Bangalore: Challenge a Cop in Mufti, get Beaten up

Bangalore, Nov 4 (DC): A study of the police work culture in the state does not seem to have changed the way the cops function. Bengaluru city police’s ‘police raj’ was exposed in a Sunday afternoon incident in City Market police station.

A mechanic from Puttur near Mangalore, Kushalappa, was still limping on Tuesday for asking a policeman in mufti to show his identity card. A resident of Mattikere in the city, Kushalappa had gone to the Sunday Bazar around 1 pm to buy dumbbells. He parked his bike at a spot where other bikes were parked and went to the market. When he returned, Kushalappa saw a man pushing away his bike. “He wore slippers and looked like a civilian. When he said he is a policeman, I asked him for some ID card. He flashed his card and said my bike was not locked and that I have to come to the station. I apologised and followed him,’’ Kushalappa said.

But Kushalappa had no inkling that he would be dragged into the police station and beaten black and blue. “I was taken to the City Market police station around 1.30 pm and a police constable came from a room and snatched my mobile phone and purse. I was asked to sit along with two thieves on the floor. A police officer, who sits in the chamber on the right side in the police station, came and flashed his ID card at me. He asked me to tell him what that was. When I said it is an ID card he slapped me and I fell on the ground,’’ Kushalappa said.

His troubles did not end there. A police constable asked Kushalappa where he hailed from. Kushalappa then got the notorious police treatments — Bombay Cut and Aero plane. “The moment I told them that I am from Mangalore, the officer hurled abuse at me and got a lathi from his assistant. He asked me to stretch my hands and when I did so, he hit me several times with the lathi. When I tried to pull back my hand, he threatened me to hit me for 50 times. I repeatedly apologised for asking for the policeman’s ID, but in vain,’’ Kushalappa said.

His ordeal did not end there. The policemen reportedly asked Kushalappa to jump continuously for an hour to reduce the swelling. Later, around 6 pm, the officer said he will book Kushalappa under sections 506 or 505 under IPC. “I got scared and pleaded with them to let me go. They discussed among themselves and took Rs 500 before letting me go. I got admitted at Ramakrishna Nursing Home where my relative is a doctor,’’ he said.

Just a few days ago, a police inspector, who was under suspension and presently at the City Control Room, had threatened a journalist that he will be bumped off in an encounter. City police commissioner Shankar M. Bidari reacted saying citizens should obey the orders of an officer in uniform. But the City Market incident suggests that they do not even need to be in uniform.

    There are so many cases of unlawful arrests and unlawful police custody without producing infront of a magistrate.The Police cannot keep a person in custody for more than 24 hours and cannot arrest a citizen without proper evidence of a offence.In the case of Kushalappa he should have resistered for a arrest and grabed attention of the public.

For decades, successive governments have failed to deliver on promises to hold the police accountable for abuses and to build professional, rights-respecting police forces.

    The 118-page report, "Broken System: Dysfunction, Abuse and Impunity in the Indian Police," documents a range of human rights violations committed by police, including arbitrary arrest and detention, torture and extrajudicial killings.

    "India is modernizing rapidly, but the police continue to use their old methods: abuse and threats," said Brad Adams, Asia director at Human Rights Watch. "It’s time for the government to stop talking about reform and fix the system."

    Several police officers admitted to Human Rights Watch that they routinely committed abuses. One officer said that he had been ordered to commit an "encounter killing," as the practice of taking into custody and extra-judicially uting an individual is commonly known. "I am looking for my target," the officer said. "I will eliminate him. … I fear being put in jail, but if I don’t do it, I’ll lose my position."

    Home minister of Karnataka should take cognizance of this unlawful incident from the policemen ,who are there to protect the law abiding citizens but not to harass them, and order a thorough enquiry and dismiss the policemen concerned , if found guilty. It is a shame on Bangalore police. These policemen are under the wrong impression that just by wearing Khaki uniform they are entitled to do whatever nonsense they think fit on hapless citizens . What is wrong in asking a cop to establish his identity if the same was in doubt ?.

