Mangalore: Naushad Murder Case - No Need for Investigation by Outside Agency - Police

Mangalore, Apr 15: Dakshina Kannada Superintendent of Police A.S. Rao said there was no need for an outside agency to investigate the murder of human rights lawyer Naushad Kashimji.

The Mangalore Bar Association had demanded a probe by Central Bureau of Investigation (CBI) into the case, alleging negligence on the part of the police in the investigation.

Mr. Kashimji’s senior lawyer, Purushotham Poojary, who had lodged a complaint with Dr. Rao alleging involvement of four top police officials, also demanded a CBI probe.

Dr. Rao told presspersons on Tuesday that investigations were progressing well and he saw no need to hand over the case to the CBI. What had given rise to suspicion was that policemen themselves were investigating into allegations of involvement of top police officials in the crime, he said.

He added that the allegation was serious and was being looked into.

He would not reveal how that was being done but said that Mr. Poojary had only suggested that the police had a motive to murder Mr. Kashimji and that did not constitute proof.

He denied that there was any negligence on the part of the police in the investigation. Dr. Rao said the post-mortem and inquest of the body had been videographed and the services of ballistic experts from Bangalore were used. The post-mortem report was awaited, he said.

He said the first information report (FIR) was filed based on eyewitness accounts and there could not be a second FIR based on Mr. Poojary’s complaint. However, the police had included the information given by him in the scope of the investigation.

    The International human rights commission must take this case in hand and punish like Mr Milosovich president of yugolslavia who was also arrested by the ICTY, or the International Criminal Tribunal for the former Yugoslavia, a UN commitee, on charges of genocide, Crimes against humanity, and violations prompting the Serbian Prime Minister Zoran Đinđić to send him to The Hague to stand trial for charges of crimes. If human rights commission takes action many politicians will be sent to Hague in Netherlands to spend their rest of life in Jail.

    Janet and Vishal, your comments are most unfortunate one and on the lines of BJP's hidden agenda. Devided we fall and united we stand. The whole world knows, Ajmal Kasab is a teroorist. Why the government of India is providing a state funded lawyer to defend him. Dont comment without knowing the laws, or just for the sake of it.

    Dont make this forum sick for its readers. If I go by the comments Vishal, then why should we have courts, legal system and judiciary?

    Since there has been suspicion on the people behind the murder and police is one of them, its for the benefit of the police to hand over the investigations to an independent body. In todays world of Indian crime we have seen all institutions dabling in crime. So no one should be above suspicion. In this case though the lawyer was representing a criminal, he was within his right to defend as per Indian law. So no lawyer should be killed for this, and who is the murderer here?

    I have carefully gone through the news item re: the murder case. I have also read many comments on Police Investigations. It is not fair that one should cast any aspersions on the Police Department and more particularly on IPS officers. It is too early to comment on what Mr. Gopal Rao may do.     Mr. Vishal D'souza has no knowledge of Indian legal system. The trial of Kassab got delayed just because there was no defense lawyer. If you feel that no lawyers should defend the accused then what about those who represented killers of Mahatma Gandhi, Indira, Rajiv????? What about those defending Linga Raju, Harshad Mehta, Parekh, etc???? It is very much necessary to have a CBI inquiry since Naushad was handling many sensitive cases including Padmapriya Bhat's death case.

Don't repeat like Padmapriya case , till today you havn't released her post mortom report.     Dear Vishal D'Souza, you seem to be totally ignorant of the law and the Indian constitution, by which even the BJP swear by. In our country even a criminal has the right to be defended by a lawyer. Why don't you criticise the Jethmalani family who have been defending criminals all along?

    True honesty is the need of moment in this case, but meantime people lost faith in khaki's, i mean local govt. must act to bring back faith with khaki's by appointing CBI for this specific case since the khaki's are involved in this case and the attacks on churches last year as well. Khakis act like they are the sole judges to deliver punishment

    SP A S Rao has a greater responsibility to find the culprit soon, otherwise the blame will be on him for not getting the outside help to solve the case intentionally.This case will not die down that easily as some of the police officers think.     The only reason why this case should be refered to CBI is due to suspiouis invlovement of senior Police Officers in the murder..if Mr.Rao is so confident about the investigations then why Ravi Poojary is not arrested so far????

    I think it is better to close the case file without further investigation. What differece it makes if the case is closed now or after a few years later ? In fact, it can save a lot of money and time of police department.It is like asking a thief to find out who stole!!!
