AIMPLB opposes uniform civil code, terms it 'unworkable'


Lucknow, Jul 27 (IANS): The All India Muslim Personal Law Board (AIMPLB) has termed the proposed Uniform Civil Code (UCC) as 'unconstitutional and unworkable for a diverse country like India'.

The board has urged the Centre to reconsider its aggressive stance towards getting the UCC implemented in the country and concentrate on real issues like education, employment, inflation and health infrastructure.

In a statement, board secretary and its spokesperson Maulana Khalid Saifullah Rahmani reiterated that the country gives everyone the right to live and practise a religion of their choice.

"Bringing about UCC will only come in the way of that which is fundamentally available right to all Indian citizens. There are more cons than any evident benefit of the UCC. It is in contradiction with the Sharia (Muslim religious laws), legal rights and also social and cultural aspects of living of different citizens in the country," said Maulana Rahmani.

He further said, "To divert from the real issues of employment and development, BJP instigates topics which divide people. It is known that in the Monsoon Session of Parliament, the Population Control Bill and UCC are to be presented as private Bills. The Uttar Pradesh government is also set to pass the Population Draft Bill. We are strongly opposed to these."

The spokesman explained, "Sharia gives certain rights to Muslims which will be in contradiction with the UCC. Like polygamy is expected to be dissolved. Similarly, the right to divorce will be taken away from the husband and put in the court which will exploit the woman and remove the chance of mutual and amicable divorce between the partners."

The All India Shia Muslim personal Law Board (AISMPLB) has already decried the proposed population Bill and sought a rethinking on the same.

    If different types of people can easily mingle with other communities, do business, can marry with each other, purchase properties, can study, write examination then why can't there be uniform civil code ( UCC) ? Don't we encounter disputes and go to court of law for settlement?

    UCC should be within the ambit of the constitution which is impossible. It should not be appeasing and following one section of the society or one political party but to serve all people and not any party. Like if beef is to be banned in india because Hindus don’t eat beef then even pork should be banned in india because it is prohibited in Islam and then all non veg food should be banned in india because it is prohibited in Jain religion and so on. So is it practical when we start with one basic issue as all citizens have equal rights????????…... Only if we have developed tolerance and respect for each ones rights and the govt protects those rights in a democratic set up then the concept of UCC is meaningless. Why do we need UCC when we have constitution where all rights to each citizens are equally given and protected.

    Yes. We need UNIFORM CIVIL CODE. The Hindu Undivided family (HUF) is the biggest loophole by way of which income tax is not paid to government. Let BJP first come clean on HUF. The HUF should be abolished by the way of Uniform Civil code. Also property in the form of Uniform Civil code should be distributed equally for women which is not happening in HUF. They have equal rights as sons.

    NO hindu Temple prohibits the entry of any citizen of India, irrespective of his religion as long as he respect Hindu religion and adheres to the customs followed by each temple. Generally in Hindu temples customs vary from to temple. Secondly another reader has written about HUF, where it is said women do not have right, HUF exists only for income tax purpose, All Hindus as far as the rights to ancestral property or the property of a parent every child has equal right, this amendment has come into force several years ago
