Govt paves way for all Indians to buy land in J&K


New Delhi, Oct 27 (IANS): In a significant move, the Centre has notified the new Land Laws for Jammu & Kashmir. In a gazette notification, the union home ministry has notified this on Monday. It paved way for any Indian to buy land in the Union Territory (UT) of Jammu & Kashmir.

The MHA notified what it calls UT of Jammu and Kashmir Reorganisation (Adaptation of Central Laws) Third Order, 2020. The order comes into force with immediate effect.

"With immediate effect, the Acts mentioned in the Schedule to this Order shall, until repealed or amended by a competent Legislature or other competent authority, have effect, subject to the adaptations and modifications directed by the said Schedule, or if it is so directed, shall stand repealed," read the order.

The General Clauses Act, 1897 applies for the interpretation of this current Order since it applies for interpretation of laws in force in India, said the order. Meanwhile 12 state laws have been repealed as a whole.

Meanwhile those legislations which are being repealed as whole include the Jammu and Kashmir Alienation Of Land Act (V of Samvat 1995), the Jammu and Kashmir Big Landed Estates Abolition Act (XVII Samvat 2007), The Jammu and Kashmir Common Lands (Regulation) Act, 1956, the Jammu and Kashmir Consolidation Of Holdings Act, 1962, among others.

    Go ahead and buy as much land you want in Kashmir and live there happily ever after nobody is stopping you. If Pakistan can not fulfill plebiscite then what is the problem with India to go ahead and complete the process of annexing the J&K territory once and for all under UNSC recognition and approval. Why India is not considering acquiring Gilgit and Baltistan where a similar resolution too applies???????????......Till the time a comprehensive resolution is not adapted for whole of J&K by UNSC even Indian Kashmir which is part of whole of J&K is in shaky grounds. Moreover, Indian controlled Kashmir is in indefinite political lock down and people are in house arrest. It won't pleasant either if at all that lock down is lifted. In such conditions what is so interesting to buy a land there with security personnel roaming in every nook and corner with guns and ammunition??????.......

    Can understand your level of frustration. J&K is an integral part of India and the status will remain the same forever. The present Government has been doing a good job in cleaning the mess created in J&K by earlier Governments. With priority on infrastructure, the roads and electricity are now reaching the remote areas of J&K. With majority of Indians backing the Government decision on J&K, it hardly matters with the opinion shared by the frustrated people about J&K.

    According to Times of India any citizen of India can from now on buy land or house and settle in J&K, in the same way as Kashmiris had been enjoying the right to buy property and settle in any part of the country for the past 70 years. Henceforth there will be no discrimination as far as property rights are concerned.

    It would be risky business to buy land in Kashmir at prevailing conditions. Govt may have made into UT but still govt doesn't have 100% say in its ownership and if UNSC resolution is adapted then people might lose money and land. At the same time govt is ignoring Kashmiri pandit's demand and thier original place of dwelling. Govt is only interested in flooding people into Kashmir for money collected by land sale, property tax and for vote bank but there is no security , no normal life, no businesses, no schools and hospitals functioning. It's not business as usual in J&K and future is uncertain. So for how long you buy the land and hold it without any appreciation and make your investment dead investment.

    For thousands of years Kashmir belongs to pundits rest all of them are outsiders and invaders. it will take time clean the garbage left behind by nehru because he went to united nations without consulting Sardar. Happy to see the process started undo the wrongs of nehru. About United nations resolution- better you educate yourself with preconditions for the plebiscite. Pakistan will never fulfill the first two conditions so NO plebiscite. JAI HIND.
