Bengaluru, Aug 11: The state high court has resented the failure of the prosecution to file objections to applications moved by five of the accused seeking to annul cases filed against them by the police relating to stone-pelting incidents which occurred during the funeral procession of Sharath Madiwala at B C Road.

Sharath Madiwala, a Rashtriya Swayaksevak Sangh activist who operated a laundry at B C Road was slain by three motor bike-borne people who remain untraced till now.

The petitions filed by right-wing activists, Satyajit Suratkal, Harish Poonja, Muralikrishna Hasantadka, Sharan Pumpwell and Pradeep Kumar requesting for quashing of cases filed against them came up for hearing before a single-judge bench of the high court presided over by Justice Arvind Kumar on Thursday August 10.

During the earlier hearing of this petition, the bench had asked the government advocates to file objections for these petitions on August 10 but this did not happen. The bench expressed unhappiness at the failure of the concerned in doing the needful. The bench stated that unless the advocates file objections on Friday August 11, the court will pass interim order as requested by the petitioners.

Advocates representing the accused claimed that the stone pelting incident was totally unconnected with their clients. They objected to invoking of several sections of Indian Penal Code relating to a number of charges including flaring up of communal passion.Therefore, they sought cancellation of these cases.

The police say that the accused are responsible for the stone pelting incident which happened during the funeral procession of Sharath. The accused have already secured anticipatory bail from the subordinate court.
