Now, Fatwa Issued against Shoaib Malik


Kolkata, April 6 (IANS) Former Pakistani cricket captain Shoaib Malik had another googly bowled at him when a fatwa was issued Tuesday against him by a muslim cleric in the wake of Hyderabadi girl Ayesha Siddiqui accusing him of marrying and then abandoning her.

The Shahi Imam of Tipu Sultan Mosque here Syed Noor-ur-Rehman Barkati issued the diktat saying Shoaib and Ayesha were now man and wife as they had married over telephone.

"Nikah has been conducted over the telephone. They are now husband and wife according to Muslim law," said the Imam, known for issuing edicts on burning issues.

"If Shoaib accepts the nikah, no problem. But if he denies, he will be out of the Muslim society," he said.

Shoaib is now in India's Hyderabad city and plans to marry tennis star Sania Mirza April 15.

With Ayesha, who claims to be Shoaib's first wife, launching a legal fight to prove her claim and the police not ruling out the Pakistani cricketer's arrest, it is learnt the Mirza and Malik families are seriously considering delaying the marriage.

Police Monday grilled Shoaib at Sania's house after booking a criminal case of cheating, harassment and criminal intimidation against him following a complaint by Ayesha, who is also a Hyderabad resident.

    Islam is a religon of convinience. It has several proofs of hindus getting converted to it just to circumvent indian laws. Dharmendra and hema, kishore and madhubala and more recently Haryana dy CM are few of the many examples here. once the mission is accomplished its treated in the same manner how it was being treated by such temporary converts.

    It is not ONLY the Nikah but the woman claims to have met Shoaib 14 times, lived with him and suffered a miscarriage. Imagine had she delivered the baby would then Shoaib have denied having met a woman of such claims ? Is Shoaib a teething baby not to know his limits ? Now that this saga is out in the open, let him and Ayesha clear it out so that Pakistani men will put an end to exploiting/taking advantage of women as well as women wooing/misleading men through chatting.

    These are all bakwas. Islam is not a religion of convenience but a religion of conviction and commitment. Whether the nikha over the phone is vaild or void, but its ones intentions are very important. God judges the intentions and he knows the secrets hidden in the hearts. If his intention is to marry Ayesha over the phone, then the fatwas is valid. More than that , there are two witnesses, each from both sides, they have to testify the marriage. Where are they? Why this cleric didnt ask for the statement of these witnesses before issuing the fatwa? So, in a marriage few things are must and important. 1. For girl, her consent
    Girls wali and wakil- i.e father, brother, uncle etc, one male witness from girls side. For boy, his presnece itself is consent, mehr, (bride money), boy himself is wali and wakil, one male witness from his side plus valimah. Qazi just solemnizes the marriage and he has no authority beyond that. Nikah should be solemnised in the presence of group of adult muslims from both sides which gives legality to the marriage and to the children born out of this union.

    There are many girls like Ayesha who fool people online. Shoaib was just 18 at that time when he fell for her prank & everytime he wanted to meet her she disappeared because of her weight issue and also because she sent him the wrong picture of another beautiful girl and posed herself as Maha aapa. Ayesha & her family should be charged for cheating and forgery and this marriage will be regarded as null and void. The whole of Pakistan team and his family have seen the picture that was sent to him and that should be a proof that this girl is lying.

    We do have telephone nikaahs in Islam if parents are involved and obviously in a telephone nikaah you cannot see the girl and presume you are marrying the girl in the picture. A copy of the marriage certificate will be sent for your signature and you can send a copy back once signed. How would this poor guy know that her parents were a part of this fraud. Indians have a mentality of allows blaming the men but please remember there are evil woman like Ayesha too in this world. I wish Sania and Shoaib all the best.

    Dear Saleem, Abu Dhabi, You are wrong. Quran clearly states that a man should marry one and if he cannot live with one he can marry up to four, provided he should treat all the four equally. A middle eastern person told with me that he is unable to deal accurately with the one and how a person deal equally with the four? Secondly, A Muslim man has the right to divorce if he pronounces 3 times divorce, divorce, divorce that is the end and he doesn’t need to the permission of former wife or the present wife. Men in Islam are privileged and women have no right to divorce. Lastly I agree to your this quote: But unfortunately so called muslims have used their own rules to marry 4. Unquote.

    S.Malik sandwitched between Aysha and Sania.Certainly there is some truth in the episode of Aysha-Malik.I guess S.Malik were trapped by law of India-Pakistan for his playboy actions.In the near future this episode will be a subject of proxy war between India and Pak as already Pak adivised India to return S.Malik's passport!! Is Sania makes it or breaks it - a million dollar question under prevailing situation.

    News goes around that Sania and Shoaib may already been married in Dubai. Its best to leave them alone - Sania has let Indians down in a terrible manner.

    Let them deal with legal matters, they deserve no public sympathy nor attention.

    Mr. Gireesh, it is not true that a muslim can marry as many or can have 4 wives without the consent of the former! There is certain rules & regulations to fulfil this. Even a muslim cannot marry 2nd time when his 1st one is still alive and can fulfil all his/family needs. But unfortunately so called muslims have used their own rules to marry 4 and one such person we have now is Shoaib Malik.

    Yes why should we worry about Sania v/s Shoaib wedding? Let them get married and for sure we all will witness that Sania will leave Shoaib within a couple of years time and then some stupid person will be ready to marry this arrogant Sania!  I feel sorry for Ayesha and her family. Look at the contradicting statements been made by Shoaib since his marraige to Ayesha!

    Marriage over telephone...sounds interesting and it really gives an impression that we are living in the age. I know its Saniya's personal matter, but why the hell she wants to marry a Paki? Couldn't she find any other guy in this big world. Anyways all the best Saniya.

    As far as my perception four families are involved in this case and four people have committed adultery. If Shoaib has had nikah with Ayesha, he should settle divorce first then can marry any one he likes. If he has not performed nikah then he is liable for punishment. As per shahriah law females are to be stoned to death and male will have lesser punishment because shahriah law provides more priority to men and less to females even in Inheritance.

    Ms Fathima,You should indeed get some basic knowledge on Islam..A Fatwa is issued only when its carefully analysed by a group of Aalims called as Ulemas..but it is up to the knowledge of a muslim individual to find out whether the ulemas are held in high regards by the muslim community or do they have the authorization to issue a Fatwa..A Fatwa once issued by a genuine Aalim is done forever..
