Bengaluru: After SC verdict, disqualified MLAs to join BJP within two days?

Bengaluru, Nov 13: The 17 disqualified MLAs of Congress and JD (S), whose mass resignations led to the collapse of the coalition government, are likely join BJP on Thursday or Friday.

It is almost sure that some of the disqualified MLAs will contest in the bypolls that are slated to be held next month. It has to be decided whether these MLAs will join BJP at New Delhi or Bengaluru.

Chief minister Yediyurappa is at Dhavalagiri till 3 pm of Wednesday due to the Supreme Court verdict on the disqualified MLAs. The meeting of BJP Core Committee will be held in the evening of Wednesday and a decision with regards to the joining of disqualified MLAs to BJP will be decided in that meeting.

Supreme Court in its verdict said, "The decision of the then Karnataka assembly speaker Ramesh Kumar of disqualifying the 17 rebel MLAs is correct. However, making them ineligible for the entire term of the legislative assembly is wrong. The disqualified MLAs cannot assume any position of power now. However, they can contest in the by elections."

It is being said that if the BJP high command gives the permission to the disqualified MLAs to join the party in New Delhi, then they will join the party in the capital of the country itself.

    People those who are commenting now must understand that this is not happening first time. May such cases like cash for votes, aaya ram gaya ram and even our own Manorama Madhwaraj cross voted during nuclear bill and joined congress.

    See the extract from today’s judgement:
    “ i. There is a growing trend of the Speaker acting against the constitutional duty of being neutral. Further horse trading and corrupt practices associated with defection and change of loyalty for lure of office or wrong reasons have not
    abated. Thereby the citizens are denied stable governments. In these circumstances, there is need to consider strengthening certain aspects, so that such undemocratic practices are discouraged and checked.”

    So change the law/ or amend the constitution. In order to prevent defection largest party or pre poll alliance must be allowed to form the government. Otherwise such cases keep on repeating

    In my opinion, if a MLA elected and resigns with out any valid reason, the defeated candidate must be declared elected. We can not be spectators for the selfish interest of MLA. Or the MLA must not be allowed to contest for elections. There should be amendment to the constitution with support of all political parties.

    It is very difficult as Speaker (usually from ruling party)will be the authority to accept resignation / dis qualify etc. As MLAs speakers are also dis honest.

    For example in Karntakaka case, some MLAs had valid reason,:
    1. JDS & Congress fought election against each other and finally top leaders took decision to form the goverment without taking their consent. If they expressed decent, they will be disqualified or will not be given any post.
    2. JDS government not treated some of the congress MLAs properly. If the MLAs dont get their due respect and funding, what they can do? they have to resign which is their fundamental right. ( For example tomorrow if Shiv Sena/ NCP/ Congress form a coalition government and if shiv sena still maintain that they feel proud in Babri demolition, some self respect MLAs will definitely resign.

    So in case of hung assembly or parliament, it is better to allow the single largest party or prepoll alliance to form the government. Otherwise party with few seats will form the government (Like JDS) which is against people verdict and definitely against democracy.
