Sedition law needed to stop anti-Indian rants: Santosh Hegde


Hyderabad, Feb 22 (PTI): Former Solicitor General of India N Santosh Hegde said on Monday that he was in “favour” of the sedition law as some “restrictions” were needed to stop people from abusing and talking against the country.

The retired Supreme Court judge argued that the act of some Jawaharlal Nehru University (JNU) students, who allegedly termed the execution of Parliament attack convict Afzal Guru “judicial murder” and raised anti-India slogans, “definitely amounts” to sedition.

JNU Students Union president Kanhaiya Kumar was arrested on sedition charges earlier this month. Five students, accused of sedition and missing for days, surfaced on the JNU campus last night.

"I believe in sedition law. I am a patriot. Any patriot cannot go on abusing the country. There are certain parameters," the former Karnataka Lokayukta told PTI.

"Many people think differently in this country whose allegiance is with some other country or some other group … if democracy has to survive, then there should be some restrictions on the people talking against the country.

"Forget all other things. You criticise the government, criticise the individuals, criticise the system. Patriotism can never be criticised," he said.

Hegde has said he does not believe in the previous judgement of the Supreme Court that says mere talk is not sedition and should be followed by actions, something contrary to law.

"I don’t believe in that judgement. Sedition means propagating some views which are against the nation. As long as the judgement of the Supreme Court is there, I am bound to say it is the law of the day today. I am one of those persons who would say that the judgement should be changed," Hegde said, citing events in the JNU after the February 9 controversial event, including violence in Patiala House.

"You can’t meddle with patriotism. Everything is alright (but) patriotism can never be compromised," Hegde said.

He strongly sought to counter those who favour junking the century-old sedition law saying it was an archaic legislation and a relic of British colonialism.

"What about Indian Penal Code. How old is it? You scrap Indian Penal Code because somebody is involved in a crime? (and wants it to be scrapped). It is a 230-year-old act. You change it," Hegde said, reacting angrily to suggestions in some quarters on scrapping the sedition law.

    Doctored video used by both opposing parties. Agreed kanaiah did not chant anti slogans. But as leader of the student momvement why he did not reveal names when asked. And where did the azadi video of Kanaiah came where he talk about azadi from pvoerty and all that. So he knew that there would chants of azadi in JNU before it happened. Or was the video done after the incident? Most of you seem to have your views biased because there is a govt at the centre which you dont approve. Today when soldiers get killed in borders Kejri and Rahul hold march protesting death of Hyderabad university student. What about dozens of thousands of soldiers who killed. Suporting their cause may not fetch vote to Kejri and Rahul. Hence this drama. Because of soldiers you have freedom of speech. Otherwise Pathankot kind attack and your bolti would be permanently Bandh. Now you ranting becase of soldiers.

    Mr Santosh Hegde is not the conscience of the nation. His views are influenced by his past job as a Supreme Court Judge. His job doesn't make him more patriotic and the rest in India less. In the present case concerning Mr Kanhaiya the question is can sedition be slapped against him when the Zee TV journalist has made an expose that it was a doctored video used by his channel. The whole issue is centred around the video which went viral. What happens if the courts decide that Kanhaiya is innocent? Will the government, media and others compensate for loss of reputation and mental agony? There should be a law to compensate in such cases. Every citizen is aware that the constitution of India has stated the reasonable restrictions while exercising the freedom of speech. Let us be patient for the courts to give justice. Quote -"Hegde has said he does not believe in the previous judgement of the Supreme Court that says mere talk is not sedition and should be followed by actions, something contrary to law".Unquote - This direction by the SC is the right way to slap sedition - words should accompany action. Otherwise it will end up in "Murder of democracy" and none can voice their dissent on a government.

    Your comments are wrong, we don't think BJP or NDA Govt or Zee TV, has doctrine the video, but definitely they have taken the advantage of such a stupid act of the students.

    The Video clip about anti national slogan raised by some students are shown on International channels like BBC, International Asia, CNN, ABC, NBC, some European channels, Australian SBS, these are very reputed and professional channels, which broadcast without bias, they check the authenticity of the video, voices & people involved before they make public, and there is no doubt anti national slogans were raised at JNU campus by some students.

    It's a total embarrassment for India, such students must be punished under sedition law, everyone should respect the Nation and its constitution.

    There are frequent anti national slogans & Pakistani flags are raised in J & K, central govt should also act on these people and should be charged under sedition law, why only JNU students?

    Being an Indian citizen one should not raise slogans against India.

    Why we want strikes or slogans in Universities we dont want groups or parties in University or college. make one law, for all students, if they want to study then study or else they should be kicked off from college. unless you do this these nonsense will be there. Only study nothing else. If you want to support anti nationals then you can go and join Pakistan army or ISIS. Give them a free ticket and send, then Ban them from India.

    I salute and Hats off to Santosh Hegde sir for his patriotic statement about change in sedition law.You are the real hero and patriotic person.Each and every individual has got the right to criticise,blame or hurl accusations at any one,government,an individual in a democratic country.But not the country in particular,where he/she has born,living,educating and availing all the facilities of mother India and then shouting against the same.This is condemnable and not tolerable at all.     As rightly pointed out by Hon. Retd. Supreme Court Judge/Ex-Lokayukta, Mr. Santosh Hegde, there can be absolutely no compromise, regarding patriotism.

    There should be "Zero tolerance" towards anti-nationals/anti-national statements and attitudes, since we are Indians first.

    There is enough scope in democracy to criticize and express your opinions, but there should be absolutely no scope for being anti-national. No country on earth can/will tolerate anti-nationalism. We are above all,
    Indians first.
