Bangalore: New Twist in Independents Disqualification Case  

Bangalore, Nov 8 (IANS): The disqualification case of five Independent lawmakers of Karnataka Monday took a new turn with two of the five voters, on whose petition the five legislators lost the assembly membership, claiming they were forced to lodge the complaint.

The two voters Monday filed an affidavit in the Karnataka High Court, which is hearing the Independents' petition challenging the disqualification, saying that their signatures were forcibly taken by the ruling Bharatiya Janata Party leaders.

The five Independent lawmakers were disqualified Oct 10 by Assembly Speaker K.G. Bopaiah on the basis of the complaint by these five voters, who said these legislators had betrayed their voters by rebelling against Chief Minister B.S. Yeddyurappa.

These five Independents along with 11 Bharatiya Janata Party lawmakers had told Governor H. R. Bhardwaj Oct 6 they no longer had confidence in Yeddyurappa.

Bopaiah disqualified all the 16 lawmakers Oct 10, a day ahead of the trust vote sought by Yeddyurappa. The chief minister won a second trust vote Oct 14 as the first one on Oct 11 was termed by Bhardwaj to be not in order.

The disqualification of the 11 has been upheld by the high court while the case of the Independents is being heard by a three-judge bench of Justice Mohan Shantanagoudar, Justice S. Abdul Nazeer and Justice A.S. Bopanna.

The five Independents are Shivaraj S. Thangadagi, D. Sudhakar, Gulihatti D. Shekhar, Ventakaramanappa and P.M. Narendraswamy.

The three judges had Nov 2 issued notices to the five voters, the speaker and the chief minister to respond to the Independents' petition challenging their disqualification.

When the court took up the case for further hearing Monday, the two voters submitted their affidavit. The three other voters are yet to respond to the notice and they have been given time till Nov 12 when the hearing will resume.

On Monday Yeddyurappa's lawyer told the judges that the chief minister cannot be made a party in the case.

The chief minister "is not a party before the speaker", Yeddyurappa's counsel said as the decision to disqualify was taken based on the complaint of the voters.

The bench gave time till Nov 12 for Yeddyurappa to respond.

    This crooked speaker has destroyed democracy.Fandoos blame the governor, who in fact is trying to save democracy. As Mr Chandrashekar says, the independents should have been disqualified the day they supported the BJP government in 2008. They were fine then, but not now. What a farce played by Yeddi, Reddy, Khaki chaddies, refugee Venkiah Naidu( No chance or place for him in Andhra) and Bopiah.

    17. Whether the Five independent MLAs can be disqualified under paragraph 2 (1) (a) which is in-applicable to them in its nature & scope, when their disqualification is clearly defined & covered under provisions of paragraph 2 (2) of 10th Schedule of Indian constitution vis-à-vis when there are no provisions for deemed membership either in bye-laws of the political party or under the provisions of Indian Societies Registration Act & Rules under which any political party is registered? If BJP considers them as members, then they are disqualified ab-intio i.e., on the day of joining the BJP Govt. soon after general elections in 2008.

    All the 5 1 independent MLAs should have been disqualified on the day they have extended their support to Yeddi soon after the general elections under paragraph 2 (2) of the 10th schedule (if BJP claims them as their deemed members)and not on 10th oct, 2010 under paragraph 2(1)(a) of 10th schedule of indian constitution. Where is rule of law in India? oh! God, it is a million dollor question? can anyone aptly answer?

    Louis / Paul, May be JDs & Congress paid heavy money to make such statement against BJP????
    Its a common sense, BJP may get N number of people to lodge complaint agianst any MLA because each constituency have more than 1 Lac people. When any person deny to complaint they can get others. Now the person who had given complaint changes his stand , it is understood that either JDs or CONgress behind this. Wake up guys.

    Yeddi will go upto any extentent to save his seat. He may sell his own family members. more over he has financial back up from Reddy brothers.This is worst Govt ruling the Karnataka state. The Youth should be given a chance,Something of NAYAK film should happen in Karnataka !!!!

    Louis, I agree with your comments. But the question is, why Speaker disqulified the MLAs one day before vote of Confidence. MLAs withdrew support to the Govt, on 6th October 2010, why Speaker took four days to take a decision to disqualify the MLAs. Once Governer has asked CM to prove his majority on 6th October, why Speaker disqualify them. Major motive behind disqualification is CM can not prove majority with out disqualifying the 16 MLAs. CM's hand behind disqualification of MLAs. Constitutional action to be taken against CM.

    I think they are paid heavily by either reddys or yeddy to file a complaint to Bopaiah so that 5 indipendent MLA's are disqualified and yeddy can save his sinking ship.Readers wait for more drama in coming days.

    This shows what type of govt we have in Karnataka State. Forcefull staement from voters. There complaints from voters about prakash varthur, Why the speaker is not taking action against him. Speaker should be punished along with chief minister.
