Cow slaughter not allowed, but beef lovers can eat meat in Maharashtra


Mumbai, May 6 (HT) : The Bombay high court ruled on Friday that it will no longer be illegal to consume or keep imported beef but said ban on beef slaughter will continue in Maharashtra.

It struck down two provisions of the Maharashtra Animal Preservation Act, 1976 which prohibits the import of beef, and criminalises possession of beef.

A division bench of justice Abhay Oka and justice SC Gupte held that section 5(d), which prohibits possession of beef imported from other states, violated right to privacy and the right to choice of food that is guaranteed under Article 21 of the Constitution.

It also held that section 9 (b), which penalises possession of beef by providing imprisonment of up to one year and a fine of Rs 2,000, as unconstitutional.

A number of petitions were filed in high court challenging the constitutional validity of various provisions of the Maharashtra Animal Preservation Act, 1976 which were introduced by 1995 amendment, but brought into force 20 years later in March 2015.

The petitioners primarily contended that section 5(d) was extraneous, as it had no rational nexus with the object sought to be achieved by the enactment brought in force to protect cow progeny in Maharashtra.

“There is no reason for the state of Maharashtra to be worried as to whether there are enough cows, bulls and bullocks in Ireland or for that matter some other country or some other state in India,” senior advocate Aspi Chinoy, who represented one of the petitioners, said.

The senior advocate had also pointed out that in several other states there was a ban on the slaughter of cows, bulls and bullocks, but there was no ban on import of beef from other states or other countries. He said section 5(d) curtails the fundamental right of choice of food of citizens, covered under the right to liberty guaranteed by Article 21 of the Constitution of India.

He said reasonable restrictions can be imposed on fundamental rights, but such restrictions must be justified on the ground of some compelling public interest.

The state government, on the other hand, contended that the amendment has not been enacted to harass beef eaters, but to prohibit slaughter of cows, bulls and bullocks in the larger interest of the agrarian society.

“Let’s not look at the act as something done to harass people,” advocate general Shrihari Aney said.

    People who want to eat beef in Maharashtra would be well advised to buy packaged beef with marking of made outside of Maharashtra as the govt can still harass beef eaters by filling cases which will need time and money to fight in the courts.

    The main purpose of banning beef in M'rashtra and elsewhere by Feku gang was not only to harass beef eaters, but to harass Muslims in particular, who not only consume it , but are also handling the beef related industry in a dominant way in India.

    Thanks to the drought conditions in India, cow owners can now send their cows to Modi should they decide to give them up due to lack of water or fodder.

    Stone age mentality of this govt. must be strongly condemned .

    Dear friend, the number of cattle died in Maharastra due to the drought is too many to count, but a hidden fact.

    The beef-ban has crippled the leather industry of Maharashtra, also other States like Tamil Nadu which was the leading State of India in leather industry.

    The high protean low priced delicious food was taken out of the plates of the human beings in Maharashtra to please the holy cow mother. The holy mothers are suffering too much under the BJP Government. The only monetary asset of the poor farmers was their cattle when the cattle got old, they were sold and got young cattle for milking and farming, thus the mere survival was going on without any interruption under the former Governments but the current Government is systematically introducing the population control through starvation death.

    The Home Minister and the Andhra BJP spokes person Naidu were too highly dedicated to have national beef-ban and anti-conversion laws enacted. It was with the whole intention to have plenty of beef for export to beat Brazil as the leading exporting nation of the world. Hunger is the worst pain of life, finally the BJP will be learning the bitter lessons of hunger arrows from different States of India. Why the BJP ruled Goa is against cow mother worship? Why Gujarat is the leading State in beef export? Can the BJP stop the beef export from Gujarat? The BJP Government and Amith Shaw will not utter a word against that. Watch the real democracy of India!

    These mentally disoriented politicians will destroy the nation step by step.

    But you people not only harass but your men killed innocent people all over the country.
    The whole world is laughing at us that we are considering Cow as God and cows are roaming and starving for food and water on roads.
    The Judges of courts has to think with more wisdom on these crucial issues which are dividing the country. How can you have different laws to different states inside one country? The Judges should use their brains once again and answer why on earth you can draw lines between cow meat and buffalo meat.
    At one place you offer cow, goat, or bull to a deity and at the same time you say Cow is mother and God?
    Do you want the Police to carry a forensic expert every time they go for a ride if a Fanatic call the police to complain that his neighbor is cooking cow meat in his house.
    This is utter non-sense to ban the beef or any meat for that matter.
    We are in 21 century we are going backwards to stone age.

    The BJP leader has promised the electorate of Kerala that if the aachi din hot party is elected to power, they will not prohibit beef eating in Kerala. Didn't say about the killing punishment of 10 years. The leader may have a contract with Amith Shaw to bring beef from Gujart or Goa and to make big money for the cow mother loving BJP.

    I already struck a deal with a farmer in Bhanda on the border of Goa that he will send his cattle (when they are useless for him) across the border and I will send him some goodwill gesture in notes and then send the meat back to Maharashtra where Marathis can have beef sukka with whiskey. Tell me, am I doing anything illegal??

    1. India is 3rd largest beef and buffalo exporting country

    2. Cow slaughter not allowed by law in all the states inacted during the rule of congress except west bengal and kerala

    3. It is being said India is a country majoritarian Hindus and Hindus are vegetarian but static report Indians consume more meat

    4. In Gujarath cow slaughter is allowed to export and mint money by Gujarathis and consumption is not allowed. Modi govt paved way for making money

    5. Now in Maharashtra high court ruled that cow slaughter is not allowed but consumption is allowed . not allowing to consuming beef violated right to privacy and the right to choice of food that is guaranteed under Article 21 of the Constitution.

    6. Beef can be exported from kerala and west bengal to other part of India and also it can imported from abroad

    This is interesting, in the neighboring state Gujarat slaughter is allowed but not(?) consumption. In Maharashtra it's the other way around. Though it looks win - win proposition for both Guj and Maha, Guj stands to gain financially.

    India is exporting beef to other countries. Gujarat is also contributing. But Why people from Maharashtra have to eat imported beef when it is available in India.
    Gujarat state can send some portion to Maharashtra.

    What is the point in the ban.... In places like Latur which is seriously a "Drought hit area" Farmers are unable to sell their cattle as no one is ready to purchase them in the fear of government action, and are just leaving their cattle in open field. as they cant afford to see them dying in front of their eyes nor are they able to feed them. neither their family because of the Ban.

    Today the laws are being made in the interest of hardly 1% but at the cost of rest 99%.
