Mumbai: Salman Khan, sentenced to 5 years in jail, gets two days interim bail

Mumbai, May 6 (Agencies): The Bombay High Court on Wednesday granted interim bail for two days to Bollywood star Salman Khan, hours after a lower court here sentenced him to five years in jail for a hit and run accident that killed one man in 2002.

Salman Khan was sentenced to five years rigorous imprisonment by a Mumbai sessions court, which convicted him of culpable homicide in the 2002 hit-and-run case, dealing a big blow to the Bollywood superstar.

Judge D W Deshpande, who held the 49-year-old actor guilty of "all charges", including driving under influence of liquor and not possessing a driving licence, pronounced the sentence after a 45-minute adjournment of the proceedings.

A big crowd, mostly of Salman's fans, thronged around the court located in Fort area of south Mumbai.

The actor, who had fought back tears after being convicted, looked calm and composed as the judgement was read out to him in the presence of his close family members.

The superstar's brothers Arbaaz and Sohail and sister Arpita were present in the court on the judgement day, which came after a long drawn legal process.

Dressed in a white shirt and blue jeans, the actor arrived in the jam-packed courtroom minutes before the proceedings began in the morning.

Sessions court judge D W Deshpande ruled "all charges" against the actor have been proved, including the stringent charge of culpable homicide not amounting to murder, besides various other offences, including rash and negligent driving and driving under influence of liquor.

The judge held that the actor also did not have a driving licence. The prosecution had alleged that Khan was driving without holding a licence and, to buttress its charge, produced RTO records to show that the actor had procured a licence only in 2004, two years after the tragedy.

The court, while pronouncing the judgement, drew parallels with the Alistair Pereira and Sanjeev Nanda BMW cases.

Asked if he had to say anything about the verdict, Salman denied the charge that he was driving the vehicle at the time of the accident.

Salman had earlier been tried for the lesser offence of causing death by rash and negligent driving which attracts a lighter punishment of imprisonment upto two years.

After examining several witnesses, a Bandra Metropolitan Magistrate had called off the trial midway in 2012 and slapped the serious charge of culpable homicide against the actor before committing the matter to the sessions court.

The court, while convicting the hugely popular actor, upheld the prosecution's contention that he was at the wheel when his Toyota Land Cruiser ran over five people sleeping on the pavement outside American Express bakery in suburban Bandra, killing one person and wounding four.

    What a law we have sometimes criminals gets bail and comes out some times innocent gets jail. and when it comes to celebrity the case will take a decade so the lawyers can make crores of money as a commission from them and finally celebrity goes to jail. i ahve seen some people said they are not big fan of Salman so you guys are against him? if your loved Hero does then you support his crime? whatever actor he could be he is the best hero his acting is not wow but people are crazy to watch his movies and broken many records by collecting crores thats called luck.

    Gabbar for your kind information Indian law is like that only. People make the law & they only break the law.

    I totally disagree with Salman getting 5 years jail. No person is allowed to sleep on the roads. Roads are meant for driving only as you know. On the roads only dogs sleeps.

    He has started charity work so much. It was an accident & not done intentionally.

    I would say in that Sanjay Dutt is a terrorist. Why 2 different laws for 2 celebrities?? Sanjay Dutt had AK-57 and so many people died. He should be made thadipaar from India. Why no guts???

    By the way I am a great fan of Salman Khan. But again I would say it was an accidents. Please try to find out the meaning of accident.

    Even before i read that you were fan of Salman Khan i knew you were his fan. And i would say that the people like you are deluded. Thats why you make stupid arguments. Salman Khan was drunk, was driving without license and killed a person who was on footpath(footpath is not for driving). And on top of that instead of accepting his mistake he and his lawyer claimed that his driver was driving the vehicle.

    I cant understand why people like you dont even understand such a matter. Even Sanjay Dutt was punished his stupid fans came up with some stupid explanation for why he should be pardoned.

    Salman is even accused in hunting of black buck. I hope he goes to jail for that.

    Accident is accident. Can judge or court prove pavement is place to sleep? Thousand and thousands people in India die in hit and run case and police not able to catch the drivers and even if catch they will come out without proper proof.

    Is Law equal to all citizens of India or is it differ from Judge to Judge who pronounce the verdict. If it is same, why couple of mass murderers rule our India even today. Prayers of many especially of old Indian citizens living in old age homes will come to the rescue of Salman as he is a great human being and does good quiently without much publicity.

