Allahabad High Court Dismisses Petition by Sunni Waqf Board


Ayodhya Verdict: Babri Mosque Built at Ram Birthplace

Lucknow, Sep 30 (IANS): In a judgement much awaited by India, the Allahabad High Court Thursday ruled that the spot in Ayodhya where a makeshift temple was built hastily after razing the Babri mosque in 1992 was indeed where Hindu god Ram was born, lawyers said.

By a majority decision, the Lucknow bench of the high court also declared that the land around the disputed site would be divided into three parts -- one going to Hindus, another to Muslims and the third to Nirmohi Akhara, a Hindu sect and a litigant in the case.

Lawyers K.N. Bhat and Ravi Shankar Prasad, representing two of the Hindu litigants, said the bench had decided that Lord Ram was born where the Babri mosque was built in the 16th century.

"All the three judges, including S.U. Khan, are unanimous in accepting that the idol of Ram cannot be removed from the place where it is installed right now," Ravi Shankar Prasad said.

Dismissing the 60-year-old title suit filed by the Sunni Waqf Board, the judges said that none of the litigants would take any action on the land for the next three months.

"We are party disappointed. We will approach the Supreme Court," Sunni Waqf Board lawyer Zafaryab Jillani told reporters.

Minutes after the ruling, Ravi Shankar Prasad, who is also a leader of the Bharatiya Janata Party (BJP), urged Muslims to help in the construction of a grand Ram temple in Ayodhya, an Uttar Pradesh town about 700 km from New Delhi.

"After this ruling, I make a humble appeal to the Muslims of this country, please accept this verdict, please help in the construction of a temple... It will lead to a new brotherhood in the country," he said.

The lawyer added that he was making the appeal not as a BJP leader but as a citizen of India.

"It is definitely in favour of the Hindus," said H.S. Jain, counsel for the Hindu Mahasabha. He said he too would approach the Supreme Court to campaign against the land given to the Sunni Waqf Board.

Leading theatre personality Aamir Reza Hussain said it was time for Muslims to give up the land for a Ram temple.

"It absolutely the time to heal the wounds, and to let it go," he said.

The ruling followed years of litigation that at one staged threatened to rip apart the country's communal fabric.

Allahabad High Court rules by majority that the disputed land in Ayodhya be divided into three parts - site of the Ramlala idol to Lord Ram, Nirmohi Akhara gets Sita Rasoi and Ram Chabutara, Sunni Wakf Board gets the rest.

Status quo will be maintained at the disputed site in Ayodhya for three months. However, the time for the final decree has not been decided.

The suit filed by the Sunni Wakf Board has been dismissed. However, Muslims are entitled to offer prayers and consider their share of the land as a mosque.

The three separate synopsis of the three judges, Justice S U Khan, Justice Sudhir Agarwal and Justice D V Sharma was made available to the media.

The portion below the central dome has been declared as the birth place of lord Ram and will go to the Hindus. S U Khan also said that the property was jointly held by the three parties among whom it has been divided.


As per the information posted on the Allahabad High Court website, the following were the issues for briefing:

1. Whether the disputed site is the birth place of Bhagwan Ram?
The disputed site is the birth place of Lord Ram. Place of birth is a juristic person and is a deity. It is personified as the spirit of divine worshipped as birth place of Lord Rama as a child.

Spirit of divine ever remains present every where at all times for any one to invoke at any shape or form in accordance with his own aspirations and it can be shapeless and formless also.

2. Whether the disputed building was a mosque? When was it built? By whom?

The disputed building was constructed by Babar, the year is not certain but it was built against the tenets of Islam. Thus, it cannot have the character of a mosque.

3. Whether the mosque was built after demolishing a Hindu temple?

The disputed structure was constructed on the site of old structure after demolition of the same. The Archaeological Survey of India has proved that the structure was a massive Hindu religious structure.

4. Whether the idols were placed in the building on the night of December 22/23rd, 1949?

The idols were placed in the middle dome of the disputed structure in the intervening night of 22/23.12.1949.

5. Whether any of the claims for title is time barred?

O.O.S. No. 4 of 1989, the Sunni Central Board of Waqfs U.P., Lucknow and others Vs. Gopal Singh Visharad and others and O.O.S. No.3 of 1989, Nirmohi Akhara and Another Vs. Sri Jamuna Prasad Singh and others are barred by time.

6. What will be the status of the disputed site e.g. inner and outer courtyard?

It is established that the property in suit is the site of Janm Bhumi of Ram Chandra Ji and Hindus in general had the right to worship Charan, Sita Rasoi, other idols and other object of worship existed upon the property in suit. It is also established that Hindus have been worshipping the place in dispute as Janm Sthan i.e. a birth place as deity and visiting it as a sacred place of pilgrimage as of right since time immemorial.

