his mother but when she reached there, she found out that his mother was not at home and he allegedly raped her.

As per the court, "Such inducement in a given moment may elicit consent, even though the concerned party may want to say no. Such false inducement given to exploit the other party would constitute an offence."

“However, it is difficult to accept that continuing with an intimate relationship, which also involves engaging in sexual activity, over a significant period, is induced and involuntary, merely on the assertion that the other party has expressed its intention to get married,” the judge added.

    Now grapes are sauer to the girl.Court has right.I simply ask the girl when he had promised to marry ,why did she wait for so long to file case in court?and same time continued her relationship so long.She should have make sure he marrys,and then relationship.otherwise he should see his path.A man who seeks physical relationship before marriage will never ever marry.On this basis girls also take care.she had her parents,why did she inform them before?Now cry loud or light,nothing works.Other side man also shouldnt let go freely.court must question him about his promise and later let her down.

    This law existing in the Western countries for decades. By chance girl gets pregnant, boy should accept mother & child . If their relationship gets broken, boy should provide the financial support to his child till the age 17. Incase the father can not provide financial aid to his kid , then its the government remits the money every month to the kid. As u know at the age 15, high school students take up part time jobs.

    So, adults claiming to have been raped 17 times over a period of two years will not be considered rape.
    May be, Rape means within 24 hours report it. If not its consensual. Beware!

    this is absolutely right. Grown up adults cannot say that they have been enticed!! One should run his or her brain when the opposite sex lures and think 100 times before indulging in physical relationship.

    In most of the cases one of the partners sees some benefit in the other and starts the relation and when things gets sour, of course the fairer sex always accuses the men of raping them as men cannot go and say the same in Indian context of the Law. The law never supports men.

    Consensual sex of adults should be considered as by will unless done under force of weapon etc

    How to prove that one has carried weapon?

    By the way if it's a rape there will surely be protest from the lady and also carries scars and marks on the body during rape or forceful sex, in such case such act can be punishable.
