Justice Hegde justifies sedition charge against Amnesty International


Hyderabad, Aug 19 (PTI): Former Supreme Court Judge N Santosh Hegde has said slapping of sedition charges against Amnesty International for hosting an event in Bengaluru where anti-India slogans were allegedly raised is justified, even as he questioned the credibility of the NGO.

He said Amnesty International cannot "run away" from its responsibility by saying that none of its employees shouted slogans.

"What's the responsibility of Amnesty International? They should have known that when you bring these people and allow whatever they want to speak, (and) then to say I am not responsible. No, you have made a platform available to them... You are an abettor. You cannot run away from that," Hegde, also the former Solicitor General of India told PTI.

"Raising pro-independence slogans amounts to sedition. It amounts to sedition according to me," he said.

"Let's take the institution's (Amnesty's) crediblity. What did Amnesty International do when soldiers were killed ? What did Amnesty International do when other terrorist activities were taking place in this country? Did they ever call a meeting like this? You try to get some popularity and when it backfires, you run away from it," he said.

"Taking into consideration what was spoken in the Bengaluru incident, I would say it certainly amounts to sedition," the former Karnataka Lokayukta said.

At the event organised by the Amnesty on Saturday, anti-India slogans were allegedly raised during a discussion on Kashmir, prompting the authorities to book the NGO under relevant IPC sections including sedition.

Amnesty, on its part, has rejected as "without substance" the allegations made by ABVP, which had also filed a police complaint in connection with the event and submitted a CD of the proceedings, and claimed that none of its employees shouted any anti-India slogans at any point.

    It is true that the organisers should know who participates in a meeting. How can the organisers know a devil's mind? An errant mind can come in with an ulterior motive, can the organisers be held responsible? When Mr P Chidambaram was addressing a press conference as Home Minister one among the journalists flung a shoe at him. Can those who organized the press meet or those who were present be blamed for it? Pity that Mr Hegde is having utopian ideas.

    Justice Hegde may be right as regards filing of Sedition charge against Amnesty International. But then SC has held that incitement to violence is a necessary element & not mere talk, as the latter forms part of Freedom of Expression. Anyway, the Government has stated that they would verify if anti-national speeches/ activities took place. If not, sedition charges will be withdrawn. I'm sure law will take its course. However, I totally disagree with his contention on what AI did when soldiers were killed or terrorist acts took place to GET A RIGHT to organise events. If that were to be accepted, it would mean that CITIZENS have no right to speak on any issue or acts of Government as they did not do Anything when such situations occurred. Justice Hegde should know better. Can he speak like our "famous" TV anchors or panelists?

    Justice Santosh Hegde has always been a role model for all of us especially in curbing corruption without any fear or favour.Justifying the sedition charge against Amnesty International has perplexed me considering that our Apex Court has clearly enunciated its ruling in such cases.

    According to his knowledge he opined the charge is right, but not according to the law.
    As per his interpretation the organizers of Babri Movement are responsible & liable to prosecution as they cannot say like Advaniji said we couldn't control the crowd later.
    Same way CM of Gujarath & Haryana should be booked too for their inability to control Jat or Patel agitations causing inconvenience & in Haryana rape of women including the destruction of public property.
    Would Hegde justify if agitators in future are prosecuted along with their political mentors who call for such disturbances?

    Amnesty International didn't incite or provoked people to raise anti national slogans.
    ABVP people raised anti national slogans by covering their faces in JNU, here too the culprits should be booked & not organizers as they didn't the audience.
    Any Pseudo Nationalists can raise slogans to tarnish the image of any event organizers, according to you my above statement holds good, now present ministers in the PM cabinet had a hand to play in Ayodhya demolition should they be arrested for contempt of court too?
    How do you know whether AI didn't condemn terrorism? They are against any Human Rights Violations. They cannot be held responsible for not discriminating in condemning the same.
    Why no action is being taken when thousands of people marched with same slogans in J & K at the funeral of slain terrorist? What PDP & BJP government has done till now? Why they have lot of tolerance there?
    Hurting the weak is only strength of the present government & bakths rejoice in meek getting arrested as strength of present "Uttara Kumaras"

    Unfortunately a judge who does not know the law. The Supreme Court has held that unless there is an incitement to violence, merely shouting anti-India slogans does not amount to sedition.