    Those sleeping on the pavements are less previlaged to have a house of their own and belongs to the downtrodden class. India is not a welfare state and the demand that administrative machinery shall also be charged for negligence together with the convict will best be applicable for countries like Sweden, Norway, Finland etc., where sole aim of the government is welfare of its subjects. Response and tweets from a few that people will be run-over if they are sleeping on footpaths are nothing short of cruel jokes. The flimsy stands taken by the defense to create procedural hurdles and to prolong the process for 13 years speaks for itself. Credibility of Indian criminal justice delivery system is enhanced by few notches by this verdict!!!!!!

Salmon is a great man also friend to modI baba and you like modI baba etc don't mean court has to be in justice based on who is the friend to whom and who is believing which god etc and offer justice accordingly it doesn't work like that. Five people sleeping are injured, one of whom later dies" this was the statement published but there were not only guilty by Salman, but there were list of convicted officials also i.e. then Commissioner of Police of Mumbai, Commissioner of Mumbai city corporation, Local Police officials, who allowed people to sleep on the road side. Along with Salman, those culprit also would strictly be imprisoned by the court of law. If police force would have been strict in India, no one sleeps on road side like that ever. India kub sudaregaa bhai?

    Salman Khan should bow before the law of the land and accept the decision in all humility. He has every right to take recourse to appeal before the Higher Courts. Nevertheless it is better he answers his conscience and follows his colleague Sanjay Dutt. Mistakes do happen in life. When wealth seems to convince a person that they can take law into their hands, consequences turn out to be bitter.

In these 14 years our law allowed him to entertain people in masses by his movies, open Humanity initiative BEING HUMAN which helped lot of poor/ cancer patients / Orphan Children.     For a cold murder and drunken driving, only five years?

    It would have been more appropriate for the judicial laws of India to severely penalize these superstars in their material assets, take away their crores of Rs and give a better life to the millions of suffering people sleeping in the roadside, hungry and naked. Also, force these big stars to be in the streets to help the helpless people as the due penalty of their reckless and arrogant nature so that they will be transformed in course of time and would be a lesson for the other big stars who are acting like they are above the law.

    My faith in justice, truth, equality, which had vanished year's ago.. has some how, been restored !!!!
    Scoundrels, rogues, thieves, celebrities, politicians had hijacked our simple, honest way of life... Common man is a non entity in modern India !!!!! Today a part of my belief that i am a Indian has been restored...Salman Khan, being a celebrity,influential,with political connections... tried to scuttle the case.. he hired eminent lawyers who helped him buy out witnesses, including cops, destroy evidence, delay & prolong the case for 13 years... finally when the case was not going his way, he visualized a master plan,
    claiming, that his driver was driving his vehicle & he was not drunk..The readers can just imagine the monetary value offered by Salman to his driver......for being A BALI KA BAKARA !!!!!!!!!!
    He often attacked the prosecution team on communal lines... claiming that they were maligning & biased against him, because he was a Muslim... He tried every trick under the sun...but the learned judge saw through his diabolic plan...& sentenced him for 5 years
    He actually deserved more then 10 years RI...Salman is a wicked animal not fit to be a human being...he tried to equate human life with money power..this wicked monster trumpeted that he was doing a lot of charity & social good work.. a similar mockery undertaken by dubious politicians & so deserves to be acquitted !!!!!
    This evil animal is so well connected, he will try every loop hole.. just to avoid being jailed..
    The case against killing wild animals like the black buck in Rajashtan should be expedited.both cases should run concurrently !!!!!

    At least he could have accepted his mistake in the court instead of trying to save himself all these years. He was wrong in driving when drunk. However, killing was not intentional.     @Praveen, in 2007 Bus-Tempo accident in Moolur Highway on my cousin's marriage day and 17 people died and 13 of them are my close relatives. The bus driver came on wrong side, hit the van badly and caused to death of 17. Still he is working for other bus as a driver. So why not court punished him??????

    This is another example of long delay verdicts in India. This does not make sense now as long years passed and Salman himself proved to be good in his actions recently.
    If the verdict would have come immediately (within max. 2 years) makes sense to the society.
    Anyway crime is crime and has to undergo punishment but not decades after when all are available for justice.
    Law should be fast enough to do the justice/ verdict as put in LOKPAL.

    After the verdict there will be several arguments for and against. We should introspect why this accident happened at all. Majority of people come to Mumbai only for employment they avoid going to other metro cities due to lack of opportunities without any accommodation/money arrangements. The Maharashtra government should also be reprimanded for allowing people to sleep on foothpaths. In the Middle east also people come on Visit Visas, Do you find anyone sleeping on Footpaths, the reason being the Law is very strict, you will be jailed/questioned if you sleep outdoors. In India though the law is there why nobody implements it. Why the Judge did not rap Maharashtra Government. If you sleep in the footpath there is huge risk to be run over by Cars incase of accidents/drunkdriving. Why to compensate people who knew the risks before sleeping on footpaths, if they do not have place to live they should have gone back to their native place. They should also be punished along with the person who committed the accident.

