Karnataka HC upholds dismissal of CISF constables accused of raping colleague's wife


Bengaluru, Jun 22 (IANS): Karnataka High Court has upheld the order of dismissal of eight CISF constables from service in connection with alleged gang rape and blackmail case.

The accused had allegedly gang raped and blackmailed their colleague's wife, which led to their dismissal. Later they approached the High Court against the dismissal order by the CISF's Disciplinary Authority.

The complaint was lodged in 2015 by the victim.

According to the complainant, one of the accused persons had allegedly befriended her. Taking advantage of the friendship, he blackmailed and raped her. Later other accused persons had threatened the victim that they would make her affair public and gang raped her.

Taking serious note of the incident, CISF had dismissed the accused from the service.

The CISF Disciplinary Authority had stated that "discipline and morality are paramount in the organisation and the act done by the accused could not be forgiven. The act which has taken place will have negative consequences on the husband who was away on duty".

Dismissing all the accused from the service, the authority also opined that the act of accused persons would also make other staff, who leave behind their family and go faraway places on duty, insecure.

Meanwhile, all eight accused were acquitted of the criminal charges by the trial court. After the order, the appeal was filed in the High Court questioning their dismissal. It was argued that from the statement of the complainant recorded in the criminal case "it was evident that she was a consenting party to the alleged incident".

The High Court stated that the incidents like this will bring down the morality of police constables and dismissal order by CISF is appropriate. The order was given recently (June 15) by the division bench headed by Justice Alok Aradhe and Justice J.M. Khazi.

    All should be sacked- no compromise. What morale - the CISF in charge should have done the sacking himself. Threatening women with blackmail and gangrape is normal modus operandi of men in sexual predator groups- whether they are in uniform or common public does not matter. Group predators are reason why women get assaulted sexually - it is end of life itself like in extreme case of Nirbhaya,

    According to the complainant, one of the accused persons had allegedly befriended her. Taking advantage of the friendship, he blackmailed and raped her........instead of blaming the victim.....Tell me Jos sir, what accused did was right ? When accused knew, her husband is far away, why he wanted to be friend with her in the first place ? He should have understood..."her husband is like me". Would he agree if other men take advantage when he is away on duty by black mailing or threatening? Even victim showed conscented behavior, accused should have kept him from her in a distance THINKING and KEEPING him on her husband's place. Finally, tell me who are those who raped her ? MEN only right?...One was befriended right ...? Why others blackmailed her ? Is there a word called trust ? Faith ? How to believe anyone who approach in the name of goat in the pretext of friendship and finally ending up into WOLF ? If friends do forget the word "trust"....how about the enemies? I feel enemies are much better than friends....They never look at your face ...turn the face and go. Men should take their wives if they work faraway....Even couple staying together under one roof, sharing one bed....betrayal is seen everywhere...Please dont justify sir, women are bad...and men are saints....If you see rapes are done by friends by befriending with them first.

    Matthew 26 : 41 "the spirit is willing, but the flesh is weak.” Cynthia, it is impractical to go into the nitty-gritty of this episode. Common sense speaks that both the parties are at fault...partially or fully. This incident wouldn't have arisen if her husband had taken her along. Many factors must've been involved.
