17 students of Milagres College had challenged refusal of hall ticket

Mangaluru, Nov 26 (DHNS): The High Court of Karnataka has refused to condone the shortage of attendance of 17 students of Milagres College, who were not allowed to appear for the examination for want of mandatory attendance.

The college had not issued hall tickets to 22 students due to shortage of attendance and 17 of them had filed a writ petition in the high court seeking directions to the college principal for issue of hall tickets. The students were studying BCom/BBM/BBA.

The students had claimed that they have paid the requisite fee and completed their 1st to 4th semesters in the college. The petitioners had contended that they were bright and intelligent students hailing from poor families and had attended all the classes. However, when their parents came to college for collecting hall tickets on October 24, 2016, the principal refused to issue hall tickets on the ground that they were short of attendance. The students had specifically contended that the college had not informed them about shortage of attendance at regular intervals.

Countering the contentions of the petitioners, the advocate for the college produced documents before the court to establish that the students and their parents had been informed about the shortage of attendance. It was pointed out that the names of students who were short of attendance were displayed at the college notice board every month. The advocate also produced the letters/memos sent to the parents informing them about the shortage of attendance of their children.

In fact, the college went one step ahead and conducted special classes to enable students make up for attendance shortage. As a result, 68 students could cross the mandatory 75 % attendance while 22 students reportedly did not take the issue very seriously. As a result, they were denied hall ticket as per the university rule. The high court, while dismissing the writ petitions filed by the students, said that it cannot direct the college or the university to permit the petitioners who do not have the required minimum attendance to take exams by condoning the shortage of attendance.

Assaulter still in jail

It may be recalled the students started protest against the college principal after Mohammed Shahanawaz, a III BBA student of the college, assaulted the college principal Fr Michael Santhumayor, over the same issue (attendance shortage) on October 20. The principal, who sustained serious head injuries, was hospitalised for many days.

Mohammed went into hiding for five days but eventually the police arrested him on October 25. He is still in judicial custody. The next day (October 26), 17 students approached the high court.

Elizabeth Neeliyara, the advocate and legal advisor to Milagres College, said that court order should be a warning to students who do not care to follow the college rules.

    Present generation need to teach like this lessons.Very good decision.They don't even care their parents.How much parents are struggling to bring up their children.Must take extra classes on how to behave with elders,parents and teachers...

    @Felca mulki,it is not extra classes to know about behaviour with elder People or teachers,but a thourough brain wash by cutting Money which is poured lavishly by parents,which they dont know the value of it ,how it Comes and hrdship connected with it for some of them.Make them earn their own bikes ,Partys financed and enjoying instead of studying.Of course all are not falling in this catagory.but one sees how parents give Money without asking why.Now atleast let this Student come to realize and make best use of his time to improve the lost time.what has brought his thrashing principal ,but only loss.

    Best step taken by the management. I have seen in other colleges that if you pay fine you can get attendance. This also should be stopped. There is no alternative for attendance. Hitting the Principal is the worst thing ever happened in Mangalore. He should be definitely punished ,this will be a lesson to others. Good job by the management. Stop student unions in colleges.

    Good Job by the HC for the denial of Petition. Student who dont adhere to the rules do not deserve any reward.A student can only be given 2 chances and this person is anyways matured enough to understand and if student says that he had not been informed about your attendance and let me tell you that even i have passed out from that same respected school and college and we have been informed every thing. So dont try to fool others.

    There were grave mistakes from the part of students... bunking classes, don't care for advise and one among them committed the crime of assaulting the principal that no disciplined student can imagine... Lawyers failed to convert the lie into truth, Very good lesson from the High Court... not only to those students... also to their defending advocates...

    It is sad that this group of students did not respond positively, and ended up messing their careers and probably, even their lives.

    The noble, selfless intentions of missionary-run educational institutions are beyond doubt. Hope this incident will be an eye-opener to all budding students who wish to make a mark in their life, and a worthwhile contribution to society.

    A college is expected not only to educate people but also inculcate true values in students.

    In the early stages of scholastic pursuit a student should be self disciplined and should adhere to college rules which are meant to bring the best out of students.

    Class attendance is of primary importance and is meant to ensure that the students get the best out of the lectures that they attend.
    Hope the parents and students understand the principles behind rules and regulations which are meant to bring the best of students.

    I am sure these students definitely started from home to college but they were missing on the way. This is totally cheating to their parents who is spending their hard earned money for their education. Some so called students unions should not use these students for the protest at the cost of their future. Students also should stay away from the radical organizations and concentrate on the studies only.

    If these students were disciplined, certainly they could have attended the special classes, where college had given a lenient opportunity also, these students surely are not poor. Out of 'Darpa' they went to court, challenging the university law.
