Bangalore: HC Warns Govt on Delay in Appointing Lokayukta

Bangalore, Jul 17 (DHNS):
The Karnataka High Court on Monday warned the State government that it would write to the governor stating that there had been a constitutional crisis in the State if the delay in appointment of the Lokayukta continued.

“There has been no appointment of Lokayukta for the past one year. If this continues, the government will be in trouble. We will write to the governor stating that there is a constitutional crisis in the State,” the Division Bench headed by Chief Justice Vikramajit Sen warned, while hearing a petition seeking the appointment of Lokayukta.

H S Nilakantappa, a resident of Tarikere, has approached the court over the delay in the appointment of the ombudsman.

Questioning the State government over its inaction, the Bench directed the government to furnish the information pertaining to appointment of the Lokayukta. The court issued the notice returnable within a week to Chief Minister Jagadish Shettar, who assumed office only last week.

The court also expressed its displeasure over a statement made by Law Minister Suresh Kumar that the State was awaiting the Supreme Court’s decision on the issue. When government counsel mentioned about a special leave petition pending before the Supreme Court, the Bench brushed it aside saying that the petition pertained to the appointment of upa lokayukta and not of lokayukta. The court adjourned the matter to July 23.

The petitioner, who has also arrayed the chief minister as a party in his petition, had alleged that the government had kept the post of the Lokayukta vacant deliberately. The post has remained vacant since September 19.

    Dear Justice Sen,
    Off late, our ex CM DVS has openly conceded that non appointment of Lokayukta was his great mistake.Thank God this openness comes to our politicians only they are out of power.When they are in power, are afraid of Lokayukta and feel that if new Lokayukta is appointed their pant may become wet anytime.Just to avoid awakward this situation and keeping in mind the point of hygene,they take precaution !!! Nothing else.

    Sir, we are busy in fighting for the chair and power. We dont have time for governance and forget about appointing Lokayukta. Our time is very short so we want to loot our state and tax payers money as we are sure that we will not be there to form a govt in 2013...Ours is a disciplined party and party with a difference and we are happy to inform you that our high command has renamed our party as Bhari Jagaladuva Party....yours sincerely....BJP govt of karnataka...

    If Government is delaying the appointment of Lokayukta, then why don't the court appoints person with clean image as Lokayukta? Warning by HC doesn't make any sense. Government will try to find loopholes in judicial system as our judicial system is so weak and influenced by criminals and corrupt. This is not limited to one political party or to one state. It is applicable to all political parties and all over India. God save our Country.

    High Court warned State Govt that it will write letter to Governor. When Governor himself rejecting appointment made by State Government then how come he can take action? At least we have adopted Lokayukta in Karnataka State, where as many Congress ruled States still do not have Lokayukta, then why, so called High or Supreme Courts are keeping quite? I think we, being Karnataka People should feel proud that all rules and regulation for State Governments must starts from Karnataka Government only as informed by UPA at Central

    The remote-controlled Shettar needs a Lokayukta of respected Santosh Hegde's clout and integrity. Hope the appointment is not in the hands of Shettar himself to facilitate fence devouring the crop.
