Taxing NRIs for income in India, not elsewhere: Nirmala Sitharaman clarifies


New Delhi, Feb 2 (IANS): Finance Minister Nirmala Sitharaman on Sunday said the government has full sovereign right on the income generated by an NRI in India and as such he will be taxed as per Indian laws. She, however, said, the income accruing to the NRI from the country he is living in wouldn't be taxed by India.

"Here's a situation where an NRI is earning in some other country and he is not taxed there. He has some earnings in India as well, but because he doesn't live here, he doesn't pay tax here too. What we are saying now (in Budget) that pay tax for the income generated in India," said the Finance Minister.

"If he is earning in a no-tax jurisdiction, why would we include that into our calculations? If you have a property in India and have got a rent through it, therefore, you carry this income too, meaning no tax there or no tax here. We have corrected this because this income is in the jurisdiction of India," she said.

"We have got full sovereign right to take consideration of the income from India property for those NRIs. I am not taxing what the NRI is earning elsewhere," the Finance Minister told IANS in an interaction on Sunday.

The Union Budget 2020 proposed to tax Indians who are not residents in India, but "their earnings" will be taxed.

So there was confusion if all their incomes from all sources all over the world will be taxed by India. Now the FM has cleared that it is only India income that would be taxed for NRIs.

Tightening the residency provisions, the Budget also proposed to reduce the period of stay in India to 120 days from 182 days earlier for persons of Indian origin (PIOs) to be categorised as non-resident Indians (NRIs).

Reworking the definition of non-resident Indians (NRIs), the Budget document said the I-T Act provides that an Indian citizen or a person of Indian origin shall be Indian resident if he is in India for 182 days in that year.

But with 240-day change, the government still has not confirmed what the definition of RONR now will be (RONR as in Resident but not ordinarily resident).

The RONR status applies to returning Indians where they got two years of continued tax-free status on offshore earnings.

    What if this numbers reduces along with export of good?

    it seems some people want to be in mental conflict daily by believing fake news on above, CAA/NRC/NPR..IT recommendation was clear, even it doesn't need clarification from FM..some just want to spread fake news..NRI with RP in host country not taxable for salary or any other earning of foreign country in India..there was no changes..some misuses 180 days cut off, so Govt made it 240 days..now to get NRI status one has to outside india minimum 8 months with RP..

    India has lot of wealthy Landlords who come from influential families like late small maharaja families, Jain, Bunts , Vokaliga and Nawab families who hide tax liabilities in the name of agriculture & agricultural property.

    The Government has made it easy for them to hide income in the name of No income tax on Agriculture.

    All large scale farmers and Landlords should be taxed just like any other group or individuals. NRI who convert & use foreign funds, assets and currency should be made exempt from Indian tax system.

    Majority of the landlords with large land holdings and plantations of commercial crops are exempt from paying taxes on agricultural income who are also involved in running businesses which earn lot of profits. The turn over from certain such businesses are not reported as income from business but reported as agricultural income thereby claiming tax exemptions. On top of claim tax benefits these landlords claim all kind of subsidies offered by the government like free electricity, subsidies on fertilizers, farm machinery and so on depriving the small farmers who keep running to banks and private lenders for loans and eventually end up killing themselves when they are unable to repay the loans. Government instead fixing these anomalies in the tax system it only runs after middle class and salaried people to milk out the taxes until they fall dead. This situation will not improve or change as it affects majority of the political class or their patrons. God help the poor and middle class in this country.

    Income earned in India from NRO was always taxed, there is no change. NRE deposit interest is tax free and there is no change as well as along as NRE/NRI status is maintained.

    To NRIs, pls take your families to visit gulf where visas are flexible, and rules are better than India including Saudi Arabia. You can save money and you have your family with you 30 to 60 days. Let the Indian business go bankrupt and let the andh bakhts enjoy their leaders.

    NRI's not allowed to hold normal saving bank account in India. They're allowed to hold NRE/NRO accounts. NRO is tax payable account. I don't see any big changes. Also NRI's not paying tax for their NRE account deposits. Therefore it's reasonable.
