Pontiff moves HC, seeks quashing of CID notice on medical tests


Bengaluru, Sep 24 (DHNS): Ramachandrapura Mutt seer Raghaveshwara Bharathi, who is facing rape charges, has approached the High Court seeking to quash the CID notice issued to him on September 21, 2015, directing him to appear for the medical examinations that were pending.

The seer has contended that he has already undergone medical examination and that the CID cannot compel him to undergo further medical examination without the permission of the court.

The petitioner has stated he has earlier refused to undergo physical examination of external genitalia, pubic hair examination, penile doppler study and semen analysis as he has stated that he is potent and a complete man.

He further contended that the forensic report states that there are two male DNAs but it is silent on female DNA.

The petitioner stated that the court, in another petition, had observed that certain materials have been collected from the alleged victim and the same required to be matched with the material taken from the seer for DNA profiling. He has further stated that he has already given blood samples and DNA profiling has been done and again the CID has asked to appear for pending medical examination, which is violation of fundamental rights of the petitioner.

The seer has sought directions from the court to grant stay on the notice issued by the CID and to quash the notice. The CID has booked Raghaveshwara Bharathi on charges of raping a Ramakatha singer.

 

Govt can't do anything to arrest seer,says Jayachandra

Bengaluru, Sep 24 (DHNS): Law Minister T B Jayachandra on Wednesday said that the State government was not in a position to do anything with regard to arresting Ramachandrapura Mutt seer Raghaveshwara Bharathi, who is facing charges of rape, as he has obtained bail from court.

Speaking to reporters, he said that the government also wanted the suspect to be arrested as early as possible. The CID, which is conducting the investigation, is gathering all evidences. Charge sheet will be filed soon after all evidences are collected. The government will not interfere in the investigation, he said in reply to a question as to why the seer has not been arrested yet.

    Just allegations doesn't make anyone convict. Only after completion of Trial one can be called 'Convict' or 'Relieved'. Till this day, our IA is unable to prove her allegations, & still they are looking for any trace of evidence. Why can't they just hand over as on date reports to Court ? So that Court will decide in to the matter. If his followers are in full support of him, why are you so upset Mr.Sachidanand Shetty ?

    only if he allows it to complete. The Seer is trying every possible way to delay the investigation by taking stay after stay. Why....my respect for him would have increased if he says conduct whatever investigation on me...I am ready to prove my innocent. The way he is avoiding tells a lot.

    The Seer has already given Blood for DNA Sampling as per Court Order. Here the threat is of taking of details & pasting it on the cloth to prove her allegation. Naturally he has every right to move to court to seek justice. DNA derieved from a person be it Blood-Hair-Skin,etc. are same, & he has complied with the court orders. Just we have to wait & see what Court says on this issue.

    It is a serious allegation and so far evaded from the clutches of RULE OF LAND?Why all these dramas even from the Govt side.If a average person accused as like this one Police might used AEROPLANE punishment.....HOW LONG THESE EVADING,COUNTER FILING OBJECTIONS ETC ETC LAST?SCIENTIFIC INVESTIGATION DID NOT PROVE?EITHER CLOSE THE CASE FOR GOOD OR TAKE IT AS SERIOUS.EVEN NATIONAL WOMEN RIGHT CHIEF ACCUSED STATE GOVT FOR MISHANDLING THE CASE...IS LAW ONE FOR POOR ANOTHER FOR MIGHTY AND WEALTHY?
