HC censures government for not enforcing law on cow slaughter


Bengaluru, Sep 23 (DHNS): The High Court of Karnataka has censured the State government for not enforcing laws that ban cow slaughter and illegal transport of other animals.

Hearing a PIL petition by Gau Gyan Foundation, a Delhi-based nonprofit, a division bench of acting Chief Justice S K Mukherjee and Justice B V Nagarathna on Tuesday demanded why the government had failed to enforce a single-bench judgment of March 6, 2015. “What kind of administration is existing in the state if court orders are not complied with... All the State’s discussions and submissions are bogus.” The single-judge bench had directed the government to strictly enforce the ban.

The NGO urged the court to direct the government to prevent the illegal transport, sale and slaughter of cattle, besides strictly enforcing the Prevention of Cruelty to Animals Act, 1960, the Karnataka Prevention of Cow Slaughter and Cattle Preservation Act, 1964, and the Prevention of Cruelty to Animals (Transport of Animals) Rules, 1978.

The petitioner contended that almost one lakh head of cattle are illegally brought to Bengaluru and unlawfully sold in APMC yards. That’s not all, she bulls, buffaloes and cows are openly slaughtered in front of other cattle, which is against the law on cow slaughter. The 1964 Act restricts slaughter of cows, calves and she buffaloes, but allows slaughter of bulls, bullocks and buffaloes if they are aged above 12 or if they are no longer fit for breeding or draught or do not give milk. However, all types of cattle are being slaughtered, the NGO claimed and sought the court’s directive to create awareness about the law among members of the community involved in such acts by involving their leaders.

During the hearing, an organisation filed an interlocutory application, seeking to bring the court’s attention to the fact that animals are being slaughtered in homes because of lack of space in slaughterhouses. But the bench didn’t entertain the application as it wasn’t submitted as per the procedure.

The court disposed of the PIL petition by directing the government to enforce the law as mentioned in the March 6 judgment but refused to pass a separate order.

    Government is deaf and totally silent with closed eyes on the subject. As a fair estimate more than 50 lakh Cow and Cattle are transported in violation of different Acts & Rules in the presence of RTO, APMC, POLICE, CIVIC authorities. A Report submitted to State Government in December,2015 revels all these facts and same was submitted by Gogyan foundation to Hon'ble Karnataka High Court. Karnataka has become feeder to all nearby States. Earlier government brought the Prevention of Cattle slaughter Bill,2010 but was taken back by the present government to fulfill promise with minority. Karnataka State Goseva Ayog was constituted to fight this evil but this government even withdrew the office rooms where to allow the working. We strongly welcome Honorable Karnataka High Court's comments and Directions on the issue

    The truth is every where in India the so called ‘mother cow’ is forced into yearly pregnancies. After giving birth she is milked for 10 months but will be artificially inseminated during her third month so that she is milked even when she is pregnant. The demanded of production of milk is more than her body can give. So she starts breaking down body tissue to produce milk. The result is an illness called ketosis.And nobody file a PIL in HC or SC.
    People are looking it into a different prospective, that too during Bakrid festival when a certain community believe in sacrificing a Goat,Cow,Bull or Buffalo.
    If you have observed around every part of our villages and milk farms,most of the day the cow is tied up in a narrow stall usually wallowing in her own excrement.
    She gets infections because the hands that milk her are rough and usually unclean. She gets rumen acidosis from waste food and unclean or grass with pesticides.
    The statistics show that in India 20 percent of the cows let loose because keeping them will cost them a lot and many are starved to death.
    If you go and check with Amul company, it is proved that,every male calves are sent to slaughter houses because they are not productive for them.
    It is also proved that Amul has a production of more than 30 Million litres per day,If you calculate 20 litres per cow per day,there should be 15 lacs cows in Amul farm. If you consider 20 percent become old,stop giving milk,means 3 lacs per year and appx 900 cows per day.

    Do you think Amul is sending these cows to Goshala? They slaughtered and exported to china.
    It is the time now,these judges should wake up now. What laws you are talking about? We should stop eating cow meat and only export it?
    Do you know the VA or the police is giving a smooth permission for the cow, bull, buffalo transport?

    whether govt can ban the cow slaughter or not & we are least bother about that. but atleast ban the cow theft from the hut. vote bank politics is not good for democratic country life.

    Here humans committing suicide people and the law enforcement are bothers about cows.

    Kill the cow and have its meat abundantly.

    The govt has nothing to do with our meals plate.Cow slaughter not banned completely .First of all allow the legal cattle trade to run and then others.If court can consider the religious sentiments of jains at least for four days then why not the muslims who required to slaughter on bakrid.The best solution is leave this matter for the personal liberty.In india cow slaughter is an issue of politics.Cattle bring votes without any voting card.If the court is more sincere then must ban all animal slaughter.ITS LAST WEEK ONLY THE RETIRED SUPREME COURT JUDGE MARKANDEYA KADJU SAID IN NDTV THAT HE MIGHT MADE MISTAKE OF JUDGEMENT ABOUT BANNING MEAT TRADE WHEN JAIN FESTIVAL IN 2006.

    ..you are in KSA and your comments 'govt has nothing to do with our meals plate' doesnt suit well..can i find pork!!..when it comes to religious sentiment, you are in front row my bro..i am definitely not in favor ban (many Hindus eat beef in kerala/NE states) but particularly in DK there are many incidents of theft..these cows are bread earner for poor farmers/families..there must be some break on illegal transportation & slaughtering..

    I am writing this, since I feel very sorry the way cows are slaughtered in Al-Khabeer slaughterhouse, meant for export. This is from Al-khabeer website.

    India has largest cow slaughterhouse and most slaughtering there is done by Hindus.

    Before slaughtering, cows are not given any food or water for 4 days. It causes hemoglobin to move from blood into fat. The meat with higher hemoglobin fetches better price.

    Then the legs are broken and the eyes poked out, so that a certificate can be obtained about their uselessness.

    Afterwards, the animals are pushed into washing showers. Extremely hot water is showered on them for 5 minutes to soften their skin, so that it will be easy to remove. The animals faint at this point, but not dead yet. Then it is hung upside down with a leg on a chain pulley conveyor. Half of the neck is slit to drain the blood, till now the animal is not dead.

    After death, the skin swells thick which sells for poor price. But the skin of the live cow is still thin, which has better price. One side, the blood is dipping from the neck and on the other the skin is peeled. By now, the cow is dead.

    Friends, I have written this not with any ulterior motive, but, I feel such cruelty to animal should be stopped.

    If it is cruelty to animals then stop killing sheep, goat & poultry. Stop catching fish they are living creatures. Let them enjoy their life. Also stop consuming vegetables they too are living organisms. Just breathe air and drink water. No need to enforce law for each and everything!!! Live happily forever.

    The honourable High court has passed a judgment seeking for laws to be implemented based on a complaint by a NGO. Why are you dragging BD/Police, Aliens, CIA , RAW into all this? What about PFI, SIMI etc ? You never even by mistake condemn their activities.

    how can you say that. the cows are stolen from the hut itself by showing weapons to the owner of the house. the only suggestion is we have to stitch some dress & put on the cows to hide their identity. so that we can try to save the cows.
