Disqualification of MLAs Upheld, Yeddy gets a Relief

Bangalore, Feb 14, (PTI): The Karnataka High Court Monday upheld the disqualification of five Independent legislators who rebelled against Chief Minister B.S. Yeddyurappa and reduced his government to a minority. 

The ruling by Justice Mohan Shantangouder, Justice S. Abdul Nazeer and Justice A.S. Bopanna comes as a morale booster for the beleaguered chief minister. The bench unanimously upheld the Oct 10 order of speaker K.G. Bopaiah disqualifying the legislators for rebelling against Yeddyurappa.

Four of the Independents - D. Sudhakar, P.M Narendra Swamy, Venkataramanappa and Shivaraj Tangadagi - were ministers at the time of the rebellion while the fifth, Gulihatti Shekar, had just been dropped from the ministry.

The five lawmakers said they would soon move the Supreme Court, challenging the high court ruling. They were disqualified by Speaker Bopaiah on the basis of the complaint by five voters, who said the legislators had betrayed their voters by rebelling against Yeddyurappa.

The five Independents along with 11 lawmakers from the ruling Bharatiya Janata Party (BJP) wrote to Governor H.R. Bhardwaj Oct 6 that they no longer had confidence in Yeddyurappa.

Bopaiah disqualified all the 16 Oct 10, a day ahead of the trust vote sought by Yeddyurappa in the state assembly. The chief minister won a second trust vote Oct 14 as the first one Oct 11 was termed by Bhardwaj to be not in order.

The rebellion by the 16 legislators reduced the Yeddyurappa ministry to minority in the 225-member house (including one nominated member) as BJP strength came down to 106.

The BJP's strength now stands at 105 as one of its members died and the Janata Dal-Secular (JD-S) won the by-poll. The BJP had won 110 seats in the May 2008 assembly polls and formed the government with the support of these five Independents, all of whom were rewarded with cabinet posts.

Though Yeddyurappa won the trust vote Oct 14 by 106 votes for and 100 against, his position has been shaky in view of the slender majority in the assembly whose effective strength now stands at 206 - with the 16 disqualifications and three vacancies.

The BJP has 105 members, the Congress 71, JD-S 27, Independent 1, nominated 1, and Speaker 1. Yeddyurappa has lost further ground even as the disqualification of the 16 is being decided by the courts, since final decision has to come from the Surpeme Court.

He is now caught in a web of scandals over land allotment to his kin and denotification of large tracts of land which allegedly benefited people who invested money in his sons business ventures.

The governor has permitted Yeddyurappa’s prosecution over alleged corruption and illegal land dealings. Two Bangalore advocates have filed five complaints against Yeddyurappa, his two sons, a son-in-law and several others over corruption and nepotism in land allotment and illegal denotification of lands.

Though the five Independent legislators will take their case to the Supreme Court, the unanimous high court decision upholding the disqualification comes as a major, if  temporary, relief to Yeddyurappa, who is under pressure to quit over the allegations.

( Kunthis 1st son born of Surya Deva “Dana shura Karna”(Another independent I forgot his name, he too is Danashura because he changed his side many times to help the people of his constituency, try to believe it) still supporting Dhuryodhana (Yeddy) At the end Pandavas (these 5 Independents) will win at any cost, Dratharastra (High court) can’t save them anymore. Because Shri Krishna (Governor Bhardwaj) is with Pandavas. The Final fight Mahabharatha Yuddha will start during the month of March. Take it easy get ready for the final war in supreme court. “Sathyameva jayathe” I wish these three High court judges read my comments.

    Here the judges had limited option to see the legality of speakers decision in diqualifying the independent MLA's, & the judgement is in expected lines, unless the Supreme Court finds something fishy in his legal decision-then the judgement will be upheld there also.
    The point the MLA's advocates failed to prove is that independents were independent though they participated in govt., activities & enjoyed power.
    The day they participated in party of governance meetings & minutes they should have been disqualified & the minority govt., would have come down from the day of its proxy rule(inception) which itself was illegal.

