High Court Puts off Hearing Against 'Disqualification' to Oct 12

Bangalore, Oct 11: The Division Bench of High Court, which took up the writ petition filed by the 16 'disqualified' MLAs, comprising 11 from BJP and 5 Independents, has put off the hearing on the petition till Tuesday, October 12.
The 16 MLAs had challenged the decision of speaker K G Bopaiah to disqualify them without following the due process of law allegedly for anti-party activities, when they had not done anything against the party but had only expressed their lack of confidence in chief minister B S Yeddyurappa especially after a series of misdeeds committed by him to favour his sons.
The dissident MLAs had moved separate writ petitions before the chief justice of High Court Justice Kehar Singh at the latter’s residence in view of the Dasara holidays declared by the High Court.
The High Court chief justice, who heard the lawyers representing the petitioners, directed them to move the vacation Division Bench of the High Court.
The writ petitions separately moved by the 11 'disqualified' BJP MLAs and 5 Independents were placed before a Division Bench comprising High Court chief justice, Justice Kehar Singh and Justice Anand.
The state government had specially brought in former Attorney General of India Soli Sorabjee, who had also served as the Union law minister, to argue on its behalf. The 'disqualified' MLAs had engaged the services of senior advocates P P Rao and Raghavan.
The lawyers representing the petitioners had referred to the decisions of Guwahati and Mumbai High Courts in past incidents of disqualification of MLAs by the speakers of the respective High Courts and the issuance of stay orders, which had been upheld even by the Supreme Court.
