Goverment's 'last' notice to Twitter, warns of penal action


New Delhi, Jun 5 (IANS): The Union Ministry of Electronics and IT has sent its final notice to Twitter over non-compliance with the new IT rules and has again warned of penal action in case the US-headquartered social media platform fails to comply with the norms.

The notice sent by the ministry noted that in view of Twitter Inc's non-compliance with the rules which came into effect on May 26, 2021, "consequences follow".

"However, as a gesture of goodwill, Twitter Inc is hereby given one last notice to immediately comply with the rules, failing which the exemption from liability available under section 79 of the IT Act, 2000 shall stand withdrawn and Twitter shall be liable for consequences as per the IT Act and other penal laws of India," it said.

The ministry said that it is clear from the responses of the company that to date it has not informed about the details of the Chief Compliance Officer as required under the Rules. Further, it also said that the Resident Grievance Officer and Nodal Contact Person nominated by the platform are not its employees in India as required under the new rules.

"The office address of Twitter Inc as mentioned by you is that of a law firm in India, which is also not as per the rules."

It said that the refusal to comply demonstrates Twitter's lack of commitment and efforts towards providing a safe experience for the people of India on its platform.

    Once upon a time Morarjee Desai asked Coka Cola to leave India. So also many FERA companies were told to change their share holdings or close down. Ultimately what happened? Some are still there in business in India and are doing well. Holck Larsen ( Person who won Magsasey Peace Prize and founder partner and Chairman of Larsen and Toubro Ltd) got disgusted and left India making way for Ambanies to try immediate take over. (Even the name got changed to L&T Limited, Ambani Group Company for short period. Fortunately Financial Institutions stood firm and saved the company from Ambani take over). Many such good companies had to hand over the management to Indian directors, Unilever, David Brown, Glaxo, Pfyser, SKF etc. some how managed to remain with Indian share holding. But many good companies wound up. Slowly India realised need for Foreign Direct Investment and these companies are back with partnerships from foreign agencies. Ultimately the loss is for India. Similar thing can happen with Twitter or Facebook. They may come back with Ambani or Adani Label.

    Twitter, FB have become liberal communists tool or one sided news or fake news. That's why origin of covid or about their or elites' impairing vaccine news never come out or their financed factcheckers quickly block or dismiss or rubbish those news or facts.

    RSS functionary, ex BJP leader who is disgruntled from Mod/shah from day one warned Govt about these social media & said one day these tech companieS will become Govt..he even filed case against Bjp govt for using social media for Govt policy announcements..now all over the world twitter/watsapp/FB so emedded in system you just can not get rid of f/ban ..Australia recently striggled with FB..

    I don't understand one thing Indian firms that work in usa UK etc all have to follow their rules and regulations why then is it soo difficult for them to follow our rules? We are a independent country we don't run under them follow the rules or get out..

    Exactly Daniel. There are 155 Indian companies in the usa all have to follow us rules and regulations in order to function. Why can't twitter do the same? Tomorrow I can't walk around in us streets with a sword in my hand which people in punjab are allowed to do. I'll get arrested there because it's their rules

    Twitter follows Indian laws. It is the ad-hoc rules made by today's Central folks that Twitter does not follow. There is a huge difference between the laws of a country and the ad-hoc rules made by some for convenience.

    Twitter, so far as I understand, is a US business. India will think a 100 times before hurting a US business. Equally importantly there could be a large number of Indians working for Twitter. So, all these warnings will come to nothing.
