Udupi, Oct 15: In a much-awaited judgement, the Udupi district sessions court on Thursday October 15 convicted three accused in the 2013 Manipal gang-rape case and sentenced them to rigorous life imprisonment.

Two others were also convicted for destruction of evidence and sentenced to three years in jail. However, hours after the judgement, they managed to secure bail from the same court.

The main accused Yogish Poojary, Hariprasad Poojary and Anand were sentenced to life imprisonment for kidnapping, issuing life threat and raping the girl, a medical student in Manipal, on the night of June 20, 2013.

Also, the three have been told to pay a fine of Rs one lac each for gang-rape, Rs 5,000 each for issuing life threat and another Rs 5,000 each for kidnapping.

Two others - Balachandra (brother of Yogish) and Harindra (brother of Hariprasad) - were found guilty of destroying evidence. Apart from jail term of three years, each of them was also told to pay Rs 5,000 as fine.

Judge Shivashankar B pronounced the judgement and the quantum of punishment.

Speaking to reporters, public prosecutor T S Jithuri hailed the verdict and said, "This judgement was awaited from two-and-a-half years. The court has given the maximum punishment in the case. Let this be a lesson to others who indulge in such crimes. This is an excellent judgement. As the public prosecutor, I fought this case not only for the victim, but for the society as well."

He also thanked police officials like former SP Boralingaiah and Manipal SI Sadanand Tippannavar and other officers who gathered sufficient evidence in the case.

    One of the land mark victory for the victim. This may be one of the case registered due to brave girl and her parents support. There might be many such incident not reported due to social stigma.

    Those fines are laughable at best. Fine for rape should be kept at 1 crore. For kidnapping... it should be 50 lakhs. Threat to life should be 50 lakhs. The cost of breaKing the laws should be crippling.

    Till our weak government & law start hanging criminals who commit such crimes there is no end for this all. It took 2 n a half years for this judgement. In other countries they would be hanged within minutes. Such a shame that the other 2 were sentenced but within hours they were granted bail. Seriously this country has become a most unsafe place especially for women. From traffic offence to Rapes there is no end here atall. God save this country.

    At last!.after two and ahalf years are gone on land and thanks to the prosecuter for fighting here for the victim.I am sure the victim will be happy to hear this.Forget about their Penalty paying.whether they are in a state to pay?Hope this will be a warning for others.Whether anyone will take notice of it?

    Life imprisonment implies a jail term for the convict’s entire life, the Supreme Court has held, clearing a misconception on this sentence.

    The apex court also said that its Constitution bench’s landmark judgement of 1980 on criterion for imposing death penalty needs a “fresh look” as there has been “no uniformity” in following its principles on what constitutes “the rarest of rare” cases.

    “It appears to us there is a misconception that a prisoner serving a life sentence has an indefeasible right to be released on completion of either fourteen years or twenty years imprisonment. The prisoner has no such right.

    “A convict undergoing life imprisonment is expected to remain in custody till the end of his life, subject to any remission granted by the appropriate government,” a bench of Justices K.S. Radhakrishnan and Madan B. Lokur said.

    The bench, however, clarified that under remission the appropriate government cannot reduce the period of sentence less than 14 years for a life convict.

    “In the case of a convict undergoing life imprisonment, he will be in custody for an indeterminate period. Therefore, remissions earned by or awarded to such a life convict are only notional. In his case, to reduce the period of incarceration, a specific order under Section 432 of the CrPC will have to be passed by the appropriate government. However, the reduced period cannot be less than 14 years as per Section 433-A of the CrPC,” the apex court said.

    The apex court order also seeks to put an end to the practice of en-masse release of the convicts by various governments on “festive” occasions and said each release requires a case-by-case basis scrutiny.

    It has been a very good judgement.While they are in Jail take these people in and around of manipal udupi roads and make them to fill the road ponds by mud or what ever means and this is unending problem of our roads and this is the best opportunities to utilise them properly

    I am strongly of the opposite view.. give death sentence to all rapists or better still shoot them as soon as possible. It has been proven many times that rapists never reform, and they have no hope of becoming normal. Better to finish them off...

    Rs. 5000/- fine imposed for kidnapping! It wont cover auto expenses at Mangalore rates. Fine should act as a deterrent and it should be substantial. The least, it should be linked to CP Index.

    quick observations. At least it's a short duration we heard the verdict than earlier instances where it used to take decades to the punishments. Good progress. Trust there is no provision for them to go to other courts now escaping the judgment. because usually we see that happening. We will be happy to hear very strict and severe verdicts , but next day we hear that they have gone to supreme court and after days supreme court holds the judgment. At least in this case there should not be any such provision. Actually they should have given death penalty because now they will be enjoying in jail with our money. why the hell ? So eliminating them from the society with the death sentence would have been the better option. any ways, at least they are sentenced jail for life time... good.
