Anti-CAA play: Child rights panel slams cops for creating 'atmosphere of fear' in Bidar school

Bidar, Feb 9: The Karnataka child rights commission has criticised the district police for several violations, including norms under the Juvenile Justice Act, over the Bidar school sedition case. The criticism comes after the Bidar police interrogated school kids following an inquiry into an anti-CAA play performed at a school function.

Earlier on January 30, the police had arrested a widowed mother of a nine-year-old student along with the headmistress in the case.

In a new development in the case, the Karnataka State Commission for Protection of Child Rights (KSPCR) chairman Dr Antony Sebastian has sent a letter to Bidar officials, the SP, and the deputy commissioner, with copies marked to the Karnataka DGP. Dr Sebastian mentioned in the letter that the police officials were liable for creating an 'atmosphere of fear' at the Shaheen Primary School and the officials were to stop questioning the school children. The KSPCR also found that officials violated norms when they placed a nine-year-old under the care of a neighbour and failed to alert the local child welfare committee.

The Bidar district police interrogated students, aged nine to 12 years at the Shaheen Urdu Primary School several times in the past week over their roles in the play on the citizenship law. The police questioned the staff and the children over who was responsible for writing the script and for assigning dialogues.

One of the arrested in the case was Nazbunnisa, the mother of one of the children, accused of allegedly delivering the controversial dialogue. The cops also arrested the teacher Fareeda Begum, who oversaw the event. The two were booked under Sections 504 (intentional insult with intent to provoke breach of peace), 505(2) (statements creating or promoting enmity, hatred or ill-will between classes), 124A (sedition), 153A (promoting, attempting to promote disharmony) and 34 (common intent) of the Indian Penal Code.

An investigation is on into the 'sedition case' against the management and staff of the school, where children had allegedly insulted Prime Minister Narendra Modi and others, in the context of Citizenship Amendment Act (CAA), in a drama they staged on January 21.

    In mid-December 2019, a group of over 100 minor students had re-enacted the demolition of the masjid for the annual day event at the Sri Rama Vidyakendra High School in Kalladka at Dakshina Karnataka. Young students, dressed in a white and saffron combination costume, rushed towards a poster of Babri Masjid and fell it down as the narrator of the script announced, “Bolo Shri Ramchandra Ki… Jai. Bolo Bharat Mata ki… Jai.”

    On the other hand, in the Kalladka case, the police showed restraint and only invoked charges under section 295A and 298 of the IPC for committing a ‘deliberate and malicious act, and intended to outrage reli­gious feelings of any class by insulting its religion or reli­gious beliefs’ and ‘uttering, words, etc., with deliberate intent to wound the religious feelings of any person’. These are both bailable sections and the maximum punishment under them is three and one years respectively.

    Outside Assam, Karnataka is one of the first states to build detention camps for “illegal immigrants”. Contrary to Prime Minister Narendra Modi’s claim that no detention centres exist in India, the in Bangalore is already functional.

    In several places in the state, police have already begun lining migrant workers up and demanding their papers, very similar to what has been happening in Assam.

    It looks like Police self dont know certain things.why should be children be asked any questions without the presence of their parents or a legal person.?Children will tell sometimes with fear that cant be considered right or wrong.second why should the lokal child welfare organization was not informed.Simply horrific scenario.Police think whatever they do is right.

    One can involve small kids in anti CAA protests and teach them hate them other community from their childhood. Even if child dies in protest that is called as sacrifice, child rights panel sleeps on such incidents.
    These NHRC, Child rights comission, Women welfare organizations are useless in India. Highly politicized and very selective in picking up the issues.

    Absolutely disgraceful the way the children are treated by police. People committing murder are not harassed in this way by police. Police are supposed to be neutral in politics and why did they not apply same scale at Kalladka? Is it because they are RSS?
