Bengaluru: Mangaluru disturbances - 22 accused get bail, FIR ordered against police

Bengaluru, Feb 19: The state high court, finding fault in the arrest of 22 persons and naming them as accused by the police relating to December 19 disturbances during anti Citizenship Amendment Act protests at Mangaluru, has ordered release of all the 22 arrested accused on bail.

During the disturbances, the police had resorted to firing in which two were killed. The high court said that the police had not followed proper procedures when arresting the accused. It also considered the fact that the police had not provided evidences about the accused having taken direct part in disturbances to the court, when ordering their release on bail. It observed that the CCTV footage which the police had provided as evidences do not bear any proof to say that the accused had directly participated in the disturbances.

The high court also viewed the firing incident at Mangaluru seriously and turned its ire against the police. There were allegations that in the guise of disturbances, the police had attacked innocent people who were inflicted with physical and mental torture. Those who complained against the police about these things had approached the high court, pointing out that even after complaints were filed against the police, no action was taken and first information reports were not filed by the police. The court, after examining the facts, ordered for registration of FIRs against the police.

Advocate for the harassed persons had said that ten complaints had been filed against police atrocity and the complainants had frequented the police station and office of the city police commissioner to learn about the fate of the complaints. He had said that the police were not giving proper response and no steps were taken based on the above complaints. The court, upholding the request, ordered for registration of FIRs against the police personnel named in the complaints.

    The court also held that there was a deliberate attempt “to cover up police excesses by implicating innocent persons at the whims and caprice of the police”.
    The court also noted that photographs produced by the petitioners revealed that the policemen themselves were "pelting stones on the crowd".
    But honorable court is short of observation in which Police officer on records saying his subordinates wasting bullets and without killing the protest.
    The court should have ruled in favor of the those two victims and asked the state government for compensation and termination of the officer who fired indiscriminately without any warning shots fired.
    Do riot control need 'live bullet' instead of 'rubber bullets' something Dr P S Harsha, city police commissioner has to clarify.

    Q. Should we really blame the police force or the political bosses at the top as per whose orders they were acting?

    A. Firstly, the police is a SERVICE. The BSF, CRPF etc. is a force, the Armed Forces is a FORCE!(the police may resort to force in extreme circumstances only, either to protect themselves or other civilians from imminent harm).

    Second, then let the police SERVICE given a written affidavit to the court naming the political bosses(whoever it is) and the orders received:
    (1) The Central Secretariat Manual of Office Procedures , Chapt.V, paras 19 to 22; clearly sets out that all orders to any subordinate shall be given in writing.

    (2) Part XIV(specifically Art.311) of the Constitution of India takes care of the IAS & IPS, insulating them from political pressures , making them virtually untouchable by corrupt wily politicians. So the corrupt and criminal elected representatives(who votes for them????? who seeks short-term and long-term benefits and favours from them????) transfer the honest IAS /IPS officers or give them postings where they can be kept out of the way so that their corrupt and criminal activities can go on.     So only those who are not upright and those who are dishonest can give excuses and try to shift the blame from themselves to a bad political boss.

    Citizens must also file complaints with the police complaints authority(which at present is in total coma and functions only on paper), with a view to getting it functional. At least then they wont claim that there are no complaints at all against the police.

    Kudos Karnataka HC! for showing the spine that others only give speeches about(after lighting lamps and diyas)!

    I think the police are at no fault here , when so many people are throwing rocks , petrol bombs etc at them and running , how can they identify who is innocent and who is guilty .so in the heat of the moment they have beaten all who came across their path .

    Such police excesses of killing innocent people, in cold blood, and then trying to hush up the case should be dealt with strictly as per the law! The person who have the firing order is clearly guilty of misusing his powers, which are actually supposed to protect innocents!
