SC slams Allahabad HC's ‘Insensitive’ remarks, stays ruling on attempt to rape

New Delhi, Mar 26: The Supreme Court on Tuesday strongly criticized the Allahabad High Court’s controversial remarks on an attempt to rape case, calling them “insensitive and inhumane.” The apex court has stayed the observations made by the high court, stating that such interpretations of the law could set a dangerous precedent.

A bench comprising justices B R Gavai and Augustine George Masih took strong exception to the high court’s ruling, which held that acts like grabbing a woman’s breast and pulling the string of her pyjama do not constitute an attempt to rape. The supreme court expressed deep concern over the lack of sensitivity in such observations and has now sought responses from the Central and Uttar Pradesh governments on the matter.

The development comes at a time when judicial comments on sexual offenses have been under scrutiny. Earlier, the Supreme Court had also stayed an order by the Allahabad High Court, which had called for examining a rape survivor’s horoscope to determine whether she was ‘manglik.’

Legal experts and women’s rights activists have welcomed the Supreme Court’s intervention, stressing the need for a more compassionate and legally sound approach in cases of sexual offenses. Many have pointed out that insensitive remarks in such cases not only undermine victims' trauma but also weaken the fight against gender-based violence.

With the Supreme Court stepping in, the matter is set for further legal deliberations, and all eyes will now be on the next course of action from the judiciary.