    As per Anti- defection law, Independent MLA's Support to BJP too is illegal, because they were elected as independent and they are not supposed to support any party. The law should apply in both the cases, this judgment is biased, judges want Yeddy to continue in office for reasons best known to them. (Of course we too know Operation Kamala has reached the court too.) Despite all efforts just few days left for yeddy, let us wait for Lokayuktha Court verdict.

    From the comments, it appears that we are not happy with the judiciary system in Karnataka. Please appreciate the fact that the independent MLAs were represented by efficient lawyers. These lawyers were not new to the court. Besides, it was not a split judgement. It was unanimous. The case does not stop here. The agrieved party has the option to go to the Supreme Court and they will go for it. Frankly speaking, I have no respect for politicians, whether they are from the ruling party or the opposition or they are independents as most of them have let down the people of this country. Of course there are a few exceptions but they are so few that one can count them on their fingers!

    Great Land Mark justice by Hon high court of Bangalore .I think Isamil K Perinje is not in a Habit of reading the News Thouroughly .Hon Court has taken Cognisance of the View that 5 Voters from the Indepenadant MLA s have complianed against them on which the Speaker has disqualified them and the Hon Court has found truth in that TRUTH IS ALWAYS A TRUTH These MLA s just tried to pull the rug from under the feet of shri Yedyurappa the CM .Speaker has rightly Disqualified them .In Haryana also same thing happened and the Supreme court also had upheld that .Jai ho Indian Judiciary .

    Beware....any indian can file a contept of court petition about your statements. If you think that all judges are appointed in high/supreme court at BJP times. that mean to say if congress was ruling it appoints judges favourable to cong???? dont mock the law system.....Frustration is because BJP won... .... until BJP is in governance u knw u cant do all conversions. Yeddi is Winning karnataka since he is in office convincingly......All the best... i support the development as done in Gujrath and Bihar., and i see this happening in karnatak after 60 yrs.This is proved by reports frm Central govt itself on many awards bagged by Karnataka Govt.

Please don’t talk about moral in politics, you are all applauded the “Governor” each and every time he took a decision to destabilize the BJP Govt, if it is “morally” and “politically” correct or not. Yesterday Dr. Parameshwar, Congress State President openly aired his views that he was very disappointed with the decision and will support those 5 independent MLAs in their future course of actions.     We all must respect the judgement. One thing we all must ask, whether these JUDGES are really know in detail about what constitution is telling about faith in political party. If they are well aware then we all must respect and incase if Supreme Court gaves different judgement then all these high court judges should be removed from the post. Every one who wants the fair judgement are depend upon these people and if they are not capable then there is NO point to trust them. Truth should be always honoured and practised.

    An independednt candidate is independent only for contesting polls. After that he become king maker. Once he decides to join a party in governence process his activities are no more independent. He rules just like other same party leaders rule. If the court judgement has been other way round, these so called independent candidates would continue to be king makers throughout their 5 years term and make a mockery of democracy.     You are not satisfied with Karnataka High Court Judges because BJP is ruling Karnataka, You are not confident or almost sure Supreme Court will confirm High Court Judgment therefore don’t want to trust Supreme Court Judges and suggest foreign court (international court)to take up the case because you believe foreign courts are anti BJP!!!, and trust that foreign.

    Come on man you are still not out of pre-independence slavery or are you groomed under the antinational culture? Why do you want to involve foreign countries in our internal affairs? Are you an Indian at heart?? I have doubts.

    Mr Keshava Puttur,independent MLAs have given undertaking for stregnthening first ever BJP state govt in south India with trust.In return what did BJP!?they were murdered politically for supporting them.As cabinet ministers they participated cab meeting,govt functions,in short represented govt as co members not as BJP members.I did not hear in 28 months these five MLAs ever exibited thier party loylity to BJP.This issue may have repurcussions in future when situation like in Karanataka had,then independents and others would think about supporting mainstream parties for forming govts.Wow BJP you are great and exibited true colors!Anyway Technically Yeddy has support of MLAs but morally and leagally BJP and Yeddy lost to rule Karanataka

In case had these 5 independent MLAs announced their support to Congress I, and subsequently if they decided to switch sides, then based on this judgement they would have been barred from voting in Assembly. How about that? Honourable Court's judgement makes it very clear that no indpendent MLAs can now switch their sides subsequently. This should bring down the premium on MLAs. Are you not happy with this development?

