Praveen Puttur, 14 others escape death penalty


NEW DELHI, Jan 22 (DHNS): The Supreme Court on Tuesday converted the death penalty awarded to 15 convicts to life term by holding that unreasonable delay in the disposal of mercy petitions by the President or governors could be a ground to commute death sentence.

A three-judge bench presided by Chief Justice P Sathasivam also laid down guidelines to “safeguard” the interests of death row convicts in view of disparities in different state prison manuals and the procedure adopted to deal with mercy petitions.

The judgment comes as a fresh lease of life to seven convicts from Karnataka. Four among them are forest brigand Veerappan’s associates Bilavendran, Simon, Gnanprakasam and Madiah, rape-cum-murder convicts Shivu and Jadeswamy, and one Praveen Kumar Puttur.

Praveen Kumar had brutally murdered four persons of a family, including three women, in Vamanjoor on the night of February 23-24, 1994. The victims were Appi Sherigarthy, her daughter Shakunthala, granddaughter Deepika and Appi Sherigarthy’s son Govinda. The Mangalore sessions court had convicted Praveen Kumar and awarded him death sentence in the year 2002 and the Karnataka high court had upheld the death penalty on October 28, 2003.

The 12 points listed out by the court mandated the authorities, among others, to give a minimum 14-day notice before execution, mental health evaluation, final meeting with families and post mortem of the convicts after hanging.


The bench held that the ground of unexplained delay for commutation of death sentence would be available to all convicts, including those facing terror charges.

The 156-page verdict comes as a relief to Khalistan sympathiser D P S Bhullar, whose mercy petition was rejected by the apex court on the grounds of grave terror charges against him.

Bhullar had petitioned the court on the point of delay in disposal of mercy petition and his poor mental health.

Former prime minister Rajiv Gandhi’s assassins V Sriharan alias Murugan, T Suthendraraja alias Santhan and A G Perarivalan alias Arivu, whose separate petitions will be taken up by the apex court later this month, may also get the benefit of the judgment.

While dealing with 13 separate petitions, the bench said, “We are of the cogent view that undue, inordinate and unreasonable delay in execution of death sentence does certainly attribute to torture which indeed is in violation of Article 21 (Right to life and liberty) and thereby entails as the ground for commutation of sentence.”

However, the bench, also comprising Justices Ranjan Gogoi and Shiva Kirti Singh, said that the nature of delay–undue or unreasonable–must be appreciated on the facts of each individual case and no exhaustive guidelines can be framed in this regard.

    This is a major debacle for India and Indian judicial system. Why then the supreme court did not alert the lower courts to speed up and punish the murderers without delay. The real onus must be on the supreme court for lack of judicial delays. It is really pathetic that our legal procedures are very vague and not in conjunction with fast developing countries in the world. We need good law in practice and the amendments must be done to punish the murderers then and there. I opined that these notorious criminals should be disposed for eternity instead of languishing in jail and incurring huge loss to exchequer. God give wisdom to our law makers and let the justice prevail in the greater interest of our society.

    Roshan Braganza's comments are always biased comments. May be he is a Lawyer who saves CRIMINALS. Otherwise, he will not write like this. His previous comments are also biased & are in favor of Rapists & Murderers. There is no point in advising him.
    Rapists & Murderers should not get any mercy. They deserve only death penalty.

    Yea sure Rohan Braganza, maybe we can send them birthday and Christmas gifts as well every year, why not, they aren't human.. What if they committed any heinous crimes, murdered someone in cold blood, lets all keep our angers aside n grief aside and provide happy n comfortable life for all those criminals. so that, next time more people have an excuse to get angry and kill someone just coz they don like their face. How about that?

    What is wrong with you, Mr,Roshan Braganza???. Your comment shows your way of VERY NARROW THINKING and also you have not come across any such incidence to any of your near and dear once. The Vamanjoor murder of 4 in the family is our close relatives and the murder has not been done out of anger, but by dreaming of becoming rich within a fortnight by stealing valuables. Think and comment next time, please comment with proper sense.

    Victims have gone against the judgement of their death punishment and made mercy petition to the President. Now the government has to appeal to the President to revoke their life imprisonment to reinstate death punishment if there any such chance in IPC?

    Its a landmark judgement upholding human rights. But in case of serial habitual offenders should be seriously counselled before release to stop from them being further liability to society. Now a days we see the death punishment is being awarded even in simple cases of rape and murder , which may be 'rare' but not ' rarest of rare ' . Often courts bulging to media pressure accentuate punishment in the above cases. Only multiple serial murders can be termed as the rarest of rare. Life imprisonment term varies with state , in Karnataka, its 14 , in Tamilnadu, its 10 and in some places its even less.

     Prisoners should be provided least punishment as prescribed and give them a chance to rehabilitate. Parole should be included in term and should be accessible even to poor convict. Better food , sanitation , media access also education is every prisoner right. As juvenile crimes are increasing age of criminal responsibility should be brought down to 12. Lastly, lets remember 60 percent crimes are committed in anger and provocation rather than intentional. so giving them an equal chance to mingle with society is their fundamental right. India being a Gandhian nation should abolish the death penalty for ever as most of the nations have done it.

    Indian law is supporting criminals. Good for the nation. As long as we have lawyers to protect these criminals, we need to live in fear. It is pathetic to see these murderers, not awarded death sentences. What right this murderer had to kill innocent victims? These ba...ds doesn't need any mercy. But Indian courts are so merciful, for these criminals and hence crime rate is very high in India.

    This is the landmark judgement by the apex court, It means a slap on union government, home Minister, law Minister and caution to the president of India. Those culprits do not have any right to be alive due to their grave crime. They will spend the rest of their life in Jail. The directions given to the government by the court to be followed. Shame on our union government so many innocent ladies, children, honest police and forest officers brutally killed by these criminals still escaped from capital punishment due to the negligence and lithargy of our union government. Union home minister may be waiting to get his royalty to move the files of mercy petitions. It is also possible may be waiting for political mileage. The way they uted Afzal guru, is an example how political parties trying to get milage. 21st century we are living sending mission to Mars but our leaders/rulers, not able to discharge their duties in time. Mockery of democratic process in this country.
