Governor Puts Breaks on Disqualification Petition

Bangalore/Chennai, Oct 10 (PTI): Uncertainty over the fate of the BJP government in Karnataka grew today with the Governor asking the Speaker not to disqualify any MLA before the trust vote while 11 rebel party legislators held their ground rallying behind JD(S) leader H D Kumaraswamy.

Embattled Chief Minister B S Yeddyruappa, already facing the heat of Kumaraswamy's machinations, appeared to face an uphill task when Governor H R Bhardwaj stepped in and opened another front when he directed Speaker K G Bopaiah to maintain status quo on the House strength as on October 6 before the rebels withdrew support reducing the Government to a minority.

With the numbers game becoming very critical, the ruling party will be still in minority being six short of the magic mark of 113 on the basis of the existing strength and if the 11 BJP rebels and five independents stick to their stand.

Kumaraswamy said in Chennai his party and Congress would work together to see the fall of the BJP government during the crucial trust vote tomorrow. Raj Bhavan sources told PTI here that the Governor in his letter to the Speaker directed that the strength of the 224-member assembly which stood as on Oct 6 should be maintained and that all legislators should be allowed to take part in the confidence vote exercise.

The directive which effectively barred any action being taken against any MLA came as a dampener to the ruling BJP, which had been hoping to get a favourable order on disqualification of 11 rebel MLAs, against whom Yeddyurappa has filed a complaint under provisions of the anti-defection law after they withdrew support to his government.

Bhardwaj in his letter said in the interest of a free and fair floor test, no attempt should be made to change the character or configuration of the house after it has been summoned for the purpose.

"Any attempt to change the character or configuration of the house in the run up to the vote of confidence motion, is bound to vitiate the proceeeings", he noted. The Governor cautioned that "any result obtained by such a vitiative proceedings will not be acceptable".

The first ever BJP government in the South, tottering under revolt of the dissidents who have declared their intent to go against the trust vote tomorrow, had been toying with the idea of bringing down the effective strength of the house to ensure a smooth sailing for itself during the trust vote.

Bhardwaj, in a clear warning, said if there was any alteration in the numbers ignoring his directive, his decision would be final. He said the process of Yeddyurappa seeking the trust vote tomorrow to prove his government's majority as per his direction should be held as per law.

In the 224-member house, BJP has 117 members, followed by Congress 73, JDS 28 and Independents six. A number of 113 is required to prove majority in the house. The government was reduced to a minority after 14 BJP MLAs and five Independents withdrew support. Three BJP MLAs have since returned the party fold.

Sacked Fisheris Minister Anand Asnotikar claimed that the dissident MLAs were all "united". Kumaraswamy, who is in Chennai to hold parleys with dissident BJP MLAs, told reporters, "Both JD(S) and Congress are in the opposition. We are together going to defeat BJP."

Addressing a press conference at a hotel in Cheanni along with the dissidents, the former Chief Minister alleged that the ruling BJP was misusing government machinery as well as the Speaker's chair to win the trial of strength on the floor of the Assembly.

"Our first priority is to remove this bad government and we (opposition) are going to unitedly do that...we are confident that we will defeat the confidence vote," he said. Responding to reporters' queries on forming government in the event of BJP losing the vote tomorrow, he said that was not the issue now. "The future course of action in this regard will be charted out later," he said.

"We are all united. Now the Karnataka political situation is totally under control. To change the corrupt government, all the MLAs are united," said Kumaraswamy who arrived in Chennai late last night along with the 11 dissident BJP MLAs from Goa.

    It is very unfortunate that the current political situation in our state has reached such a low level.If other political parties succeed in bringing down the present government ,the Governor should recommend a President's rule and let, we the people of Karnataka decide about the next government.The way the JDS is trying to accquire power by appeasing the tainted,greedy and corrupt MLA,s is not in accordance with most of the people in our state.And if they gain power in this way then only God can save our state.The fate of our state is now in the hands of our Governor,who, we hope,will take the right decision and save our state from utter chaos.

    If governor can do everything, then why government/speaker/cm etc? Every post has its own constitutional rights and they should abide by it. If the governor try to poke his nose on everything, he will get the right reply like what speaker did this morning.

    Big blunder by governor by writing this letter to speaker. speaker is supreme in conducting the house.if speaker does wrong then governor should come into picture, not before. bjp should take all these points to court if they lose.

    The constitutional position is been misused to the maximum at all levels. The Governor should maintain his dignity of his position, rather acting as a Party Agent. His Party in the Centre has already made us a big loss of a good Politician , the then Loksabha Speaker, Mr. Somnathji. Instead of writing some letter today, he should have waited for the proceedings tomorrow and then taken his action under the constitutional perview. God save our Nation. Our Tax Money is been enjoyed by these Dirty Politicians of all the Party.... . Rahul Gandhi wants the youngster's to join Politics, how would he expect us to take a decision after seeing these dirty Saga of last one week.

    In my opinion Speaker have to do his job as usual by getting Constitutional experts opinion. If disqualifying the rebels are within the constitution, Speaker must act even if it amounts to ignoring the letter of Bhardwaj. Let the state on Presidents rule and BJP go to court with suspended assembly. At any cost BJP must not heed to the pressure of Bhardwaj and Gowda & Sons.

    As a constitutional head of the State, the Governor has taken an impartial and correct decision. This is right at a time when BJP govt. is making all illegal means to stick in their chairs ignoring in giving 7 days time for the rebels to explain their position as per Anti-Defection law. At present juncture the rebel MLAs' action does not amount to defection and it is mearly an anti-party activity. At least now Yeddi should resign gracefully before getting defeated in trust vote. This corrupt govt must go and enough is enough.

    Right decision taken by governor! 14 Rebel MLA's must not be disqualified, because still they haven’t defied party. Notices should have been served to all MLA's of all the parties for staying away at resorts. Hard days for Yeddy & Eshwarappa. Ishwarappa tongue is like ladies tongue, he used to blame Governor for everything. Yeddy wasted his two yrs in anti slaughter bill n what not, trying to please majority Hindus. Trying to divide people of this state, there was perfect harmony between all the religions before BJP came into power. To get power he even changed his name. To keep his chair kept on changing minister’s portfolio. Now his portfolio is going to change as opposition leader at assembly.

    All eyes are now directed to Speaker of Karnataka Assebly and a fair free no confidence of motion is in course as Gov directed Speaker to maintain status quo as of 6th oct 2010.

    It is now certain and beyond doubt that BJP govt will fall provided if BJP not trying for final OPERATION KAMALA.It is also quite interesting to see that, is Speaker flouting constitutional obligation in running this motion or abide by the costitution.Both way Yeddy will relinquish CM post tomorrow @ 10.30AM.BEST OF LUCK YEDDY AND HDK!!!!???

    Speaker is not bound by Governor's directive regarding the conduct of assembly proceedings. And speaker is the authority who'll decide on disqualification. Governor can only send his recommendation to the central government. Very interesting position.
