Bengaluru: Move to delegate vehicle registration rights to dealers questioned

Bengaluru, Nov 17: The state high court has served notice to the state government relating to a petition filed in the high court that has questioned a notification issued by the transport department delegating the right to register new vehicles to the vehicle dealers. The public interest litigation (PIL) in this connection was filed by retired transport department official, Mohammad Dastagir.

A division bench of the state high court presided over by Chief Justice Ritu Raj Awasthi which took up the above PIL on Tuesday November 16, ordered issuance of notices to the transport department chief secretary and the transport commissioner. It also said that the registrations which have been conducted based on the notification dated October 31, 2021 will be subject to the final decision that the high court might take in the case.

Ramesh Puthige, advocate on behalf of the petitioner, argued that the transport department's decision to entrust the vehicle registration right to vehicle dealers is in contravention of Motor Vehicles Act and is not good from the point of view of the general public. He said that this measure is as dangerous as giving the right of issuing passports and visas to travel agencies. There is possibility of registering vehicles in different names and hence he sought quashing of the said notification.

The advocate for the state sought time to file objections to the petition. The court adjourned the hearing after giving four weeks to file objections if any.

    Making the process online like getting PAN would have been sufficient, wherein information needs to be entered into the system and identity is biometric based aadhaar transaction - all of which can be done by the dealer sitting in his office only. Delegation of right is serious as now the ownership decided by the dealer will be admissible in court rather than decided by a Gazzetted officer. Government wants the money, but not the associated burden. If dealers can be held accountable along with delegation of rights, then it is a different matter. What happens if dealer closes shop and biz? Who will maintain the records, will be maintained by Government or it perishes when the dealer's computer system perishes?

Travel agents world wide do act on behalf of public for processing Visas, Passports, which is great help to the public, and benefits govt . too. In this era of biometrics and digital technology available, it is high time that we get rid of corrupt govt. officials who do not like change, simply becos it robs their chances of making money under the table. All govt. services should be digitalized and processed by private bodies, as govt. still remains final authority, and recipient of all revenues . Jai Hind!!!

    RTO was one of the most corrupt departments, govt has done the right thing, also many services are now online."Agents" are crying as they have no work, earlier they use to charge Rs 2500 for a work of Rs 500.

    RTO is one of the most corrupt departments .. The govt has done the right thing by taking the entire process online. Going online for all govt services is an effective tool against corruption ..One good eg is the finance sector like banks which have gone online ,has really transformed the way we do banking today .. The same can be emulated for all govt services .. Its difficult but not impossible.
