From opening a bank account and obtaining a mobile SIM to checking into hotels, Aadhaar is essential for various services. However, mishandling or misusing Aadhaar details can lead to serious legal consequences — including imprisonment.
According to the Unique Identification Authority of India (UIDAI), using Aadhaar data improperly or attempting to tamper with biometric information such as fingerprints or iris scans can attract a heavy penalty. Under the UIDAI (Adjudication of Penalties) Rules, 2021, unauthorised access or violation of UIDAI directions is punishable.

Up to 3 years in jail for Aadhaar misuse
As per UIDAI’s official website (uidai.gov.in), altering or attempting to alter an individual's demographic or biometric data to impersonate someone is considered a criminal offence. Such acts can result in imprisonment for up to 3 years and a fine of up to Rs 10,000.
How to check if your Aadhaar has been misused
To monitor your Aadhaar usage:
1. Visit the MyAadhaar website and log in.
2. Enter your Aadhaar number and the CAPTCHA code.
3. Click on 'Login with OTP' and enter the OTP sent to your registered mobile number.
4. Go to the ‘Aadhaar Authentication History’ section to view when and where your Aadhaar was used.
If you suspect misuse, report it immediately to UIDAI.
Aadhaar updates are crucial to keep your card active
UIDAI recommends that every citizen update their Aadhaar details every 8–10 years. Failure to update information such as photographs or address proof over a long period can result in the Aadhaar being deactivated or invalidated.
UIDAI is urging citizens to ensure that their Aadhaar cards are up to date, especially with current photo and identity documents. Inactive or invalid Aadhaar cards can lead to difficulties in accessing government services and welfare benefits.
