Mangalore, Mar 9: It is learnt that BJP has decided to knock at the doors of courts to set right the injustice it feels it has suffered because of what it terms as faulty interpretation of rules by the returning officer. BJP district level leaders are making preparations to file a petition in the court, seeking stay for the election of city mayor, Gulzar Banu.

It is said that the BJP leaders will be filing the suit in the district court here, duly questioning the procedures followed in holding the election. Their hope of getting a favourable judgment hinges on the argument that there is no mention about the format of the caste certificate in proforma 27 under Karnataka City Corporation Election Rules, 1979. They also point out that there is no restriction that caste certificate in the prescribed format should not be submitted at the time of scrutiny of nominations, and that under rule 72B, there is no restriction that caste certificate submitted during scrutiny should be in a particular format.

Along with this move, the leaders have also discussed about the necessity to change the tactics in running the city corporation administration in the face of unexpected turn of events at the mayoral election.

It is learnt that the concerned have 15 days time to file the petition. The legal opinion on the issue is also divided in general, depending upon the political leanings of the advocates.
