Lucknow, Jan 9: Two Ayodhya residents challenged the CBI court's judgment that acquitted all 32 accused in the 1992 demolition of Babri mosque including BJP veterans LK Advani and Murli Manohar Joshi. The challenge was placed in the Allahabad high court under the counsel of All India Muslim Personal Law Board executive member Zafaryab Jilani.
The petition was filed because the prosecuting agency CBI has not yet appealed against the judgment last year, the advocate who has also been convener of the Babri Masjid Action Committee said. The petition was filed with the high court registry.
Haji Mahmood Ahmad (74), and Syed Akhlaq Ahmad (81) the two Ayodhya residents in their petition claimed that they were witnesses in the trial against those acquitted by the special court in September 30.
The duo claimed in their petition that the trial court committed an error in not convicting the accuseaad while adequate evidence was on record. "The trial judge did not appreciate the evidence of conspiracy in the right perspective," they claimed.
In the plea, they sought that the record from the trial court be summoned, its judgment set aside and all the accused be held guilty and punished accordingly.
Previously, all the 32 accused of inciting a kar sevaks mob to demolish the Babri masjid in Ayodhya were acquitted by the special court. The demolition was followed with the belief that the 16th century mosque stood at the birthplace of Lord Rama.
The Supreme Court, in November 2019 ruled that Ram temple be constructed at the Ram Janmabhoomi-Babri Masjid land dispute site and a separate plot be allotted in Ayodhya to build a mosque.
