Moodbidri man arrested in Bengaluru for posting derogatory comment against Khader

Mangaluru, Aug 11: The police have arrested a man for posting a derogatory comment against minister for food and civil supplies U T Khader on Facebook.

The accused, identified as Divyaprasad (46) is a native of Hosamane, Daregudde in Moodbidri.

Divyaprasd works in a canteen in Bengaluru. He was arrested from his workplace on Thursday August 10 and brought to Mangaluru, police sources said.

 

Divyaprasad allegedly posted derogatory comments on Facebook against Khader pertaining to the 'Hello Minister' TV programme in which he was the guest.

A complaint was filed in this regard Beliyoor panchayat member Abdul Shukur.

Acting on the complaint, the Kadri police arrested Divyaprasad and produced him in court on Friday August 11.

A case has been registered under IPC Section 507 and Sec 67 of the IT Act.

    In democracy all have the full freedom of speech. But, can not use derogatory words. According to IPC, derogatory words can land you in jail. If someone does not understand this simple formula, then they are not fit to be in the Indian society.

    If his comments are absurd surely he should be punished. One should not use freedom of social media to the extent of defaming any other citizen.

    My question here is - always media publish this type of news. What actually he says or why he did it or he pleaded innocence or not etc will not come immediately.

    There are many people in the world who burn their anger against politicians. Can Police catch them all ? Because social media provided a proof Police caught them easily and eagerly tell to media that - "We have a CATCH". Some people who don't know that if they tell something in social media will be easily caught. But police have an easy CATCH. People have something to WATCH. His relatives and family have work to PATCH.

    Facebook to mask out the peoples face. I don't have a facebook account and not need one now or in future. My prayers with GOD are - Never ever make a me a CATCH of Police or Lawyer...

    If this fellow has written obscene then I do not think he can escape the law.

    In a landmark judgment, Supreme Court has struck down Section 66A  of the IT Act. In their order, the court said, Section 66A is violative of Article 19(1)(a), not saved by Article 19(2), hence unconstitutional. 
    Freedom of the speech is the fundamental right of every person and with this judgment Supreme Court has Court has termed Section 66A of the IT Act as unconstitutional and untenable. The court said that it violated the right to freedom of speech, a fundamental right guaranteed in the constitution of India. In a landmark judgement upholding freedom of expression, the Supreme Court on Tuesday struck down a provision in the cyber law which provides power to arrest a person for posting allegedly “offensive” content on websites.
    A bench of justices J Chelameswar and R F Nariman had on February 26 reserved its judgement after Government concluded its arguments contending that section 66A of the Information Technology Act cannot be “quashed” merely because of the possibility of its “abuse”. Additional Solicitor General Tushar Mehta had said that the Government did not want to curtail the freedom of speech and expression at all which is enshrined in the Constitution, but the vast cyber world could not be allowed to remain unregulated.

    Free speech is under great threat under this Siddharamaiah led Congress Government. So many sickulars keep abusing Modi and Amit Shah day in and day out but they are not arrested. Afterall what is the crime committed by this guy? Should he keep praising Khadar just like these Sickulars do? He has expressed his opinion now why should police arrest him? He is not a criminal neither he is out there to commit some crime. Criminals are let free under this government. The police has still not been able to nab the killers of Sharath Madiwala.