    Rules should be made country specific. The act where commoners are sleeping on pavement when the actor’s Land Cruiser kills one and injures four is surely an accident and not a crime committed out of some evil intention.
    It rather shows the Indian situation in bad light where on one front we claim to be a to-be super power and on the other front we have people sleeping on road in one of the most celebrated cities of India.
    If Salman Khan is to be blamed for killing those innocent people so should the authorities of Municipal Corporation for allowing people to sleep on road sides.
    I am sure there are more such cases in past where decision is still pending. So why trap just one person, just because he is a superstar? Also, is it justified enough to put a person in jail for rash driving? What purpose does it serve? Salman’s conscience is already guilty about what he did.

    0ur judiciary has time and again proved that it will not spare anybody. The same judiciary has sent another big film star Sanjay Dutt to jail in the Mumbai bomb blast case of 1993. The same judiciary has sent mighty people like AIADMK supremo J Jayalalithaa, business tycoons Subrato Roy Sahara and Ramalinga Raju, self-confessed godman Aasaram, Janardhana Reddy,the powerful Haryana politician family Chautalas and many others in various other cases across India. Instead of shedding tears for Salman Khan's plight, the so-called educated society must hail the judgement and express sympathies with the poor victims of Salman Khan's rash driving.     The Law in India is very confusing. During Riots you are free to kill anyone for Eg Sikh Riots,Hindu-Muslim communal riots. But in normal circumstances you cannot kill by mistake/purpose any human being or black buck. He should be punished no doubt but where are the rioters who killed several people in the name of Riots. What is the action taken against them. In India Killing a Black buck is a grave crime but killing human beings/looting money no issues at all.

    Yes – no one should be above the law and all crimes should be punished as per the law irrespective of whoever it may be! Let’s follow this good example and bring all the culprits under the same law and let’s punish everyone who has committed a crime.

    Now – what will be the consequence of this judgment?
    1) The judge & the attorney involved with this case will become famous and popular
    2) A very nice masala news for all the news channels and they will run this news all day and will have few stupid people having National Debate for hours and hours on National televisions
    3) All the investors who invested on Salman Khan movies & projects will be crying and face huge losses
    4) Those who were getting support from Being Human foundation may also cry and this BH foundation may face some downfall in the absence of Salman Khan
    5) Those girls who wanting to marry Salman Khan will start searching for a suitable compromise
    6) The families of injured parties & the Driver’s family will not get any monitory benefit from Salman Khan, which (if they get) would have been very good for them

    In the process of punishing one Salman Khan, did we kill many more than what we have already lost in the accident????

    I would anyday prefer a 100 crore fine to Salman and finish the case.

    Salman can afford the above fine with some pinch on his earnings. Govt can use the money to compensate the victims, rehabilitate the survivor or make a living for him or compensate him also and use the money for some good cause to benefit the traffic situation or the police manning it and close this case. Jailing Salman Khan will not give any justice to anyone, that too after so many years. Lot of people especially rich/politicians kids etc get away with such accidents all over India and they is no law that reaches him, I think Salman khan is just paying the price for his stardom and IPC has to prove that no-one is above law. There are worst kind of crimes like Rapes & Murders and other offences committed in India and the criminals escape using the loopholes in the law, this is a peanut case compared to this.

    This is just a decision of Mumbai sessions court, now he will move to High Court. It will take again 5-10 years. After that he can move to Supreme court and Hit & Running case will continue.....

    Historical judgement ! Salman is my favourite actor..I am sad,but It doesn't mean that I have to support him for wrong doing.People should remember that celebrities are not God..Law is equal to every one..Court sent Sanjay Dutt to jail..now one more Celebrity will go behind bars..We,common citizen are expecting same type of judgement in IPL fixing case where top,very infulential 6 cricketers are involved !!
    Two days back, IG Mr.T.J.Jose(Inspector General of Police) from Kerala was caught red handed while copying in EXAM hall..He was immediatley asked to go on leave..but,strong evidence is against him..So,IG can't escape..

    No one is above the law of the land.
    If Salman is guilty he should face the consequence. Let us hope that session court judge in his capacity conducts the trial impartially (voice of true conscience), assesses the credibility and arguments of the parties and would announce fair judgment. (10 years prison sentence).
