Bengaluru, Mar 11: Karnataka High Court on Thursday, March 10 said that Non-Karnataka registered vehicles do not have to pay lifetime tax as demanded by transport authority.

The High Court declared the Karnataka motor vehicle taxation (amendment) act, 2014 unconstitutional which allowed the collection of lifetime tax on vehicles registered outside Karnataka. The High Court also quashed all the demand notices issued to owners of several such vehicles to pay the tax by the transport department.

Several vehicles bearing the non-Karnataka numbers were seized by the transport department for non-payment of life time tax after they remained in the state beyond 30 days.

Non-KA registration vehicle owners had approached the high court requesting that the court should direct the transport department not to collect lifetime tax as they have been paid in other states. It also said the harassment of vehicle owners should also stop as the tax was illegal and unreasonable.

Justice Anand Byrareddy pronounced the orders on a batch of pleas. He declared the 2014 Act unconstitutional.

Justice Byrareddy observed in his judgment that 'Lifetime tax that is levied at the point of registration of a vehicle as per the KMVT Act cannot be levied on a vehicle that is already registered, merely on a presumption that a vehicle registered outside Karnataka has remained in the state for a period exceeding 30 days.'

The court said the basis of the government’s decision and explanation given for the collection of lifetime tax are unconstitutional and ultra vires.

    Someone should challenge the constitutionality of life time tax. It should be on yearly basis. If the vehicle is totaled due to accident right after paying lifetime tax, is the owner gets pro-rated refund?

    Good decision. Karnataka state road tax are highest compared to neighboring states. This puts pressure on government to review their current tax policy.
    We have choice now regarding registration, if government do not review

    Please dont pass such comments when you do not stay in karnataka, come to karnataka only on your 'annual leave' that you get in your wonder land 'dubai' and do not understand the ground reality & hardships people face. These unreasonable Karnataka motor vehicle amendment act was unconstitutional as declared by the HC judge and this result was long overdue. This greedy money making amendment act put people visiting or working in karnataka through extreme hardship, me being one of them. My vehicle was impounded though I was visiting Karnataka for only 2 months on business. I was asked to pay lifetime tax of 15 years for just 2 months of visit. I obviously did not, my vehicle was not given back for 4 months until the HC intervened and put a stay order on collection of LT tax. This gives hope that justice still exists even if a government fails to provide it.

    This is what I was always saying to DUFFERS. Road tax in Karnataka is 2 times higher than neighbouring states and roads are worst even in cities like Bangalore. Where all these money goes?. Reduce road tax, it will encourage people to register in Karnataka

    HC and SC must scrap many draconian laws in India, which are not in tune with the changing times, and also hinder progress of our nation.

    Some people don't mind spending lakhs of rupees to buy swanky luxurious cars but get their vehicles registered in places like Pondicherry to save a few thousands in road taxes thereby duping motherland 'Karnataka'. These people should be asked to go back to Pondicherry..!! Right????

    dear patriot,

    should you register your vehicle in your beloved Karnataka, and then move to Pondicherry, would you be willing to pay road tax once again if asked to do so?

    Is there any other state in India, who imposes this absurd law?

    Are the roads in K'taka better than that of Pondicherry?

    Do you have any idea where does this looted money ends up with?

    HC and SC must scrap charging toll on highways, as every vehicle owner has paid life time road tax, and due to the fact we are given poor quality roads, which are wasting our money on maintenance and fuel as well.

    Concept of life time tax is totally wrong. It should be annually collected after checking the fitness of vehicles. I appreciate the UAE's system of annual vehicle registration renewal and vehicle fitness checking system which is good for all.
