Mangaluru: With family wanting land back, 40-yr-old govt school faces uncertainty

Mangaluru, Mar 28: Questions have arisen about the survival of government school at Babbukatte, which is providing education to the people of the area since the last 40 years. The school, which has imparted education to thousands of people during these years, has been served with legal notice by a family to vacate the place within two months.

The government primary and high school at Babbukatte had begun to serve the people of this rural area in 1976. The school was started in 44 cents of land donated to the school by a local named Ramesh Kotian. In this land, primary school was started in 1976, and high school section was added in 1980. It is said that the failure of successive officials to get the land transferred in the name of the school is the root cause for the current crisis-like situation.

Ramesh Kotian is no more. His children, Deepak and his sister, are seeking the school to vacate the land. The teachers and villagers alike are taken unawares by this sudden development, and have requested the government to take steps to see that the institution continues to serve the locals.

The department of education, on its part, also failed to pursue the matter of getting the land transferred in its name. Other than sending a letter to the tahsildar in 2013 to transfer this land to the school, the department did not do anything, it is gathered. The then zilla panchayat vice president, Satish Kumpala, had held talks with the land donor's family and the education department on this issue in the presence of Deepak and his wife, Ramya. Reportedly, a decision to install the stone bust of Ramesh Kotian at the land, and to appoint representatives of land donors as ex-officio member, had been taken during this meeting. The family had agreed to transfer the land in the name of the government subject to adhering to these conditions. It is said that the fact that the land value in the area has multiplied manifold in the recent past has encouraged the family to serve legal notice to the school in a bid to wrest the land back. The education department says it is determined to fight back this effort.

School development and monitoring committee member, Chandra, expresses surprise about the fact that Deepak, who has served vacation notice along with his sister, is trying to evict an institution of which he is a past student.

Block education officer, Jnanesh, confesses that the department does not have records to prove that the land belongs to the government, and that RTC also mentions Ramesh Kotian as its owner. He said that state health minister, U T Khader, who is the MLA representing this constituency, has been approached. He confessed that the teachers are surprised that an old student of this very school wants the school to be vacated from the land. He said that everyone wants the school to survive this crisis and continue to serve people.


What family says

Speaking to daijiworld, the late Ramesh Kotian's son Deepak said that the family was unaware that the land had been donated to the school. "My father had never said that he had donated this land to the school. None of us knew about it. After my father passed away about 12 years ago, the school authorities claimed that it had documents to prove that the land had been donated by my father. We believed them and did not enquire much.

"However, now it has transpired that the school has no documents at all to prove its claim on the land. If the land had really been donated, they should have supporting documents," he added.

"We studied in the same school but we were not given any concession. Our family has never been called for any school programme either, the way donors are invited in other schools. Just recently the headmistress had called us for a meeting, but that was the only meeting we ever had. There have been no talks. It is for our mother and us four siblings to decide and we will fight this case legally in court," Deepak said.

    If State Govt. wish they can allot vacant land to the school to build a new school, and till then school should pay reasonable rent to the owner. I dont justify to buy that land by the Govt. because compensation given by the Govt to the land owner will be a peanut. Better leave the land and Govt. can build a new school, in other place, so that students wont suffer the academic studies. Its not justifiable for the owner to donate the land at free of cost.especially present condition.

    Government of the People should pay fair market value of the land to the legal owners of the property including fair market rent since the death of previous land owner. As long as Government collect tax from it's private Citizens it should not have power to get free property from private Citizens. Children of Mr. Kotian take the Government to court.

    It Looks bit mysterious.Children of the donor are not small ,he died before 12years,and they didnt knew father donated this?whether the father didnt settle who gets what before death?when one said there are documents about donation then where did they go?why are they coming now to Claim?after 12years fathers death?only questions and no answer.would they accept other land if anyone asked them.sure not .because present place must be more costing .and builders are staying line must be.sad for students.Till govt builds a new school ,present students will be having self School going children. Dont they shame to ask back donated place from father?

    Which Politician owning this land would have donated it to run the Government Primary School without getting ten times larger land and in a central place?
    Which bhakt would have donated? Which Secular would have donated in
    present times when land prices rockeing sky-high.
    Govt. has lots of land - just shift the school.

    If anyone of you owned this land and kept quiet until now, that in itself was a great deed towards education of the locals. Now time has come to shift and thankfully Govt. school should shift.
    The Govt. authorities of the school themselves are to blame. They never took care to transfer the land.
    Now Government should hire this premises for a year until they build a school for those who are studying there. There should not be any legal tangle. If they do no one in future will allow a Govt. School on their premises.
    Ministers\politicians whacking acres of land here and there almost for free. Take back that land and build Government Primary school on that land.

    Govt. should take over the land and thus the long standing school be saved for the sake of education of the surrounding children. Land was donated by the Father of the children who now want to grab the land. Why they are so selfish ?

    Negligence of the govt.has come now very costly self.why did they neglected to Register?second question,certainly noone builds a School without land approval.Atleast who donated land should be havind documents if not govt.Is strange here.Now within two months to vacate a School is not a joke.Atleast they should give some more time to handle.Otherhand govt,should buy the land and give freedom if they are ready to accept.There is wurm in this case.something wrong,fishy.bad for children.where there no witnesses while donating?

    Since the Govt authorities are running the school for years in this plot and the owner of the land is no more - at least the schooling children should not be deprived of their right.
    Kotian family may like to approach the management and ask them to put a board engraved in their family name as donors of this prominent school land in case they are interested and solve the issue amicably for which they may gain Gods blessings

    Forefathers’ times and the present world have gone through a major economic change and property value. Land value for 40 Cents would be a big amount indeed.
    Let the government arrange to settle the matter as per prevailing land value and continue the school for the benefit of the students.

    Why cant government pay the current value of the land to the real owner. school doesn't have the documents to prove so who knows its donated or illegally acquired. Why people hearing are blaming the family with out proper knowledge.

    in another view they have to look that is school education but they told school management never invited them for any function as a guest

    40 Yrs Old School & Owner's Children studied there. They have to pay the respect to school whether school management invited or not. Education is one of the important factor it will give them much reward then money.