    The uniform is not for taking the law in hands,its just for carrying out the duty as policeman according to the law,i am surprised to see Mr.Shankar Bidaris statement in this case,where in instead of punishing the policemen for their misbehaviour they are being justified ,I have one of my colleague who is a senior Engineer from Chennai who flew from Abudhabi to Bangalore & was taken to police station & harassed along with some 4other co passengers,just for the sake of money by the police.Even the gold which he had in his pocket was looted by the police inside the station but the poor man couldnt do anything but to return without uttering any word.He was swearing he will never travel again to Bangalore .What a shame!!!
    There are some who are trying to drag the religion & party in this issue,also trying to poke Nagesh for no reason,pls do not go out of the issue while commenting,its no party or people who direct the police to misbehave,its law acting blind on such issues leading to growth in such unruly things by the police.

    Don't understand why Bidari is asking us to obey the orders of a policeman in uniform. That is valid only if the order is lawful. They can't use that power to harass people. No wonder they are known as criminals in uniform.

    We citizens, Know the culture of Police everywhere in the world and specially in India. This is not the first time incident. There are many incidents where these police are act like 'rakshasas'. Even though we demand an action from higher authority, they will promise for the time being and will not do anything. They will forget the incident very next day because there will be many more similar incidents that day. this is our culture, cant be changed. Need proper education before joining this police force for these people. Show them some video clippings for some foreign countries' polices and their behaviour. Teach them humbleness. Make them understand that, the normal people also have some dignity and they need to respect their life. Even though here Mr Kushalappa is a machanic, he has respect to his job like police.

    Most police are really robbers in uniform. Firstly Kushalappa has the right to ask for ID as the concerned policeman is in civil clothes. Secondly, not locking his bike is no crime and no business of this policeman. Thirdly he had no right to drag him to the police station. Fouthly the duty officer who is incharge should be pulled up and lastly these police men at the station took Rs.500/= from this person all these persons should be booked & each should pay Kushalappa Rs.500/= for this kind of robbery in uniform. This is just shameless of police and I am 100% sure they took money because I have experienced this kind of robbery from policemen in my life too. Any innocent person cannot get out of a police station with out shelling out money. This is the sad state of our Indian Police Departments. As most our Government babus are themselves big thieves, I doubt any action will be taken.

    Many of us have experieced the same with the police . Police think they have the law in their hands, instead of maintaining law they break law by doing these activities like Terrorist ,they always torture the poor . The police in Gulf States seems to be more deciplined than our Indian Police. There are only few Indian Cops like Mr Subash Bahrani, KPS Gill , etc, are well discplined and it is only because of them Indian police have servived.

    Reminds me of a similar incident where I was riding with 2 pillion riders on my Honda activa and a person in mufti stopped me near Manyata Tech park , Bangalore. – he claimed to be a policeman and asked me for my licence and tried to snatch away the keys. I refused and held on to the keys and in the scuffle, his fingers were squeazed in between the keys. Angered by this, he called couple of his friends ( who were also in mufti )and asked me to get o the bike and come to the police station.

    He showed me his Khaki trousers and said he is a policeman.. I questioned him saying even drivers, students and municipal workers wear Khaki and asked him why I should believe him. I told him I admit that I have violated the traffic rules as we were 3 people riding the 2 wheeler, however, I refused to pay the fine unless he gve me a proper receipt for the fine collected.

    After some time, a traffic Assistant sub inspector ( An elderly man) came by and took stock of the situation, I told him I am ready to pay the fine as long as I get a receipt. No sooner did I pulled out a 100 rupee note from my wallet, the traffic inspector snatched the note from me, and asked all the 3 of us to hop on to the bike and carry on where we were heading… and he pocketed my money and walked away much to the amazement and surprise of the so called policeman in mufti who had stopped me in the first place HA HA HAHA..

    This inspector should also be beaten in a same manner and the police should be beaten in public so that the police also knows that he shouldnt beat any innocent for such a simple mistake of not locking his bike. And now a days all show they are some or the other big shots so what Kushalappa did was right by asking him his ID cause he was in the formals. The police department should react immediately and book the police under sections 506 or 505 under IPC.He should be taught a lesson so that no other police commits this mistake again.
