Heggade supports Cauvery stir, 'Not mandatory to obey SC order' - B V Acharya

Daijiworld Media Network - Beltngady (SP)

Beltangady, Sep 13: Dharmasthala Dharmadhikari, Dr D Veerendra Heggade, said that he wholeheartedly supports all the activists who have been fighting against injustice in the matter of Cauvery river water usage. "This is not just the fight of people using Cauvery river water. It is a fight being carried on by all the people of Karnataka. But the struggle must be continued peacefully without damaging properties," he opined.

Speaking at Dharmasthala on Monday September 12, Heggade noted that users of Caurery river water are aghast. They are facing injustice in the matter of river water use. All Kannadigas support them. But their mode should be non-violent Satyagraha. Property of government and people should never be damaged or destroyed," he felt.

He asked the concerned not to feel that people of Dakshina Kannada are not with them. "Many districts have been facing shortage of rainfall. River Netravati, where flood used to be experienced at least five to six times a year at Dharmasthala, is having dearth in water flow. People should not waste water. They should use it justifiably. Government also should spread awareness about this issue," he demanded.

Bengaluru: 'Not mandatory to obey SC order' - former advocate general B V Acharya

Daijiworld Media Network - Bengaluru (SP)

Bengaluru, Sep 13: Former advocate general and senior advocate, B V Acharya, has expressed the opinion that the order issued by the Supreme Court (SC) on release of Cauvery river water to Tamil Nadu has violated Interstate River Water Disputes Act.

He is of the opinion that as per section 11 of Interstate River Water Dispute Act - 1956, no courts including SC can interfere in the matter of interstate river water distribution disputes. Only tribunals or monitoring committees can redress the disputes. He therefore is of the opinion that SC has erred in passing order to release water to Tamil Nadu.

He was of the opinion that the SC had only two options before it on the review petition filed by the state government which came up before it on Monday. The SC could only dismiss or uphold it. It was not proper on its part to order the state to release additional water for four days. The state has the option of not adhering to this order on this point too, he felt.

At the same time, he said that if the court treats non-adherence to this order as contempt of court and acts accordingly, the government will have to be prepared to face the consequences. He felt that the government and opposition should unitedly take a decision and show the courage and conviction to boldly face the matter.

SC could have considered the need of Karnataka first before ordering the release of Cauvery water to TN on the condition that the TN government has to pay compensation to Karnataka. Water is scares and becoming a commercial commodity. Nestle leases water reservoirs.
Ten years from now, people who own open wells can make their living just by selling drinking water in India. A bottle of drinking water now sells for Rs.15 and the petrol is for Rs.60. With the introduction of all electric cars at the affordable price this year, the water and petrol price will perhaps be close to Rs.30 per litre in the near future.

They why our Advocate Naariman is silent about the issue. Why he has not defended the case properly on this issue. And how the Supreme Court has ordered for the release of water to Tamilnadu ? Why this confusion? Cant be this set right now?

Time to sack Fali Nariman as the counsel for Karnataka for filing an erroneously drafted application. The admission of the State before the SC is humiliating and an insult to the people of the State. If B.V.Acharya is right then explore the possibility of legally questioning the jurisdiction of the SC in dealing with such matters and obtain suspension of the verdict. Also constitute a team of expert advocates from Karnataka who will review the applications before they are filed by SC advocates representing Karnataka. At least now the stupid governments of Karnataka (past and present) should ensure Cauvery water is provided for the purposes of drinking to the people of Mysuru as nearly 75% of the city households depend upon bore well water. Shame on the Governments of Karnataka for their failure.

Tulunad people are the only ones who accept outsider language Kannada as the official language. Go to any other place in the entire India, the local language itself takes precedence.

As a staunch supporter of Modi Ji. With all due respect sir, I ask you one question- Why are you silent on this issue??.
You go to Foreign nations, international summits and give long speeches on cross border terrorism, peace, prosperity, growth, development, FDI etc.., now what's happening in Bengaluru, does it look good to your eyes?. Does it give you more FDI??..
Can't you see the tears in the eyes of this farmers?. Are these farmers not children of Bharath Matha?. What these poor farmers have done to you?. What people of Bengaluru has done to you?. Are you taking revenge for not voting you?.
This is not the type of politics you play. Yo were voted as PRADHAN SEVAK. But what are you doing now?. This is not expected on the lines of Modi Ji. In a Federal System, when there is disputes between states, will you keep quiet as PM?. Does that give you sound sleep?.
You need answers this to Kannadigas?. Or else does the Rajya Sabha MP numbers of AIDMK made you neglect Kannadigas?. No Modi Ji, it's not acceptable. We want you answer. we want you to act?.
Please do that before we loose all hope.

Hi VM, First of all Modi has no role to play in this. Only the states concerned and the courts. Why do u you indulging in Modi bashing? As the water is limited, it cannot satisfy eveyone. The court after a thorough inquiry and investigation has give the order that the water be shared.

The Central Govt. or Union Govt, has more powers. They only have to use them.
The Interstate River Water Disputes Act, is an Act of the Parliament of India enacted under Article 262 of Constitution of India on the eve of reorganization of states on linguistic basis to resolve the water disputes that would arise in the use, control and distribution of an interstate river or river valley.
Article 262 of the Indian Constitution provides a role for the Central government in adjudicating conflicts surrounding inter-state rivers that arise among the state/regional governments.
    Invoke Article.
Under Section 6A of this Act, central government may frame a scheme or schemes to give effect to the decision of a tribunal. Each scheme has provision to establish an authority for implementation of a tribunal verdict. Now say does or does not our PM has the power??.
