Raghaveshwara Swamiji hearing,another judge withdraws from case

Bengaluru, Jan 20: Joining the bandwagon of his brother judges, Justice K N Phaneendra and Justice Ram Mohan Reddy, Justice Kumar announced on Monday January 19 that he would be recusing himself from hearing an appeal preferred by Sri Raghaveshwara Bharathi Swamiji of Ramachandrapur Math, seeking cancellation of rape case registered against him. It may be recalled that the Swamiji has gone on appeal against the decision of the single judge bench of the high court, which had dismissed his petition seeking withdrawal of the rape case.

It may be recalled that Justice K N Phaneendra of the high court had withdrawn from hearing a petition filed by the Swamiji seeking cancellation of a notice served by criminal investigation department police asking him to appear for medical examination. On January 6 this year,Justice Ram Mohan Reddy, who was chairing a division bench along with Chief Justice, D H Waghela, had sought to recuse himself from hearing the case when it came up for hearing that day.

When the appeal filed by the Swamiji came before the division bench of which Justice Kumar was a part on on Monday, he announced his decision to stay away from hearing the case. As a result, the chief justice is faced with the task of transferring this case to another division bench. However, none of the judges have given reasons for seeking to excuse themselves from hearing cases involving Sri Raghaveshwara Bharathi Swamiji.

    So far 5 Judges have withdrawn, & one Newspaper few days back had mentioned that in one case regarding Raghavendra Matha in 1970's, 7 Judges had withdrawn.

    So, with these trends, people are getting fed up with such sort of adminstration.... & if our Nidderamiah doesn't still wake up, he may be given gate-pass by public, & may have to rest permanently in his home in future.

    If our HM is unable to handle sensitive issues, this things may come again & again. In fact he is quite incapable & is belived to be biased in these sorts of issues. Can we ever think of our highly appreciated IA carry enquiry months after months, & perhaps its 4 months now ?...without either submitting report clearly, & playing with sentiments of public ?.... In fact if these trend continue, it may not be astonishing if this case is transferred to the neighbouring states on pretext of doubt of fear of political pressure, something like Kanchi case where it was transferred to Pondichery from TN. It is really painfull to note that how such respectefull people are so humilated all by means, by hook or cook. Really disgusting indeed.

    All these days I also had a feeling that there might be some faults by the swamiji.But off late I have realised that this is a pure case of blackmail.Hence I have full support to swamiji.

    Like you many commentators in this web had earlier commented against Swamiji with all filthy words at their command.They belong to all communities but more from non hindu.I was deeply pained as the comments were mere illusions.I had in comment stated that writting with out substanceagainst Swamijis,Priests from RCs.Mullahs etc., is wrong and its is unpardonable sin if the remarks prove to be a conspirecy.Now with latest development it is becoming clear all the game plan to malaign swamji is mischievous and for ransum.Sathyameva jayathe......