After the construction of the disputed structure it is proved the deities were installed inside the disputed structure on 22/23.12.1949. It is also proved that the outer courtyard was in exclusive possession of Hindus and they were worshipping throughout and in the inner courtyard (in the disputed structure) they were also worshipping. It is also established that the disputed structure cannot be treated as a mosque as it came into existence against the tenets of Islam.

Como'n guys let's focus on our socio-econobic problem instead of this stupid matter. "A country will develop only when religion is become personal matter, otherwise it will teared by inch by inch atleast mentally if not geographically. God bless all of us.

    Babur invaded India in 1526 and ruled upto 1531.Ramcharit Manus was written by Tulsidas between 1574 & 1577 and he has not written anything about the demolition of temple,or Ramjanmbhoomi in his poems ( ramcharit manus)...

    A changing mood of Indian judiciary which is making space to give a room to " Astha " a judicial sanction and en corporate the majority communities perverted views on idea of India, is more dangerous than ignoring the facts & denying justice. The verdict not only encircled the Muslims but all other minorities to tell them that, you have the live with the terms dictated by the majority - not by the spirit of the constitution.
    Where India will go from here? What will prevail? The rule of law or the rule of jungle?

    VERY VERY INTELLIGENT JUDGEMENT ! Judges didn't give anyone a chance to fight. May be some are unhappy but have been forced to keep quiet.Ayodhya residents (hindus & muslims )don't want to go to Supreme court.But neighbours don't want to stop this matter here.Still 60 years waiting is not enough ?

    How can the judges categorically say that Lord Rama was born on that site? Are they 100% sure of that? They could say whether or not a temple existed before the mosque - anything else is not a fact.

    It is a sad for India and the legal system. Property rights have not been respected. Instead of rendering a just, legal opinion, the court has surrendered to fear. Fear of retaliation that if a certain segment of society is angry, all hell will break loose. How can anyone say India is a secular country after reading this verdict that is completely one-sided.

    I totally well come the decision made by ALLAHabad high court Judges.at the same time I request to all my bros, sisters as well as Sunni waqf board don't approach Supreme court agnaist above verdict.in 60yrs there is no prayer (NAMAZ) taken place means the disputed Babri Masjid not be called a Mosque bcoz if there is continive 40 days prayers not made in the build,in the Islamic law it should not be called Mosque,i mean the the masjid status will go.so think about Babri Masjid there was not made any prayers for 60yrs.in this regard once again i request my Muslim community to show our secular mind to the World.     the court has tried to satisfy all..i dont think advani is happy unless the temple should be built by bjp government so he can always say we built ram temple.it is a unstable moment again,the muslim board may go supreme court,the matter will drag another 60 years,after all court proved the idols were kept at midnite and not a miracle.

    This is a good political judgement, but a very very poor legal judgement.

    Land rights in India are determined by land documents dating from Independence time, ie 1947.

    By digging up land, going by beliefs, the courts have indeed made a mockery of the legal system and land holding rights, which has become a joker by this verdict.

    But this is apna justice system anyway. Congress has played the communal card, indeed.

    Let us wait for some more time. The court has said that nothing to be done for 3 months. In the mean time the Sunni Waqf Board will approach the Supreme Court. Who knows, the Supreme Court may give a better judgement which might please all the parties concerned. Honestly, this judgement is in favour of the Hindus. But telling the Muslims to help build the temple is a bit too much. In fact it is the Hindus who should be magnanimous in their attitude and help the Muslims to build a proper mosque which is acceptable to them. After all, did not their leaders promise to take brick by brick from the existing structure and rebuild it at a suitable place, prior to the demolition? As a non Hindu and as a non Muslim, I can only pray for both Hindus and Muslims to help each other to heal the wounds. I also hope that some people will not take advantage of collecting money in the name of building the temple and pocketing it to themselves.

    Great judgement by Judges by Sharma who has retired today.All the judges will be remembered in the minds of the Indians for a long time.Judgement has demonstrated the world the great power of Indian judiciary.As stated by tall personalities, judgement is not a win or loss for anybody but demonstration of inheritance of tolerence and peaceful existance of two major communities.Let us accept the judgement in true spirit as matured citizens.Bond between the two communities should be fortfied by extending full support by muslims to hindus to build the grand Ram temple in the alloted place and hindus should extend full support to muslims to build the mosque.This will send a strong message to the world about our capabilities of peaceful co-existance of hindus and muslims and in that event no force on the earth dare to see India with ulterior motives.Jai Bharat.

    Satyameva jayate-truth alone is victorious...fact & evidence seeking people may not agree...but I think judges displayed extraordinary wisdom in delivering this wisdom..like King Solomon did between two mothers who claimed to be the real mother...cut the child in two parts giving each one half..now it is upto the people of India, whether Muslim or Hindu to show magnanimity.. and give in to each other...join one another and build a temple and a mosque side by side... live and let live in peace and love...show it to the World...It Happens only in India...

