"Govt cannot Order Probe into Land Scam without Lokayukta's Approval"

Bangalore, Nov 26 (PTI): Lokayukta Santosh Hegde on Friday objected to the state government's decision to order a judicial probe into land scam allegation faced by Chief Minister B S Yeddyurappa and said he will complete the pending inquiry into a complaint on the same issue.

Hegde, who has written to the government said, "they cannot take away this pending inquiry by me," and rejected government's contention that the judicial probe covered a wider gamut of issues and the Central Act under which the inquiry has been ordered supersedes the state Lokayukta Act.

"There is a clearcut provision that (only) with prior consent (of Lokayukta)... the government can order probe into an issue which was already before the Lokayukta," Hegde, a former Supreme Court judge, told PTI.

Hegde's strong comments came even as former High Court judge B Padmaraj agreed to head the one-man commission of inquiry to probe land scam charges against the Chief Minister.

Yeddyurappa had ordered the probe after facing a barrage of allegations of corruption, nepotism and favouritism from the Opposition over allotment of Karnataka Industrial Area Development Board (KIADB) lands to his daughter and denotifying Bangalore Development Authority (BDA) lands to his son-in-law and sons.

Padmaraj, in a letter, has communicated his acceptance to head the Commission in the public interest, official sources said here today.

He has asked government to provide him with necessary infrastructure for the smooth functioning of the commission.

Hegde said the state government did not have the authority to order a judicial probe when an inquiry was pending before the Lokayukta.

"It (the issue) could not be referred to another inquiry without the prior approval of the Lokayukta," he said.

He alleged that those in the government quoted the law without understanding it and said the Karnataka Lokayukta Act was passed with the assent of the President of India.

Yesterday, Higher Education Minister and senior state BJP leader Dr V S Acharya had said that the Central Act takes precedence over the state act.

Hegde said as per section 8(2B) of state Lokayukta Act, any pending inquiry before the ombudsman body cannot be taken away from it.

He said Lokayukta had "travelled a lot of distance" on its inquiry into alleged irregularities involving KIADB, one of the issues referred to the judicial probe.

He said JDS spokesman Y S V Datta had petitioned Lokayukta on November 18 seeking a probe into land scams and the ombudsman has already taken note of it as it was a fit case for inquiry.

Last year, Hegde had resigned his post fuming that the BJP government was not serious in fighting against corruption and his report on illegal mining did not evoke any action.

In the wake of public outrage and condemnation from Opposition parties, BJP central leadership led by party chief Nitin Gadkari and senior leader L K Advani persuaded Hegde to withdraw his resignation.

    After being exposed in the Land Scams and even admitting and willing to return the property, for what reason or why is he trying to appoint a one man committee to further utilise the tax payers money. Further there is an organisation called Lok Ayukta to look into irregularities and scam, BSY must have forgotten or try to hide his misadventures from the Lok Ayukta. It is shame that he is continuing as the CM. It is better he put a milestone round his neck and jump into a well. Such cheats should be whipped in public and send them to the baracks.

    I believe, Mr. Santhosh Hegde is a honest person, he will do impartial enquiery, and bring out the truth, he cannot be influenced by any one. All political parties should agree on his stand.b Padmaraj has already obtained a plot illegaly and is not the right person to investigate land scam.

    If mr. VS Acharya says, a central law is above state law. then can the BJP government of the state say why dis they not ask for a CBI enquiry inot the ilegal mining case. Why now is the Acharya citing the Central rules? doesnt he have trust in the lokayukta?????

    I cannot appoint a commission to investigate me. My Supervisors or a person in senior position should do that to me. It is called conflict of interest. Can a murderer, accused person, an admitted felon like Karnataka Chief Minister or corrupts person can choose an investigator or a judge to investigate him or judge him. Answer is always BIG NO, Chief Minister may ask the Governor or central Government to investigate or judge the case, which he is involved with, without any pre condition because the office of Governor & Central Government is above the State Chief minister & State Government. No wonder why lawyers in India make least pay comparing to other professions. People should remember that any elected or nominated office is not a right. It is a privilege. It should be surrendered when a conflict arise so it may be properly investigated by the power above

It is time that all of us, the common people of Karnataka to stand united and support the noble cause of Mr Hegde to fight against the corrupt Government and help him to book these culprits to get them the desired punishment. We have witnessed enough of drama by the great Yeddi and his team. This is a golden opportunity for all of us, who have erred in electing these dirty and greedy people, to take corrective action. Left unchecked they will sell our state within no time. Let us strengthen the hands of Lokayukta by providing at least moral support to him. He is the only hope left for us to bring this state back on its track of growth and prosperity. Let us not loose this golden opportunity else our future generation may not pardon us for breeding corruption in the public life.     One man judicial enquiry against
    the corruptions of a CM or people
    of that caliber, is the biggest
    political drama behind the curtain.

    Is the government too poor to
    appoint 5 impartial judges from
    various States to dig down the
    root of the matter!

    These kinds of "whitewash" jobs
    to fool the public are being done
    all across India, but there is no
    record of anybody got punished or
    in jail. Since majority of the
    people have the problem of "amnesia", this show can go on
    without any end.

    Thank God, atleast we have one
    person, Justice Santosh Hegde to
    speak the truth openly.

    Justice Santhosh Hegde has spoken loudly this time, to show his anger over the Politicians, who act like Law unto themselves.
    Whenever Lokayukta asks for more Power from the Legisltors,they shy away.This shows their apathy towards Corruption in high places. We can only dream to have a clean imaged Politician, like Lal Bahadur Shastry of yester year in India today.
    God Bless our Legislatures who enact Law for their personal benifit and break Law as their whims and fancy.
    I wish MR. HEGDE all the best, let our all mighty God give him strength to confront and tame, all the evil and corrupt Big Wigs.

You will remain a mute spectator to the developments and the one man judicial commission (He too may have been one of the most corrupt judges)will continue his work. I mean, YOU ARE HELPLESS.

    Only justification BJP is giving on corruption is that "we are only following the precedent set by congress" if that's true then NDA is also culpable in 2G as A Raja has repeatedly said he's merely following NDA policies initiated in 2003.Even back then, CAG had indicted NDA govt for causing loss of 60,000 cr for exchequer.So BJP has to account for 60,000 cr loss to indian govt.

    Secondly, they have approved of yeddi's land scams & reddy's mining mafia but go gaga about Ashok Chavan for alloting a single flat to his relative and bring him down.

    Thus because of sheer arrogance & double standard BJP has been exposed before the people of karnataka and india.

    BJP is unfit to rule india and will have to sit in the opposition for atleast another 10 years.