    This is a very good judgement and makes one thing clear - now in future no independent MLA's can blackmail any political party. This is good for stability of any govt.     Dear High Court Judges:

    Are you justified by your judgement. I doubt, your judgement is dictated by CM and the Speaker. I do not believe the Judges of Karnataka and also Supreme Court Judges as they are all appointed during the BJP regime. If we should have good Judgement only Justice Santhosh Hegde or Justice Saldhana can be trusted, because they have proved their honesty. Or only in the International Court in overseas can get the right judgement. Look at Justice Somashekar's one sided, dictated judgement? Only God Almighty is the righteous judge who will judge the false judges to hell. Wait and see.

    The five independent MLA and eleven BJP MLA lost the court battle for the time being.But the head-ache of Eddy is not just over.They will cause more trouble in the next Election.The BJP people are not laise with Eddy anymore.The BJP won the election just because the other hidden faction of groups supported the BJP on Hindutva.The promises made to them were not fulfilled till date.There is big challenge for BJP for next election..The Ram Temple,Ban on beef and Flag hosting at J&K all this agenda will not work anymore with educated Hindu voters.Only a innocent ,unemployed youth and labor class people voted the BJP and they are BJP vote bank for another few years.Once the real Hindu people realize the importance of developments and peace then only secular parties will survive.

    This judgement is quite surprising. I am not able to understand how independent MLAs can be disqualified under anti defection law?

    But this is the judgement of Judiciary and everybody has to accept this with all humility. Now independent MLAs should be careful not to attend any party meetings as being done by these independents.

    Now atleast I hope that Yedyurappa will not indulge in 'Operation Kamala'and concentrate on administration.

Then what is definition of anti -defection law for BJP ?You know gentlemen in Kerala an MP Sudhakaran acused of bribing SC judge for a favor in verdict in which he is eye witness!In another case immediate past SC chief judge KGB was accused of amassing wealth beyond known source of income inculding sons and son in law!?So we have to wait for the SC verdict in this particular case because if my guess is correct this is the first ever case independent MLAs got disqaulified.

    If 5 Independents withdrawal of support to BJP govt. is wrong? Then their support from day 1st itself should have been wrong!!!! Both things cannot go together? That means Yeddy never had majority from day One. That much common sense the judges doesn’t have means they are biased. Karnataka is like Egypt now, with shameless politicians like BSY n HDK who goes to any extent to be in power. (Mysore ZP President Election is another example)
    We were expecting this judgment from High court. Hats off to yeddy he got his valentine day Gift as I wrote before.

    Good decision from highcourt,it is a good lesson to lawmakers who changes a loyality for their personal gain....
    It is a big slap on law expert,cow expert,constitution expert and so on....again and again...he has no moral right to continue in his office......
    It is a lesson to HDK who is openly trying to pull down the democratically elected goverment..
    It is a good lesson to Congres for trying to pull down the goverment in back door....
    It is a sad news for day light dreamers and congress spoke persons
    Finally I believe BJP will complete its term and get ready for another term too........
    I repeat Yeddy has no moral right to continue in his office....

    verdict of court is correct,when indipendent MLA give support to govt. they became part of govt. till that period. MLA should think before they give support.

    The verdict is bit of surprise and subject of debate.How could independent MLAs disqualified since they were not won in any party's simbal?Who has the authority to issue WHIP?Anti- Defection law now seems to be widened instead of strenthened.Did independent MLAs got natural justice or justice is a million dollar question.Yeddy may have got temp reprive but the case against denotification for his kieth kins will honound long time which may break his 'Development Mantra'

    Yeddy might have won court case and he knows the tric of the trade how to get the court verdict to his favour.But ,Yeddy is morally lost his credibility and this verdict will not bring any cheer to him.Even if CM indulged in such a huge corruption in the history of Karnataka ,yet he is still CM.What a tragedy of this land?