    First of all this was a 'Panch' verdict to satisfy all the party in dispute and not a fact related judicial verdict.
    Babri Masjid was a functional mosque where five times prayers performed by the faithful since built in1527. The first Hindu-Muslim riot broke out over Ram Janma Bhoomi issue in 1853 during British rule. And later in 1949 in the middle of one night a group of 50-60 militants of Hindu Mahasabha entered Babri Masjid after breaking the gate lock and established therein an idol of Shri Bhagwan and painted Sita Ram, on the outer and inner walls with Red Loam. The following morning a large supporter if Hindu Mahasabha attempted to enter the mosque to make offerings to the deities. On hearing this news, then PM Jawaharlal Nehru directed Uttar Pradesh CM to get the deities removed. However, the sitting District Magistrate one Nair feared that the Hindus would retaliate and pleaded his inability which was the first failure by the authority.
    Unfortunately, the Muslims who were not party to the 500 old disputes, stopped from praying in their own mosque that was one of the largest mosques in Uttar Pradesh with a fine architectural design and as per G Pickford, an Architect to Lord William Bentinck (1828–33). Finally, after Advani’s Rath Yathra, in 1992, the militant Kar Sevaks of RSS demolished the mosque and the whole world condemned it.
    Today the Lucknow Court gave ‘Sabka Kalyan Ho’ verdict and not ‘Satyameva Jayate’

    First of all inference need not be a fact.I feel it should have been divided like this:20% Hindus,20%Sunni Muslims 20%Nirmohi Akhara 10% Babers Great Great Grand Children,2% Christians,2% Sikhs,2%Buddhists,2% Jains,2%Communists,2%Dalits,2%BJP,2%Congress,2%Bhajrang Dal 2% Hindu Mahasabha 2% Western Tourists 2% Unemployed Youths who demolished it, 2% for the Judges for their wisdom in delivering the judement and time,2 % to be reserved for further calims, clashes and litigation,2% for Media 2% for the Property Developers to assess the wise investment made by Baber.If any one is left out he or they can put up a claim.

    The court said archaeological evidence showed a temple had pre-dated the mosque. That means Babri Masjid constructed by razing down the temple for whatever reasons. As I always advocated, time has come for the Muslim community to withdraw the claim for that land and show to the world that Muslims are for PEACE. After all, Kaaba in Mecca and other Mosques in Iraq are sacred for Muslims.

    The verdict is supreme and very very accommmodative for all. The verdict itself lets the ground for reconcilation. If the land is devided in parts for 2 communities, the bone of contention shall always leads to violence and claims and counter claims. In the larger interest of peace and harmony, muslims should come forward and gift their part of land to hindus for building a grand temple and in return the govt should allocate a land and help them in building a grant masjid else where.

    This is the time to negotiate and enter into permanent solution and everlasting peace. My dear muslims clergies/politicians please dont allow this golden opportunity to slip away. Such occasions seldom come. Here, in this moment we have to show to our hidu brothers that we really love them, care for them, respect their sentiments and we must show to the world that Islam truly stands for peace, security and sacrifice and tolerance. Its not a selfish religion. Islam beleives in the welfare of masses. I congratulate the Allahabad Higho court for its farsighted verdict. The law of the land must be resprected by all. Already there are calls from fundamentalists to start building a temeple after this verdict. Please dont be haste. Give some more time for reconcialtion so that both communities think cooly and act or else violence will be order of the day

    belonged to Babar or the person who constructed the mosque or under whose orders it was
    constructed.
    3. No temple was demolished for constructing the mosque.
    4. Mosque was constructed over the ruins of temples which were lying in utter ruins since a
    very long time before the construction of mosque and some material thereof was used in
    construction of the mosque."

    Quite fair decision at the end. But , I wanted the verdict to be "No mans Land". It means niether to Hindus nor Muslims. The land shuold have taken under Govt of India and there would be a garden named "INDIAN GARDEN".

    The following is from an article in Times of India about Abdul Wahid and his family which is an exceptional example of communal harmony for all of us.

    This humble `dresswala' sends across a strong message that religion is meant for bonding people, not dividing them.

    Be it Lord Rama, Laxman, Sita, Ravana, or Hanuman, all these characters wear the dresses made by Wahid and his family.

    "Mandir aur masjid ki baten karna sirf faltu logo ka kaam hai, jab unke pas koi aur kaam nahi hai karne ko to kya karen, (the issues of temple and mosque are being talked by people who do not have any other work to do)," said Wahid's younger son Abdulla. "For me, Ram and his life is as important as that of Allah. And why only me, I believe youngsters, be they of any any religion, have grown watching the epics like the Ramayana and Mahabharata on TV," he added.

    Let us now abide by the verdict and say "Saare Jahan se achcha..."

    This will not end here. Some one or other will be unhappy (specially BJP govt) and case will goto Supreme Court. Supreme court will give its verdict on September 30, 2110 (after 100 years) during UPA govt rule.

    This is one of the best judgements that could come on Ayodhya issue for the unity and oneness of Indian citizens. There does not seem to be any necessity to go to the Supreme Court.
