New Delhi, Feb 20: The Supreme Court has dismissed a contempt of court petition filed by Shah Khadri of Datta Peeta at Bababudangiri here, accusing the state government of failing to comply with the orders of the Supreme Court pertaining to procedures and rituals that are allowed to be performed at the site.

Shah Khadri of Bababudangiri Dargah, Syed Ghose Mohidin, had approached the Supreme Court seeking to proceed against the state government for allegedly failing to comply with the earlier directives issued by the apex court. A division bench of the Supreme Court comprising Justice Ranjan Gogoi and Justice Prafullakumar Pant dismissed the petition, finding it to be not in order. At the same time, it allowed the petitioner an opportunity to rectify the defect in the petition and resubmit it.

The petitioner had sought to hold the government guilty of violating the court order, contending that the district administration has been preventing the concerned from bringing frankincense into the Dargah for performing Mujavar, also known as Fateh, into the Dargah.

The Supreme Court had earlier ruled that the state government has to take a decision as to which religious practices of Hindus and Muslims could be allowed inside Bababudangiri's contentious site that is sacred to both the communities. In September last, the court had asked the government to study in detail a report submitted by the commissioner for religious endowments department through the deputy commissioner, and take a decision after hearing objections and petitions. It also had given opportunities to the concerned to approach the court if still they feel that justice was not done to them by the state ministry decision. No specific time limit had been prescribed for the state to comply with this order.
